44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to information on projected changes in weather and water
77 availability in strategic plans of certain state agencies.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2056.002(b), Government Code, is amended
1010 to read as follows:
1111 (b) The Legislative Budget Board and the division of the
1212 governor's office responsible for budget and policy [Governor's
1313 Office of Budget, Policy, and Planning] shall determine the
1414 elements required to be included in each agency's strategic plan.
1515 Unless modified by the Legislative Budget Board and the division
1616 [Governor's Office of Budget, Policy, and Planning], and except as
1717 provided by Subsection (c), a plan must include:
1818 (1) a statement of the mission and goals of the state
1919 agency;
2020 (2) a description of the indicators developed under
2121 this chapter and used to measure the output and outcome of the
2222 agency;
2323 (3) identification of the groups of people served by
2424 the agency, including those having service priorities, or other
2525 service measures established by law, and estimates of changes in
2626 those groups expected during the term of the plan;
2727 (4) an analysis of the use of the agency's resources to
2828 meet the agency's needs, including future needs, and an estimate of
2929 additional resources that may be necessary to meet future needs;
3030 (5) an analysis of expected changes in the services
3131 provided by the agency because of changes in state or federal law;
3232 (6) a description of the means and strategies for
3333 meeting the agency's needs, including future needs, and achieving
3434 the goals established under Section 2056.006 for each area of state
3535 government for which the agency provides services;
3636 (7) a description of the capital improvement needs of
3737 the agency during the term of the plan and a statement, if
3838 appropriate, of the priority of those needs;
3939 (8) identification of each geographic region of this
4040 state, including the Texas-Louisiana border region and the
4141 Texas-Mexico border region, served by the agency, and if
4242 appropriate the agency's means and strategies for serving each
4343 region;
4444 (9) a description of the training of the agency's
4545 contract managers under Section 2262.053;
4646 (10) an analysis of the agency's expected expenditures
4747 that relate to federally owned or operated military installations
4848 or facilities, or communities where a federally owned or operated
4949 military installation or facility is located;
5050 (11) an analysis of the strategic use of information
5151 resources as provided by the instructions prepared under Section
5252 2054.095; [and]
5353 (12) for the Department of Agriculture, Texas
5454 Commission on Environmental Quality, General Land Office, Texas
5555 Department of Housing and Community Affairs, Texas Department of
5656 Insurance, Parks and Wildlife Department, Department of Public
5757 Safety, Public Utility Commission of Texas, office of the
5858 comptroller, Texas A&M Forest Service, and Texas Water Development
5959 Board:
6060 (A) an analysis of expected changes, including
6161 adverse impacts, in the services provided by the agency because of
6262 projected changes in weather, water availability, and climate
6363 variability, as determined by the Texas state climatologist's
6464 report under Section 2056.005(c);
6565 (B) for each period described in Section
6666 2056.005(c), a description of the means and strategies for meeting
6767 the agency's needs and managing the risks associated with the
6868 projected changes in weather, water availability, and climate
6969 variability as determined by the report; and
7070 (C) for the means and strategies described by
7171 Paragraph (B):
7272 (i) identification of any financial
7373 resources that will be needed to carry out those means and
7474 strategies; and
7575 (ii) an analysis of partnerships and
7676 cooperation between the agency and other state, local, and federal
7777 governmental entities that will be needed to carry out those means
7878 and strategies; and
7979 (13) other information that may be required.
8080 SECTION 2. Section 2056.005, Government Code, is amended by
8181 adding Subsections (c), (d), (e), and (f) to read as follows:
8282 (c) Not later than February 1 of each even-numbered year,
8383 the Texas state climatologist shall provide to the Legislative
8484 Budget Board, for use in the strategic planning of a state agency
8585 listed in Section 2056.002(b)(12), a report on projected changes in
8686 weather, water availability, and climate variability across the
8787 state for a period of:
8888 (1) five years beginning with the next odd-numbered
8989 year; and
9090 (2) at least 20 years and not longer than 50 years
9191 beginning with the next odd-numbered year.
9292 (d) The report under Subsection (c) may include:
9393 (1) projections of precipitation;
9494 (2) projections of temperature;
9595 (3) projections of stream flow in Texas rivers;
9696 (4) projections of evaporation rates;
9797 (5) projections of soil moisture rates;
9898 (6) projections of sea level changes;
9999 (7) projections of coastal storm intensity;
100100 (8) projections of inland and coastal flood intensity;
101101 (9) likely ranges of variability for all projections;
102102 (10) any estimations of the likelihood of the
103103 forecasts, as considered appropriate by the Texas state
104104 climatologist; and
105105 (11) any additional factors that are considered useful
106106 for state agency strategic planning by the Texas state
107107 climatologist.
108108 (e) The Texas state climatologist may use a forecast created
109109 outside of the office of the state climatologist if the forecast is
110110 considered suitable by the climatologist for the requirements of
111111 the report.
112112 (f) Not later than March 1 of each even-numbered year, the
113113 Legislative Budget Board shall distribute the report provided under
114114 Subsection (c) to the state agencies listed in Section
115115 2056.002(b)(12) for use in each agency's strategic planning.
116116 SECTION 3. This Act takes effect September 1, 2019
