9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 12, Property Code, is amended by adding | |
11 | 11 | Section 12.0013 to read as follows: | |
12 | 12 | Sec. 12.0013. MANDATORY SALES PRICE DISCLOSURE. (a) A | |
13 | 13 | person may not file for record or have recorded in the county | |
14 | 14 | clerk's office an instrument conveying real property under a | |
15 | 15 | contract for sale unless the instrument discloses the sales price | |
16 | 16 | of the property. | |
17 | 17 | (b) The purchaser of any property for which an instrument is | |
18 | 18 | recorded in violation of Subsection (a) is liable to the state for a | |
19 | 19 | civil penalty for each violation in an amount equal to five percent | |
20 | 20 | of the sales price of the property. | |
21 | 21 | (c) The attorney general or the county or district attorney | |
22 | 22 | for the county in which the property is located may bring suit to | |
23 | 23 | recover a penalty under this section. | |
24 | 24 | (d) This section does not apply to an instrument conveying | |
25 | 25 | only a mineral interest in real property. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2019. |
