| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 438, Health and Safety Code, is amended |
|---|
| 11 | 11 | | by adding Subchapter E to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER E. CARDIOPULMONARY RESUSCITATION CERTIFICATION FOR |
|---|
| 13 | 13 | | CERTAIN FOOD SERVICE EMPLOYEES |
|---|
| 14 | 14 | | Sec. 438.051. DEFINITION. In this subchapter, "food |
|---|
| 15 | 15 | | service establishment" has the meaning assigned by Section 437.001. |
|---|
| 16 | 16 | | Sec. 438.052. APPLICABILITY. This subchapter applies only |
|---|
| 17 | 17 | | to a food service establishment with a space designed for food |
|---|
| 18 | 18 | | consumption on the premises of the establishment. |
|---|
| 19 | 19 | | Sec. 438.053. CARDIOPULMONARY RESUSCITATION CERTIFICATION. |
|---|
| 20 | 20 | | (a) A food service establishment may require each establishment |
|---|
| 21 | 21 | | employee whose position requires regular interaction with |
|---|
| 22 | 22 | | customers consuming food on the establishment's premises to hold a |
|---|
| 23 | 23 | | certification in cardiopulmonary resuscitation. The establishment |
|---|
| 24 | 24 | | is not required to reimburse an employee for the cost of obtaining |
|---|
| 25 | 25 | | the certification. |
|---|
| 26 | 26 | | (b) The instructor of a training course for the |
|---|
| 27 | 27 | | certification required under this section must be authorized to |
|---|
| 28 | 28 | | provide the training by the American Heart Association, the |
|---|
| 29 | 29 | | American Red Cross, or a similar nationally recognized association. |
|---|
| 30 | 30 | | Sec. 438.054. PROHIBITED DISCRIMINATION. A food service |
|---|
| 31 | 31 | | establishment may not discriminate in hiring an employee for a |
|---|
| 32 | 32 | | position described by Section 438.053(a) based on whether an |
|---|
| 33 | 33 | | applicant for the position is certified in cardiopulmonary |
|---|
| 34 | 34 | | resuscitation. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2019. |
