99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 438, Health and Safety Code, is amended
1111 by adding Subchapter E to read as follows:
1212 SUBCHAPTER E. CARDIOPULMONARY RESUSCITATION CERTIFICATION FOR
1313 CERTAIN FOOD SERVICE EMPLOYEES
1414 Sec. 438.051. DEFINITION. In this subchapter, "food
1515 service establishment" has the meaning assigned by Section 437.001.
1616 Sec. 438.052. APPLICABILITY. This subchapter applies only
1717 to a food service establishment with a space designed for food
1818 consumption on the premises of the establishment.
1919 Sec. 438.053. CARDIOPULMONARY RESUSCITATION CERTIFICATION.
2020 (a) A food service establishment may require each establishment
2121 employee whose position requires regular interaction with
2222 customers consuming food on the establishment's premises to hold a
2323 certification in cardiopulmonary resuscitation. The establishment
2424 is not required to reimburse an employee for the cost of obtaining
2525 the certification.
2626 (b) The instructor of a training course for the
2727 certification required under this section must be authorized to
2828 provide the training by the American Heart Association, the
2929 American Red Cross, or a similar nationally recognized association.
3030 Sec. 438.054. PROHIBITED DISCRIMINATION. A food service
3131 establishment may not discriminate in hiring an employee for a
3232 position described by Section 438.053(a) based on whether an
3333 applicant for the position is certified in cardiopulmonary
3434 resuscitation.
3535 SECTION 2. This Act takes effect September 1, 2019.
