66 AN ACT
77 relating to authority of certain officers of certain counties to
88 disburse or direct payment of county funds for salaries or
99 expenses.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 113.047, Local Government Code, is
1212 amended to read as follows:
1313 Sec. 113.047. DISBURSEMENTS FOR SALARIES OR EXPENSES [IN
1414 COUNTY WITH POPULATION OF 190,000 OR MORE]. After the deposit of
1515 funds in a county depository, an officer [in a county with a
1616 population of 190,000 or more] may draw checks on the county
1717 treasurer to disburse the funds as payment for a salary or expenses
1818 authorized by law or in payment to the county or to the person to
1919 whom the funds belong.
2020 SECTION 2. Subchapter B, Chapter 154, Local Government
2121 Code, is amended by adding Section 154.0235 to read as follows:
2222 Sec. 154.0235. PROCEDURES REGARDING PAYMENT OF EMPLOYEE
2323 SALARIES. (a) A district, county, or precinct officer may issue a
2424 warrant against the salary fund to pay the salary of an employee
2525 whose salary may be paid from the fund.
2626 (b) A payment may not be made from the salary fund to an
2727 employee for a service performed before the person has taken the
2828 constitutional oath of office, if applicable, and the person's
2929 authorized appointment and oath, if any, have been filed for record
3030 with the county clerk and the county auditor, if the county has a
3131 county auditor.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2019.
