7 | 7 | | relating to requiring law enforcement agencies to establish a |

8 | 8 | | campus active shooter response plan. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Chapter 2, Code of Criminal Procedure, is |
---|
11 | 11 | | amended by adding Article 2.33 to read as follows: |
---|
12 | 12 | | Art. 2.33. CAMPUS ACTIVE SHOOTER RESPONSE PLAN. (a) Each |
---|
13 | 13 | | law enforcement agency in this state shall: |
---|
14 | 14 | | (1) establish a plan for coordinating with other local |
---|
15 | 15 | | law enforcement agencies and first responders when responding to an |
---|
16 | 16 | | active shooter emergency on the campus of a school or educational |
---|
17 | 17 | | institution; |
---|
18 | 18 | | (2) annually: |
---|
19 | 19 | | (A) conduct an active shooter drill with local |
---|
20 | 20 | | law enforcement agencies and first responders in accordance with |
---|
21 | 21 | | the plan; and |
---|
22 | 22 | | (B) review and, if necessary, revise the plan; |
---|
23 | 23 | | and |
---|
24 | 24 | | (3) not later than July 1 of each year, submit the plan |
---|
25 | 25 | | to the Department of Public Safety. |
---|
26 | 26 | | (b) The response plan established under Subsection (a)(1) |
---|
27 | 27 | | must include protocols for the first officer arriving at the scene |
---|
28 | 28 | | to immediately: |
---|
29 | 29 | | (1) enter the premises where the emergency is |
---|
30 | 30 | | occurring; |
---|
31 | 31 | | (2) identify and evaluate the threat; and |
---|
32 | 32 | | (3) take action to eliminate the threat, if feasible, |
---|
33 | 33 | | or contain the threat to prevent further injuries and protect the |
---|
34 | 34 | | public while additional law enforcement officers are summoned. |
---|
35 | 35 | | (c) The Department of Public Safety shall adopt rules and |
---|
36 | 36 | | procedures to annually certify a law enforcement agency's |
---|
37 | 37 | | compliance with this article. |
---|
38 | 38 | | SECTION 2. (a) As soon as practicable after the effective |
---|
39 | 39 | | date of this Act: |
---|
40 | 40 | | (1) each law enforcement agency shall establish the |
---|
41 | 41 | | campus active shooter response plan required by Article 2.33(a)(1), |
---|
42 | 42 | | Code of Criminal Procedure, as added by this Act; and |
---|
43 | 43 | | (2) the Department of Public Safety shall adopt the |
---|
44 | 44 | | rules and procedures required by Article 2.33(c), Code of Criminal |
---|
45 | 45 | | Procedure, as added by this Act. |
---|
46 | 46 | | (b) Not later than July 1, 2020, each law enforcement agency |
---|
47 | 47 | | shall submit the agency's initial plan to the Department of Public |
---|
48 | 48 | | Safety, as required by Article 2.33(a)(3), Code of Criminal |
---|
49 | 49 | | Procedure, as added by this Act. |
---|
50 | 50 | | SECTION 3. This Act takes effect immediately if it receives |
---|
51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
---|
52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
---|
54 | 54 | | Act takes effect September 1, 2019. |
