55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the statute of limitations for aggravated assault
88 committed against a public servant.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 12.01, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 12.01. FELONIES. Except as provided in Article 12.03,
1313 felony indictments may be presented within these limits, and not
1414 afterward:
1515 (1) no limitation:
1616 (A) murder and manslaughter;
1717 (B) sexual assault under Section 22.011(a)(2),
1818 Penal Code, or aggravated sexual assault under Section
1919 22.021(a)(1)(B), Penal Code;
2020 (C) sexual assault, if:
2121 (i) during the investigation of the offense
2222 biological matter is collected and subjected to forensic DNA
2323 testing and the testing results show that the matter does not match
2424 the victim or any other person whose identity is readily
2525 ascertained; or
2626 (ii) probable cause exists to believe that
2727 the defendant has committed the same or a similar sexual offense
2828 against five or more victims;
2929 (D) continuous sexual abuse of young child or
3030 children under Section 21.02, Penal Code;
3131 (E) indecency with a child under Section 21.11,
3232 Penal Code;
3333 (F) an offense involving leaving the scene of an
3434 accident under Section 550.021, Transportation Code, if the
3535 accident resulted in the death of a person;
3636 (G) trafficking of persons under Section
3737 20A.02(a)(7) or (8), Penal Code;
3838 (H) continuous trafficking of persons under
3939 Section 20A.03, Penal Code; or
4040 (I) compelling prostitution under Section
4141 43.05(a)(2), Penal Code;
4242 (2) ten years from the date of the commission of the
4343 offense:
4444 (A) theft of any estate, real, personal or mixed,
4545 by an executor, administrator, guardian or trustee, with intent to
4646 defraud any creditor, heir, legatee, ward, distributee,
4747 beneficiary or settlor of a trust interested in such estate;
4848 (B) theft by a public servant of government
4949 property over which he exercises control in his official capacity;
5050 (C) forgery or the uttering, using or passing of
5151 forged instruments;
5252 (D) injury to an elderly or disabled individual
5353 punishable as a felony of the first degree under Section 22.04,
5454 Penal Code;
5555 (E) sexual assault, except as provided by
5656 Subdivision (1);
5757 (F) arson;
5858 (G) trafficking of persons under Section
5959 20A.02(a)(1), (2), (3), or (4), Penal Code; [or]
6060 (H) compelling prostitution under Section
6161 43.05(a)(1), Penal Code; or
6262 (I) aggravated assault under Section 22.02,
6363 Penal Code, if the offense is committed against a public servant and
6464 punishable under Subsection (b)(2)(B) of that section;
6565 (3) seven years from the date of the commission of the
6666 offense:
6767 (A) misapplication of fiduciary property or
6868 property of a financial institution;
6969 (B) securing execution of document by deception;
7070 (C) a felony violation under Chapter 162, Tax
7171 Code;
7272 (D) false statement to obtain property or credit
7373 under Section 32.32, Penal Code;
7474 (E) money laundering;
7575 (F) credit card or debit card abuse under Section
7676 32.31, Penal Code;
7777 (G) fraudulent use or possession of identifying
7878 information under Section 32.51, Penal Code;
7979 (H) exploitation of a child, elderly individual,
8080 or disabled individual under Section 32.53, Penal Code;
8181 (I) Medicaid fraud under Section 35A.02, Penal
8282 Code; or
8383 (J) bigamy under Section 25.01, Penal Code,
8484 except as provided by Subdivision (6);
8585 (4) five years from the date of the commission of the
8686 offense:
8787 (A) theft or robbery;
8888 (B) except as provided by Subdivision (5),
8989 kidnapping or burglary;
9090 (C) injury to an elderly or disabled individual
9191 that is not punishable as a felony of the first degree under Section
9292 22.04, Penal Code;
9393 (D) abandoning or endangering a child; or
9494 (E) insurance fraud;
9595 (5) if the investigation of the offense shows that the
9696 victim is younger than 17 years of age at the time the offense is
9797 committed, 20 years from the 18th birthday of the victim of one of
9898 the following offenses:
9999 (A) sexual performance by a child under Section
100100 43.25, Penal Code;
101101 (B) aggravated kidnapping under Section
102102 20.04(a)(4), Penal Code, if the defendant committed the offense
103103 with the intent to violate or abuse the victim sexually; or
104104 (C) burglary under Section 30.02, Penal Code, if
105105 the offense is punishable under Subsection (d) of that section and
106106 the defendant committed the offense with the intent to commit an
107107 offense described by Subdivision (1)(B) or (D) of this article or
108108 Paragraph (B) of this subdivision;
109109 (6) ten years from the 18th birthday of the victim of
110110 the offense:
111111 (A) trafficking of persons under Section
112112 20A.02(a)(5) or (6), Penal Code;
113113 (B) injury to a child under Section 22.04, Penal
114114 Code; or
115115 (C) bigamy under Section 25.01, Penal Code, if
116116 the investigation of the offense shows that the person, other than
117117 the legal spouse of the defendant, whom the defendant marries or
118118 purports to marry or with whom the defendant lives under the
119119 appearance of being married is younger than 18 years of age at the
120120 time the offense is committed; or
121121 (7) three years from the date of the commission of the
122122 offense: all other felonies.
123123 SECTION 2. The change in law made by this Act does not apply
124124 to an offense if the prosecution of that offense becomes barred by
125125 limitation before the effective date of this Act. The prosecution
126126 of that offense remains barred as if this Act had not taken effect.
127127 SECTION 3. This Act takes effect September 1, 2019.
