6 | 14 | | telemonitoring services under Medicaid. |

7 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 16 | | SECTION 1. Section 531.0216(f), Government Code, is amended |
---|
9 | 17 | | to read as follows: |
---|
10 | 18 | | (f) Not later than December 1 of each even-numbered year, |
---|
11 | 19 | | the commission shall report to the speaker of the house of |
---|
12 | 20 | | representatives and the lieutenant governor on the effects of |
---|
13 | 21 | | telemedicine medical services, telehealth services, and home |
---|
14 | 22 | | telemonitoring services on Medicaid in the state, including the |
---|
15 | 23 | | number of physicians, health professionals, and licensed health |
---|
16 | 24 | | care facilities using telemedicine medical services, telehealth |
---|
17 | 25 | | services, or home telemonitoring services, the geographic and |
---|
18 | 26 | | demographic disposition of the physicians and health |
---|
19 | 27 | | professionals, the number of patients receiving telemedicine |
---|
20 | 28 | | medical services, telehealth services, and home telemonitoring |
---|
21 | 29 | | services, the types of services being provided, [and] the cost of |
---|
22 | 30 | | utilization, and the cost savings of telemedicine medical services, |
---|
23 | 31 | | telehealth services, and home telemonitoring services to Medicaid. |
---|
24 | 32 | | SECTION 2. Section 531.02164, Government Code, is amended |
---|
25 | 33 | | by adding Subsection (c-1) to read as follows: |
---|
26 | 34 | | (c-1) Notwithstanding Subsection (c)(1), the program |
---|
27 | 35 | | required under this section must also provide that home |
---|
28 | 36 | | telemonitoring services are available to pediatric persons who: |
---|
29 | 37 | | (1) are diagnosed with end-stage solid organ disease; |
---|
30 | 38 | | (2) have received an organ transplant; or |
---|
31 | 39 | | (3) require mechanical ventilation. |
---|
32 | 40 | | SECTION 3. Section 531.02176, Government Code, is repealed. |
---|
33 | 41 | | SECTION 4. The executive commissioner of the Health and |
---|
34 | 42 | | Human Services Commission shall adopt the rules necessary to |
---|
35 | 43 | | implement Section 531.02164(c-1), Government Code, as added by this |
---|
36 | 44 | | Act, not later than December 1, 2019. |
---|
37 | 45 | | SECTION 5. If before implementing any provision of this Act |
---|
38 | 46 | | a state agency determines that a waiver or authorization from a |
---|
39 | 47 | | federal agency is necessary for implementation of that provision, |
---|
40 | 48 | | the agency affected by the provision shall request the waiver or |
---|
41 | 49 | | authorization and may delay implementing that provision until the |
---|
42 | 50 | | waiver or authorization is granted. |
---|
43 | 51 | | SECTION 6. The Health and Human Services Commission is |
---|
44 | 52 | | required to implement a provision of this Act only if the |
---|
45 | 53 | | legislature appropriates money specifically for that purpose. If |
---|
46 | 54 | | the legislature does not appropriate money specifically for that |
---|
47 | 55 | | purpose, the commission may, but is not required to, implement a |
---|
48 | 56 | | provision of this Act using other appropriations available for that |
---|
49 | 57 | | purpose. |
---|
50 | 58 | | SECTION 7. This Act takes effect September 1, 2019. |
