4	10		AN ACT
5	11		relating to the authority of certain water districts to exercise
6	12		the power of eminent domain.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. CERTAIN IRRIGATION DISTRICTS. Subtitle D, Title
9	15		6, Special District Local Laws Code, is amended by adding Chapters
10	16		7505, 7506, and 7509 to read as follows:
11	17		CHAPTER 7505. HIDALGO COUNTY IRRIGATION DISTRICT NO. 6
12	18		SUBCHAPTER A. GENERAL PROVISIONS
13	19		Sec. 7505.001. DEFINITION. In this chapter, "district"
14	20		means the Hidalgo County Irrigation District No. 6.
15	21		SUBCHAPTER B. POWERS AND DUTIES
16	22		Sec. 7505.051. EMINENT DOMAIN. (a) The district may
17	23		exercise the power of eminent domain as provided by this section
18	24		only if the district submits a letter to the comptroller not later
19	25		than December 31, 2019, in accordance with the requirements of
20	26		Section 2206.101(b), Government Code, other than the requirement
21	27		that the letter be submitted by the date specified by that
22	28		subsection.
23	29		(b) Notwithstanding the expiration of the district's
24	30		authority to exercise the power of eminent domain under Section
25	31		2206.101(c), Government Code, the district may exercise the power
26	32		of eminent domain as provided by law applicable to the district on
27	33		or after the 90th day after the date the district submits a letter
28	34		in accordance with Subsection (a).
29	35		CHAPTER 7506. HIDALGO COUNTY IRRIGATION DISTRICT NO. 16
30	36		SUBCHAPTER A. GENERAL PROVISIONS
31	37		Sec. 7506.001. DEFINITION. In this chapter, "district"
32	38		means the Hidalgo County Irrigation District No. 16.
33	39		SUBCHAPTER B. POWERS AND DUTIES
34	40		Sec. 7506.051. EMINENT DOMAIN. (a) The district may
35	41		exercise the power of eminent domain as provided by this section
36	42		only if the district submits a letter to the comptroller not later
37	43		than December 31, 2019, in accordance with the requirements of
38	44		Section 2206.101(b), Government Code, other than the requirement
39	45		that the letter be submitted by the date specified by that
40	46		subsection.

49	55		Sec. 7509.001. DEFINITION. In this chapter, "district"
50	56		means the Hidalgo County Irrigation District No. 5.
51	57		SUBCHAPTER B. POWERS AND DUTIES
52	58		Sec. 7509.051. EMINENT DOMAIN. (a) The district may
53	59		exercise the power of eminent domain as provided by this section
54	60		only if the district submits a letter to the comptroller not later
55	61		than December 31, 2019, in accordance with the requirements of
56	62		Section 2206.101(b), Government Code, other than the requirement
57	63		that the letter be submitted by the date specified by that
58	64		subsection.

67	73		adding Chapter 7963 to read as follows:
68	74		CHAPTER 7963. HIDALGO COUNTY MUNICIPAL UTILITY DISTRICT NO. 1
69	75		SUBCHAPTER A. GENERAL PROVISIONS
70	76		Sec. 7963.001. DEFINITION. In this chapter, "district"
71	77		means the Hidalgo County Municipal Utility District No. 1.
72	78		SUBCHAPTER B. POWERS AND DUTIES
73	79		Sec. 7963.051. EMINENT DOMAIN. (a) The district may
74	80		exercise the power of eminent domain as provided by this section
75	81		only if the district submits a letter to the comptroller not later
76	82		than December 31, 2019, in accordance with the requirements of
77	83		Section 2206.101(b), Government Code, other than the requirement
78	84		that the letter be submitted by the date specified by that
79	85		subsection.
80	86		(b) Notwithstanding the expiration of the district's
81	87		authority to exercise the power of eminent domain under Section
82	88		2206.101(c), Government Code, the district may exercise the power
83	89		of eminent domain as provided by law applicable to the district on
84	90		or after the 90th day after the date the district submits a letter
85	91		in accordance with Subsection (a).
86	92		SECTION 3. EFFECTIVE DATE. As provided by Section 17(c),
87	93		Article I, Texas Constitution, this Act takes effect only on a
88	94		two-thirds vote of all the members elected to each house. If this
89	95		Act receives the vote necessary to take effect, this Act takes
90	96		effect September 1, 2019.
