| 7 | 7 | | relating to exempting certain honorably retired peace officers from |

| 8 | 8 | | continuing education requirements. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 1701.356, Occupations Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | Sec. 1701.356. CERTAIN OFFICERS: REACTIVATION AND |
|---|
| 13 | 13 | | CONTINUING EDUCATION NOT REQUIRED. (a) An officer is not subject |
|---|
| 14 | 14 | | to Section 1701.351 or 1701.352 if the officer is: |
|---|
| 15 | 15 | | (1) an honorably retired commissioned officer of the |
|---|
| 16 | 16 | | Department of Public Safety who is: |
|---|
| 17 | 17 | | (A) a special ranger under Section 411.023, |
|---|
| 18 | 18 | | Government Code; or |
|---|
| 19 | 19 | | (B) a special Texas Ranger under Section 411.024, |
|---|
| 20 | 20 | | Government Code; |
|---|
| 21 | 21 | | (2) an honorably retired commissioned officer of the |
|---|
| 22 | 22 | | Parks and Wildlife Department who is a special game warden under |
|---|
| 23 | 23 | | Section 11.0201, Parks and Wildlife Code; or |
|---|
| 24 | 24 | | (3) an honorably retired commissioned officer of the |
|---|
| 25 | 25 | | Texas Alcoholic Beverage Commission who is a special inspector or |
|---|
| 26 | 26 | | representative under Section 5.142, Alcoholic Beverage Code [may |
|---|
| 27 | 27 | | not be required to undergo training under Section 1701.352(b)]. |
|---|
| 28 | 28 | | (b) A person who is an [An] honorably retired commissioned |
|---|
| 29 | 29 | | officer described by Subsection (a) [of the Department of Public |
|---|
| 30 | 30 | | Safety who is a special ranger under Section 411.023, Government |
|---|
| 31 | 31 | | Code,] or a retired state employee and who holds a permanent license |
|---|
| 32 | 32 | | issued before January 1981 and that was current on January 1, 1995: |
|---|
| 33 | 33 | | (1) has the same rights and privileges as any other |
|---|
| 34 | 34 | | peace officer of this state; |
|---|
| 35 | 35 | | (2) holds, notwithstanding Section 1701.316, an |
|---|
| 36 | 36 | | active license unless the license is revoked, suspended, or |
|---|
| 37 | 37 | | probated by the commission for a violation of this chapter; and |
|---|
| 38 | 38 | | (3) is not subject to Section 1701.351. |
|---|
| 39 | 39 | | (c) An honorably retired commissioned officer described by |
|---|
| 40 | 40 | | Subsection (a) [of the Department of Public Safety who is a special |
|---|
| 41 | 41 | | ranger under Section 411.023, Government Code, or who is a special |
|---|
| 42 | 42 | | Texas Ranger under Section 411.024, Government Code,] may not be |
|---|
| 43 | 43 | | required to undergo training under Section 1701.253 [1701.253(j)]. |
|---|
| 44 | 44 | | SECTION 2. This Act takes effect August 26, 2019. |
