96 AN ACT
10- relating to prohibited retaliation against state or local public
11- employees for reporting certain violations of law.
7+ relating to whom certain violations of the law by a state or local
8+ governmental entity may be reported.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 554.002(a), Government Code, is amended
1411 to read as follows:
1512 (a) A state or local governmental entity may not suspend or
1613 terminate the employment of, or take other adverse personnel action
1714 against, a public employee who in good faith reports a violation of
1815 law by the employing governmental entity or another public employee
1916 to:
20- (1) the reporting employee's immediate supervisor, or
21- an individual who holds a position above the reporting employee's
22- immediate supervisor, at the employing governmental entity;
17+ (1) the reporting employee's supervisor at the
18+ employing governmental entity;
2319 (2) an individual or office designated by the
24- employing governmental entity as the individual or office for
25- reporting such grievances;
20+ employing governmental entity as the appropriate individual or
21+ office for reporting such grievances;
2622 (3) a member of the human resources staff of the
2723 employing governmental entity; or
2824 (4) an appropriate law enforcement authority.
29- SECTION 2. Section 554.009, Government Code, is amended to
30- read as follows:
31- Sec. 554.009. NOTICE TO EMPLOYEES. (a) A state or local
32- governmental entity shall inform its employees of their rights
33- under this chapter by:
34- (1) posting a sign in a prominent location in the
35- workplace; and
36- (2) providing its employees with a copy of the
37- anti-retaliation policy adopted by the entity under Section
38- 554.0095.
39- (b) The attorney general shall:
40- (1) prescribe the design and content of the sign
41- required by Subsection (a)(1); and
42- (2) post in a prominent location on its Internet
43- website:
44- (A) a summary of the rights of public employees
45- under this chapter; and
46- (B) a notice informing public employees of:
47- (i) the ability to obtain a copy of the
48- anti-retaliation policy adopted by their employing governmental
49- entity from an individual described by Section 554.002(a)(1), (2),
50- or (3); and
51- (ii) the requirement that an employing
52- governmental entity provide to each public employee on the first
53- day of employment with the entity a copy of the entity's
54- anti-retaliation policy developed and adopted under Section
55- 554.0095 [this section].
56- SECTION 3. Chapter 554, Government Code, is amended by
57- adding Section 554.0095 to read as follows:
58- Sec. 554.0095. ANTI-RETALIATION POLICY. (a) A state or
59- local governmental entity shall:
60- (1) develop and adopt an anti-retaliation policy
61- consistent with this chapter that:
62- (A) informs its employees of their rights under
63- this chapter and the anti-retaliation policy; and
64- (B) lists the individuals to whom its employees
65- may report a violation of law under Section 554.002(a);
66- (2) provide a copy of the anti-retaliation policy
67- adopted under Subdivision (1) to each employee on the first day of
68- the employee's employment with the entity; and
69- (3) notify its employees of any change made to its
70- anti-retaliation policy by e-mail, memorandum, or in any other
71- manner that ensures each employee will be informed of the change.
72- (b) If an employee of a state or local governmental entity
73- requests a copy of the entity's anti-retaliation policy from an
74- individual described by Section 554.002(a)(1), (2), or (3), the
75- individual shall provide the employee with a copy of the policy.
76- SECTION 4. Not later than December 1, 2019, a state or local
77- governmental entity, as defined by Section 554.001, Government
78- Code, shall develop and adopt an anti-retaliation policy as
79- required by Section 554.0095, Government Code, as added by this
80- Act.
81- SECTION 5. This Act takes effect September 1, 2019.
