| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 39.054, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (f) to read as follows: |
|---|
| 13 | 13 | | (f) For purposes of evaluating school districts and campus |
|---|
| 14 | 14 | | performance under this section, the commissioner may not use |
|---|
| 15 | 15 | | state-required performance indicators in Section 39.053 in a |
|---|
| 16 | 16 | | proportion that exceeds the percentage of the State share of the |
|---|
| 17 | 17 | | Foundation School Program estimated in Section 42.001(c) in each |
|---|
| 18 | 18 | | fiscal year, and a school district may substitute locally selected |
|---|
| 19 | 19 | | or developed performance indicators. |
|---|
| 20 | 20 | | SECTION 2. Section 42.001, Education Code, is amended by |
|---|
| 21 | 21 | | adding Subsection (c) to read as follows: |
|---|
| 22 | 22 | | (c) The General Appropriations Act shall include a |
|---|
| 23 | 23 | | Legislative Budget Board projection for each fiscal year of the |
|---|
| 24 | 24 | | percentage of State revenue sources that is estimated to constitute |
|---|
| 25 | 25 | | the State's share of the Foundation School Program for school |
|---|
| 26 | 26 | | districts statewide and of the percentage of local tax revenues |
|---|
| 27 | 27 | | that is estimated to constitute the local share of the Foundation |
|---|
| 28 | 28 | | School Program for school districts statewide, excluding federal |
|---|
| 29 | 29 | | funds. In this section, the term "local tax revenues" includes |
|---|
| 30 | 30 | | revenue that a school district is required to transfer to the State |
|---|
| 31 | 31 | | to reduce the school district's wealth per student to the equalized |
|---|
| 32 | 32 | | wealth level, and the term "state revenue sources" does not include |
|---|
| 33 | 33 | | such revenue. |

| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2019. |
