| 5 | 12 | | relating to the definition of first responder. |
|---|
| 6 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 7 | 14 | | SECTION 1. Section 421.095(1), Government Code, is amended |
|---|
| 8 | 15 | | to read as follows: |
|---|
| 9 | 16 | | (1) "First responder" means a public safety employee |
|---|
| 10 | 17 | | or volunteer whose duties include responding rapidly to an |
|---|
| 11 | 18 | | emergency. The term includes: |
|---|
| 12 | 19 | | (A) a peace officer whose duties include |
|---|
| 13 | 20 | | responding rapidly to an emergency; |
|---|
| 14 | 21 | | (B) fire protection personnel under Section |
|---|
| 15 | 22 | | 419.021; |
|---|
| 16 | 23 | | (C) a volunteer firefighter who is: |
|---|
| 17 | 24 | | (i) certified by the Texas Commission on |
|---|
| 18 | 25 | | Fire Protection or by the State Firemen's and Fire Marshalls' |
|---|
| 19 | 26 | | Association of Texas; or |
|---|
| 20 | 27 | | (ii) a member of an organized volunteer |
|---|
| 21 | 28 | | fire-fighting unit as described by Section 615.003; [and] |
|---|
| 22 | 29 | | (D) an individual certified as emergency medical |
|---|
| 23 | 30 | | services personnel by the Department of State Health Services; |
|---|
| 24 | 31 | | (E) an emergency response operator or emergency |
|---|
| 25 | 32 | | services dispatcher who provides communication support services |
|---|
| 26 | 33 | | for an agency by responding to requests for assistance in |
|---|
| 27 | 34 | | emergencies; and |
|---|
| 28 | 35 | | (F) other emergency response personnel employed |
|---|
| 29 | 36 | | by an agency. |
|---|
| 30 | 37 | | SECTION 2. This Act takes effect September 1, 2019. |
