55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring law enforcement agencies to establish a
88 campus active shooter response plan.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 2, Code of Criminal Procedure, is
1111 amended by adding Article 2.33 to read as follows:
1212 Art. 2.33. CAMPUS ACTIVE SHOOTER RESPONSE PLAN. (a) Each
1313 law enforcement agency in this state shall:
1414 (1) establish a plan for coordinating with other local
1515 law enforcement agencies and first responders when responding to an
1616 active shooter emergency on the campus of a school or educational
1717 institution;
1818 (2) annually:
1919 (A) conduct an active shooter drill with local
2020 law enforcement agencies and first responders in accordance with
2121 the plan; and
2222 (B) review and, if necessary, revise the plan;
2323 and
2424 (3) not later than July 1 of each year, submit the plan
2525 to the Department of Public Safety.
2626 (b) The response plan established under Subsection (a)(1)
2727 must include protocols for the first officer arriving at the scene
2828 to immediately:
2929 (1) enter the premises where the emergency is
3030 occurring;
3131 (2) identify and evaluate the threat; and
3232 (3) take action to eliminate the threat, if feasible,
3333 or contain the threat to prevent further injuries and protect the
3434 public while additional law enforcement officers are summoned.
3535 (c) The Department of Public Safety shall adopt rules and
3636 procedures to annually certify a law enforcement agency's
3737 compliance with this article.
3838 SECTION 2. (a) As soon as practicable after the effective
3939 date of this Act:
4040 (1) each law enforcement agency shall establish the
4141 campus active shooter response plan required by Article 2.33(a)(1),
4242 Code of Criminal Procedure, as added by this Act; and
4343 (2) the Department of Public Safety shall adopt the
4444 rules and procedures required by Article 2.33(c), Code of Criminal
4545 Procedure, as added by this Act.
4646 (b) Not later than July 1, 2020, each law enforcement agency
4747 shall submit the agency's initial plan to the Department of Public
4848 Safety, as required by Article 2.33(a)(3), Code of Criminal
4949 Procedure, as added by this Act.
5050 SECTION 3. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2019.
