6 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 14 | | SECTION 1. Section 421.095(1), Government Code, is amended |
---|
8 | 15 | | to read as follows: |
---|
9 | 16 | | (1) "First responder" means a public safety employee |
---|
10 | 17 | | or volunteer whose duties include responding rapidly to an |
---|
11 | 18 | | emergency. The term includes: |
---|
12 | 19 | | (A) a peace officer whose duties include |
---|
13 | 20 | | responding rapidly to an emergency; |
---|
14 | 21 | | (B) fire protection personnel under Section |
---|
15 | 22 | | 419.021; |
---|
16 | 23 | | (C) a volunteer firefighter who is: |
---|
17 | 24 | | (i) certified by the Texas Commission on |
---|
18 | 25 | | Fire Protection or by the State Firemen's and Fire Marshalls' |
---|
19 | 26 | | Association of Texas; or |
---|
20 | 27 | | (ii) a member of an organized volunteer |
---|
21 | 28 | | fire-fighting unit as described by Section 615.003; [and] |
---|
22 | 29 | | (D) an individual certified as emergency medical |
---|
23 | 30 | | services personnel by the Department of State Health Services; |
---|
24 | 31 | | (E) an emergency response operator or emergency |
---|
25 | 32 | | services dispatcher who provides communication support services |
---|
26 | 33 | | for an agency by responding to requests for assistance in |
---|
27 | 34 | | emergencies; and |
---|
28 | 35 | | (F) other emergency response personnel employed |
---|
29 | 36 | | by an agency. |
---|
30 | 37 | | SECTION 2. This Act takes effect September 1, 2019. |
