410 AN ACT
511 relating to the creation of the criminal offense of false caller
612 identification information display.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Chapter 33A, Penal Code, is amended by adding
915 Section 33A.051 to read as follows:
1016 Sec. 33A.051. FALSE CALLER IDENTIFICATION INFORMATION
1117 DISPLAY. (a) A person commits an offense if the person, with the
1218 intent to defraud or cause harm, makes a call or engages in any
1319 other conduct using any type of technology that results in the
1420 display on another person's telecommunications device of data that
1521 misrepresents the actor's identity or telephone number.
1622 (b) An offense under this section is a Class A misdemeanor.
1723 (c) Notwithstanding any other provision of this chapter, a
1824 conviction for an offense under this section may not be used for
1925 enhancement purposes under any other section of this chapter.
2026 (d) It is a defense to prosecution that the actor:
2127 (1) blocked caller identification information;
2228 (2) was a peace officer or federal law enforcement
2329 officer lawfully discharging an official duty;
2430 (3) was an officer, agent, or employee of a federal
2531 intelligence or security agency lawfully discharging an official
2632 duty;
2733 (4) was an officer, agent, or employee of a
2834 telecommunications service provider who was:
2935 (A) acting in the provider's capacity as an
3036 intermediary for the transmission of telephone service, a Voice
3137 over Internet Protocol transmission, or another type of
3238 telecommunications transmission between the caller and the
3339 recipient;
3440 (B) providing or configuring a service or service
3541 feature as requested by a customer;
3642 (C) acting in a manner that is authorized or
3743 required by other law; or
3844 (D) engaging in other conduct that is a necessary
3945 incident to the provision of service; or
4046 (5) was a private investigator licensed under Chapter
4147 1702, Occupations Code, lawfully conducting an investigation.
4248 (e) For the purposes of this section, "telecommunications
4349 service provider" means a:
4450 (1) telecommunications provider, as defined by
4551 Section 51.002, Utilities Code; or
4652 (2) provider of telecommunications service, advanced
4753 communications services, or information service, as those terms are
4854 defined by 47 U.S.C. Section 153.
4955 SECTION 2. This Act takes effect September 1, 2019.
