| 7 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 15 | | SECTION 1. Section 21.101, Labor Code, is amended to read as |
|---|
| 9 | 16 | | follows: |
|---|
| 10 | 17 | | Sec. 21.101. AGE DISCRIMINATION LIMITED TO INDIVIDUALS OF |
|---|
| 11 | 18 | | CERTAIN AGE. The [Except as provided by Section 21.054, the] |

| 12 | 19 | | provisions of this chapter referring to discrimination because of |
|---|
| 13 | 20 | | age or on the basis of age apply only to discrimination against an |
|---|
| 14 | 21 | | individual 40 years of age or older. |

| 15 | 22 | | SECTION 2. Section 21.054(b), Labor Code, is repealed. |

| 16 | 23 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 17 | 24 | | to conduct that occurs on or after the effective date of this Act. |

| 18 | 25 | | Conduct that occurs before the effective date of this Act is |
|---|
| 19 | 26 | | governed by the law in effect on the date the conduct occurred, and |

| 20 | 27 | | the former law is continued in effect for that purpose. |

| 21 | 28 | | SECTION 4. This Act takes effect September 1, 2019. |
