66 relating to proportionality between state accountability
77 performance indicators that apply to school districts and the
88 State's share of the foundation school program for school

1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 39.054, Education Code, is amended by
1212 adding Subsection (f) to read as follows:
1313 (f) For purposes of evaluating school districts and campus
1414 performance under this section, the commissioner may not use
1515 state-required performance indicators in Section 39.053 in a
1616 proportion that exceeds the percentage of the State share of the
1717 Foundation School Program estimated in Section 42.001(c) in each
1818 fiscal year, and a school district may substitute locally selected
1919 or developed performance indicators.
2020 SECTION 2. Section 42.001, Education Code, is amended by
2121 adding Subsection (c) to read as follows:
2222 (c) The General Appropriations Act shall include a
2323 Legislative Budget Board projection for each fiscal year of the
2424 percentage of State revenue sources that is estimated to constitute
2525 the State's share of the Foundation School Program for school
2626 districts statewide and of the percentage of local tax revenues
2727 that is estimated to constitute the local share of the Foundation
2828 School Program for school districts statewide, excluding federal
2929 funds. In this section, the term "local tax revenues" includes
3030 revenue that a school district is required to transfer to the State
3131 to reduce the school district's wealth per student to the equalized
3232 wealth level, and the term "state revenue sources" does not include
3333 such revenue.
3434 SECTION 3. This Act takes effect September 1, 2019.
