8 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 17 | | SECTION 1. Subchapter H, Chapter 411, Government Code, is |
---|
10 | 18 | | amended by adding Section 411.1954 to read as follows: |
---|
11 | 19 | | Sec. 411.1954. WAIVER OF CERTAIN FEES FOR CERTAIN |
---|
12 | 20 | | APPLICANTS WHO HOLD CARDIOPULMONARY RESUSCITATION CERTIFICATION. |
---|
13 | 21 | | (a) Notwithstanding any other provision of this subchapter, the |
---|
14 | 22 | | department shall waive any fee required for the issuance of an |
---|
15 | 23 | | original or renewed license under this subchapter if at the time of |
---|
16 | 24 | | the application the applicant for the license submits to the |
---|
17 | 25 | | department satisfactory evidence that the applicant: |
---|
18 | 26 | | (1) holds a current certification in cardiopulmonary |
---|
19 | 27 | | resuscitation issued by the American Heart Association, the |
---|
20 | 28 | | American Red Cross, or another nationally recognized association; |
---|
21 | 29 | | and |
---|
22 | 30 | | (2) is not required to hold the certification |
---|
23 | 31 | | described by Subdivision (1) as a condition of obtaining or |
---|
24 | 32 | | maintaining employment or an occupational license. |
---|
25 | 33 | | (b) For purposes of Subsection (a)(2), "occupational |
---|
26 | 34 | | license" means a license, certificate, registration, permit, or |
---|
27 | 35 | | other form of authorization that a person must obtain to practice or |
---|
28 | 36 | | engage in a particular business, occupation, or profession. |
---|
29 | 37 | | SECTION 2. Subchapter I, Chapter 521, Transportation Code, |
---|
30 | 38 | | is amended by adding Section 521.1812 to read as follows: |
---|
31 | 39 | | Sec. 521.1812. WAIVER OF CERTAIN FEES FOR CERTAIN |
---|
32 | 40 | | APPLICANTS WHO HOLD CARDIOPULMONARY RESUSCITATION CERTIFICATION. |
---|
33 | 41 | | (a) A person is exempt from the payment of any fee for the issuance |
---|
34 | 42 | | of an original or renewal driver's license, as provided under this |
---|
35 | 43 | | chapter, if at the time of the application for an original or |
---|
36 | 44 | | renewal driver's license the person submits to the department |
---|
37 | 45 | | satisfactory evidence that the person: |
---|
38 | 46 | | (1) holds a current certification in cardiopulmonary |
---|
39 | 47 | | resuscitation issued by the American Heart Association, the |
---|
40 | 48 | | American Red Cross, or another nationally recognized association; |
---|
41 | 49 | | and |
---|
42 | 50 | | (2) is not required to hold the certification |
---|
43 | 51 | | described by Subdivision (1) as a condition of obtaining or |
---|
44 | 52 | | maintaining employment or an occupational license. |
---|
45 | 53 | | (b) For purposes of Subsection (a)(2), "occupational |
---|
46 | 54 | | license" means a license, certificate, registration, permit, or |
---|
47 | 55 | | other form of authorization that a person must obtain to practice or |
---|
48 | 56 | | engage in a particular business, occupation, or profession. |
---|
49 | 57 | | (c) The department shall establish a record of the amount of |
---|
50 | 58 | | the fees waived under this section that would otherwise be |
---|
51 | 59 | | deposited to the credit of the Texas mobility fund. |
---|
52 | 60 | | (d) On or before the fifth workday of each month, the |
---|
53 | 61 | | department, using available funds, shall remit to the comptroller |
---|
54 | 62 | | for deposit to the credit of the Texas mobility fund general revenue |
---|
55 | 63 | | in an amount equal to the amount of the fees described by Subsection |
---|
56 | 64 | | (c) in the preceding month. |
---|
57 | 65 | | SECTION 3. (a) Section 411.1954, Government Code, as added |
---|
58 | 66 | | by this Act, applies only to an application for an original or |
---|
59 | 67 | | renewed license to carry a handgun submitted on or after the |
---|
60 | 68 | | effective date of this Act. An application submitted before the |
---|
61 | 69 | | effective date of this Act is governed by the law in effect when the |
---|
62 | 70 | | application was submitted, and the former law is continued in |
---|
63 | 71 | | effect for that purpose. |
---|
64 | 72 | | (b) Section 521.1812, Transportation Code, as added by this |
---|
65 | 73 | | Act, applies only to an application for an original or renewal |
---|
66 | 74 | | driver's license submitted on or after the effective date of this |
---|
67 | 75 | | Act. An application submitted before the effective date of this Act |
---|
68 | 76 | | is governed by the law in effect when the application was submitted, |
---|
69 | 77 | | and the former law is continued in effect for that purpose. |
---|
70 | 78 | | SECTION 4. The Department of Public Safety of the State of |
---|
71 | 79 | | Texas is required to implement a provision of this Act only if the |
---|
72 | 80 | | legislature appropriates money specifically for that purpose. If |
---|
73 | 81 | | the legislature does not appropriate money specifically for that |
---|
74 | 82 | | purpose, the Department of Public Safety of the State of Texas may, |
---|
75 | 83 | | but is not required to, implement a provision of this Act using |
---|
76 | 84 | | other appropriations available for that purpose. |
---|
77 | 85 | | SECTION 5. This Act takes effect September 1, 2019. |
