11+ A BILL TO BE ENTITLED
412 AN ACT
513 relating to telemedicine medical, telehealth, and home
614 telemonitoring services under Medicaid.
715 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
816 SECTION 1. Section 531.0216(f), Government Code, is amended
917 to read as follows:
1018 (f) Not later than December 1 of each even-numbered year,
1119 the commission shall report to the speaker of the house of
1220 representatives and the lieutenant governor on the effects of
1321 telemedicine medical services, telehealth services, and home
1422 telemonitoring services on Medicaid in the state, including the
1523 number of physicians, health professionals, and licensed health
1624 care facilities using telemedicine medical services, telehealth
1725 services, or home telemonitoring services, the geographic and
1826 demographic disposition of the physicians and health
1927 professionals, the number of patients receiving telemedicine
2028 medical services, telehealth services, and home telemonitoring
2129 services, the types of services being provided, [and] the cost of
2230 utilization, and the cost savings of telemedicine medical services,
2331 telehealth services, and home telemonitoring services to Medicaid.
2432 SECTION 2. Section 531.02164, Government Code, is amended
2533 by adding Subsection (c-1) to read as follows:
2634 (c-1) Notwithstanding Subsection (c)(1), the program
2735 required under this section must also provide that home
2836 telemonitoring services are available to pediatric persons who:
2937 (1) are diagnosed with end-stage solid organ disease;
3038 (2) have received an organ transplant; or
3139 (3) require mechanical ventilation.
3240 SECTION 3. Section 531.02176, Government Code, is repealed.
3341 SECTION 4. The executive commissioner of the Health and
3442 Human Services Commission shall adopt the rules necessary to
3543 implement Section 531.02164(c-1), Government Code, as added by this
3644 Act, not later than December 1, 2019.
3745 SECTION 5. If before implementing any provision of this Act
3846 a state agency determines that a waiver or authorization from a
3947 federal agency is necessary for implementation of that provision,
4048 the agency affected by the provision shall request the waiver or
4149 authorization and may delay implementing that provision until the
4250 waiver or authorization is granted.
4351 SECTION 6. The Health and Human Services Commission is
4452 required to implement a provision of this Act only if the
4553 legislature appropriates money specifically for that purpose. If
4654 the legislature does not appropriate money specifically for that
4755 purpose, the commission may, but is not required to, implement a
4856 provision of this Act using other appropriations available for that
4957 purpose.
5058 SECTION 7. This Act takes effect September 1, 2019.
