10+ A BILL TO BE ENTITLED
411 AN ACT
512 relating to the definition of first responder.
613 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
714 SECTION 1. Section 421.095(1), Government Code, is amended
815 to read as follows:
916 (1) "First responder" means a public safety employee
1017 or volunteer whose duties include responding rapidly to an
1118 emergency. The term includes:
1219 (A) a peace officer whose duties include
1320 responding rapidly to an emergency;
1421 (B) fire protection personnel under Section
1522 419.021;
1623 (C) a volunteer firefighter who is:
1724 (i) certified by the Texas Commission on
1825 Fire Protection or by the State Firemen's and Fire Marshalls'
1926 Association of Texas; or
2027 (ii) a member of an organized volunteer
2128 fire-fighting unit as described by Section 615.003; [and]
2229 (D) an individual certified as emergency medical
2330 services personnel by the Department of State Health Services;
2431 (E) an emergency response operator or emergency
2532 services dispatcher who provides communication support services
2633 for an agency by responding to requests for assistance in
2734 emergencies; and
2835 (F) other emergency response personnel employed
2936 by an agency.
3037 SECTION 2. This Act takes effect September 1, 2019.
