55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to exempting certain honorably retired peace officers from
88 continuing education requirements.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1701.356, Occupations Code, is amended
1111 to read as follows:
1212 Sec. 1701.356. CERTAIN OFFICERS: REACTIVATION AND
1313 CONTINUING EDUCATION NOT REQUIRED. (a) An officer is not subject
1414 to Section 1701.351 or 1701.352 if the officer is:
1515 (1) an honorably retired commissioned officer of the
1616 Department of Public Safety who is:
1717 (A) a special ranger under Section 411.023,
1818 Government Code; or
1919 (B) a special Texas Ranger under Section 411.024,
2020 Government Code;
2121 (2) an honorably retired commissioned officer of the
2222 Parks and Wildlife Department who is a special game warden under
2323 Section 11.0201, Parks and Wildlife Code; or
2424 (3) an honorably retired commissioned officer of the
2525 Texas Alcoholic Beverage Commission who is a special inspector or
2626 representative under Section 5.142, Alcoholic Beverage Code [may
2727 not be required to undergo training under Section 1701.352(b)].
2828 (b) A person who is an [An] honorably retired commissioned
2929 officer described by Subsection (a) [of the Department of Public
3030 Safety who is a special ranger under Section 411.023, Government
3131 Code,] or a retired state employee and who holds a permanent license
3232 issued before January 1981 and that was current on January 1, 1995:
3333 (1) has the same rights and privileges as any other
3434 peace officer of this state;
3535 (2) holds, notwithstanding Section 1701.316, an
3636 active license unless the license is revoked, suspended, or
3737 probated by the commission for a violation of this chapter; and
3838 (3) is not subject to Section 1701.351.
3939 (c) An honorably retired commissioned officer described by
4040 Subsection (a) [of the Department of Public Safety who is a special
4141 ranger under Section 411.023, Government Code, or who is a special
4242 Texas Ranger under Section 411.024, Government Code,] may not be
4343 required to undergo training under Section 1701.253 [1701.253(j)].
4444 SECTION 2. This Act takes effect August 26, 2019.
