55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority of a member of the legislature to request
88 an attorney general opinion.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 402.042(b), Government Code, is amended
1111 to read as follows:
1212 (b) An opinion may be requested by:
1313 (1) the governor;
1414 (2) the head of a department of state government;
1515 (3) a head or board of a penal institution;
1616 (4) a head or board of an eleemosynary institution;
1717 (5) the head of a state board;
1818 (6) a regent or trustee of a state educational
1919 institution;
2020 (7) a member [committee] of a house of the
2121 legislature;
2222 (8) a county auditor authorized by law; or
2323 (9) the chairman of the governing board of a river
2424 authority.
2525 SECTION 2. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2019.
