| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 113.047, Local Government Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | Sec. 113.047. DISBURSEMENTS FOR SALARIES OR EXPENSES [IN |
|---|
| 14 | 14 | | COUNTY WITH POPULATION OF 190,000 OR MORE]. After the deposit of |
|---|
| 15 | 15 | | funds in a county depository, an officer [in a county with a |
|---|
| 16 | 16 | | population of 190,000 or more] may draw checks on the county |
|---|
| 17 | 17 | | treasurer to disburse the funds as payment for a salary or expenses |
|---|
| 18 | 18 | | authorized by law or in payment to the county or to the person to |
|---|
| 19 | 19 | | whom the funds belong. |

| 20 | 20 | | SECTION 2. Subchapter B, Chapter 154, Local Government |
|---|
| 21 | 21 | | Code, is amended by adding Section 154.0235 to read as follows: |
|---|
| 22 | 22 | | Sec. 154.0235. PROCEDURES REGARDING PAYMENT OF EMPLOYEE |
|---|
| 23 | 23 | | SALARIES. (a) A district, county, or precinct officer may issue a |
|---|
| 24 | 24 | | warrant against the salary fund to pay the salary of an employee |
|---|
| 25 | 25 | | whose salary may be paid from the fund. |
|---|
| 26 | 26 | | (b) A payment may not be made from the salary fund to an |
|---|
| 27 | 27 | | employee for a service performed before the person has taken the |
|---|
| 28 | 28 | | constitutional oath of office, if applicable, and the person's |
|---|
| 29 | 29 | | authorized appointment and oath, if any, have been filed for record |
|---|
| 30 | 30 | | with the county clerk and the county auditor, if the county has a |
|---|
| 31 | 31 | | county auditor. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2019. |
