412 AN ACT
513 relating to a study by the Texas Department of Transportation of the
614 Ports-to-Plains Corridor, including an evaluation of the
715 feasibility of certain improvements to Interstate Highway 27.
816 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
917 SECTION 1. (a) In this Act:
1018 (1) "Advisory committee" means the Ports-to-Plains
1119 Advisory Committee established under this section.
1220 (2) "Department" means the Texas Department of
1321 Transportation.
1422 (3) "Improvement" has the meaning assigned by Section
1523 221.001, Transportation Code.
1624 (4) "Port of entry" has the meaning assigned by
1725 Section 621.001, Transportation Code.
1826 (5) "Ports-to-Plains Corridor" means the highways
1927 designated as the Ports-to-Plains Corridor under Section 225.069,
2028 Transportation Code.
2129 (b) The department shall conduct a comprehensive study of
2230 the Ports-to-Plains Corridor. The study must evaluate the
2331 feasibility of, and the costs and logistical matters associated
2432 with, improvements that create a continuous flow, four-lane divided
2533 highway that meets interstate highway standards to the extent
2634 possible, including improvements that:
2735 (1) extend Interstate Highway 27:
2836 (A) from its southern terminus to Interstate
2937 Highway 20;
3038 (B) from Interstate Highway 20 to Interstate
3139 Highway 10; and
3240 (C) from Interstate Highway 10 to the port of
3341 entry located in Laredo;
3442 (2) extend Interstate Highway 27:
3543 (A) from its northern terminus to Dumas;
3644 (B) from Dumas to Stratford; and
3745 (C) from Stratford to the Oklahoma state border;
3846 and
3947 (3) extend Interstate Highway 27:
4048 (A) from its northern terminus to Dumas;
4149 (B) from Dumas to Dalhart; and
4250 (C) from Dalhart to the New Mexico state border.
4351 (c) In conducting the study under Subsection (b) of this
4452 section, the department shall:
4553 (1) use the reports submitted to the department by the
4654 advisory committee under Subsection (j) of this section; and
4755 (2) hold quarterly public meetings on a rotational
4856 basis in Amarillo, Laredo, Lubbock, and San Angelo to gather public
4957 feedback on improvements or expansions to the Ports-to-Plains
5058 Corridor.
5159 (d) The department shall establish a Ports-to-Plains
5260 Advisory Committee to assist the department in conducting the study
5361 under Subsection (b) of this section.
5462 (e) The advisory committee is composed of:
5563 (1) the county judge, or an elected county official or
5664 the administrator of the county's road department, as designated by
5765 the county judge, of each county along the Ports-to-Plains
5866 Corridor, including the counties along the possible extensions of
5967 Interstate Highway 27 described by Subsection (b) of this section;
6068 and
6169 (2) the mayor, or the city manager or assistant city
6270 manager, as designated by the mayor, of Amarillo, Big Spring,
6371 Carrizo Springs, Dalhart, Del Rio, Dumas, Eagle Pass, Eldorado,
6472 Lamesa, Laredo, Lubbock, Midland, Odessa, San Angelo, Sonora,
6573 Sterling City, Stratford, and Tahoka.
6674 (f) The advisory committee shall meet at least twice each
6775 year on a rotational basis in Lubbock and San Angelo.
6876 (g) The department, in conjunction with the advisory
6977 committee, shall establish segment committees for each geographic
7078 segment along the Ports-to-Plains Corridor as determined by the
7179 department. The segment committees are composed of:
7280 (1) volunteers who may represent:
7381 (A) municipalities, counties, metropolitan
7482 planning organizations, ports, chambers of commerce, and economic
7583 development organizations along that segment of the
7684 Ports-to-Plains Corridor;
7785 (B) the oil and gas industry; and
7886 (C) the trucking industry;
7987 (2) department representatives; and
8088 (3) any other interested parties.
8189 (h) A segment committee established under Subsection (g) of
8290 this section for a segment along the Ports-to-Plains Corridor shall
8391 submit a report to the advisory committee providing input for the
8492 study conducted by the department under Subsection (b) of this
8593 section. The report must include:
8694 (1) an examination of the ability of the energy
8795 industry to transport products to market;
8896 (2) an evaluation of the economic development impacts
8997 of the Ports-to-Plains Corridor, including whether the improvement
9098 or expansion of the Ports-to-Plains Corridor would create
9199 employment opportunities in this state;
92100 (3) a determination of whether improvements or
93101 expansion of the Ports-to-Plains Corridor would relieve traffic
94102 congestion in the segment;
95103 (4) an examination of freight movement along the
96104 Ports-to-Plains Corridor;
97105 (5) a determination and prioritization of
98106 improvements and expansion of the Ports-to-Plains Corridor that are
99107 warranted in order to promote safety and mobility, while maximizing
100108 the use of existing highways to the greatest extent possible and
101109 striving to protect private property as much as possible;
102110 (6) a determination of the areas that are preferable
103111 and suitable for interstate designation;
104112 (7) an examination of project costs related to the
105113 improvement or expansion of the Ports-to-Plains Corridor; and
106114 (8) an assessment of federal, state, local, and
107115 private funding sources for a project improving or expanding the
108116 Ports-to-Plains Corridor.
109117 (i) Not later than June 30, 2020, each segment committee
110118 established under Subsection (g) of this section shall submit to
111119 the advisory committee the report described by Subsection (h) of
112120 this section, including priority recommendations for improvement
113121 and expansion of the Ports-to-Plains Corridor.
114122 (j) Not later than October 31, 2020, the advisory committee
115123 shall review and compile the reports submitted by each segment
116124 committee under Subsection (i) of this section and submit to the
117125 department:
118126 (1) the reports submitted by each segment committee;
119127 and
120128 (2) a summary and any recommendations based on those
121129 reports.
122130 (k) The advisory committee and each segment committee shall
123131 conduct extensive public involvement campaigns for feedback on
124132 preliminary recommendations made by the committees before
125133 submitting the reports under Subsections (i) and (j) of this
126134 section.
127135 (l) Not later than January 1, 2021, the department shall
128136 submit a report on the results of the study conducted under
129137 Subsection (b) of this section to the governor, the lieutenant
130138 governor, the speaker of the house of representatives, and the
131139 presiding officer of each standing committee of the legislature
132140 with jurisdiction over transportation matters.
133141 (m) This Act expires August 31, 2021.
134142 SECTION 2. This Act takes effect immediately if it receives
135143 a vote of two-thirds of all the members elected to each house, as
136144 provided by Section 39, Article III, Texas Constitution. If this
137145 Act does not receive the vote necessary for immediate effect, this
138146 Act takes effect September 1, 2019.
