| 5 | 13 | | relating to the use of a county early voting polling place by a |

| 6 | 14 | | political subdivision. |
|---|
| 7 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 16 | | SECTION 1. Section 85.010, Election Code, is amended by |
|---|
| 9 | 17 | | adding Subsection (a-1) and amending Subsection (b) to read as |
|---|
| 10 | 18 | | follows: |
|---|
| 11 | 19 | | (a-1) In this section, "eligible county polling place" |
|---|
| 12 | 20 | | means an early voting polling place, other than a polling place |
|---|
| 13 | 21 | | established under Section 85.062(e), established by a county. |
|---|
| 14 | 22 | | (b) A political subdivision that holds an election |
|---|
| 15 | 23 | | described by Subsection (a): |
|---|
| 16 | 24 | | (1) shall designate as an early voting polling place |
|---|
| 17 | 25 | | for the election an eligible county [any early voting] polling |
|---|
| 18 | 26 | | place[, other than a polling place established under Section |
|---|
| 19 | 27 | | 85.062(e), established by the county and] located in the political |
|---|
| 20 | 28 | | subdivision; and |
|---|
| 21 | 29 | | (2) may not designate as an early voting polling place |
|---|
| 22 | 30 | | a location other than an eligible county polling place unless each |
|---|
| 23 | 31 | | eligible county polling place located in the political subdivision |
|---|
| 24 | 32 | | is designated as an early voting polling place by the political |
|---|
| 25 | 33 | | subdivision. |

| 26 | 34 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 37 | | Act does not receive the vote necessary for immediate effect, this |

| 30 | 38 | | Act takes effect September 1, 2019. |
