410 AN ACT
511 relating to peace officers commissioned by the State Board of
612 Veterinary Medical Examiners.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Subchapter D, Chapter 801, Occupations Code, is
915 amended by adding Section 801.165 to read as follows:
1016 Sec. 801.165. PEACE OFFICERS. (a) The board may employ and
1117 commission as a peace officer to enforce this chapter a person who
1218 has been certified as qualified to be a peace officer by the Texas
1319 Commission on Law Enforcement.
1420 (b) If the board commissions peace officers under
1521 Subsection (a), the board shall designate a peace officer as the
1622 chief investigator to supervise and direct the other peace officers
1723 commissioned by the board. The chief investigator must have
1824 appropriate training and experience in law enforcement, as
1925 determined by the board.
2026 SECTION 2. Article 2.12, Code of Criminal Procedure, is
2127 amended to read as follows:
2228 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
2329 officers:
2430 (1) sheriffs, their deputies, and those reserve
2531 deputies who hold a permanent peace officer license issued under
2632 Chapter 1701, Occupations Code;
2733 (2) constables, deputy constables, and those reserve
2834 deputy constables who hold a permanent peace officer license issued
2935 under Chapter 1701, Occupations Code;
3036 (3) marshals or police officers of an incorporated
3137 city, town, or village, and those reserve municipal police officers
3238 who hold a permanent peace officer license issued under Chapter
3339 1701, Occupations Code;
3440 (4) rangers, officers, and members of the reserve
3541 officer corps commissioned by the Public Safety Commission and the
3642 Director of the Department of Public Safety;
3743 (5) investigators of the district attorneys', criminal
3844 district attorneys', and county attorneys' offices;
3945 (6) law enforcement agents of the Texas Alcoholic
4046 Beverage Commission;
4147 (7) each member of an arson investigating unit
4248 commissioned by a city, a county, or the state;
4349 (8) officers commissioned under Section 37.081,
4450 Education Code, or Subchapter E, Chapter 51, Education Code;
4551 (9) officers commissioned by the General Services
4652 Commission;
4753 (10) law enforcement officers commissioned by the
4854 Parks and Wildlife Commission;
4955 (11) airport police officers commissioned by a city
5056 with a population of more than 1.18 million located primarily in a
5157 county with a population of 2 million or more that operates an
5258 airport that serves commercial air carriers;
5359 (12) airport security personnel commissioned as peace
5460 officers by the governing body of any political subdivision of this
5561 state, other than a city described by Subdivision (11), that
5662 operates an airport that serves commercial air carriers;
5763 (13) municipal park and recreational patrolmen and
5864 security officers;
5965 (14) security officers and investigators commissioned
6066 as peace officers by the comptroller;
6167 (15) officers commissioned by a water control and
6268 improvement district under Section 49.216, Water Code;
6369 (16) officers commissioned by a board of trustees
6470 under Chapter 54, Transportation Code;
6571 (17) investigators commissioned by the Texas Medical
6672 Board;
6773 (18) officers commissioned by:
6874 (A) the board of managers of the Dallas County
6975 Hospital District, the Tarrant County Hospital District, the Bexar
7076 County Hospital District, or the El Paso County Hospital District
7177 under Section 281.057, Health and Safety Code;
7278 (B) the board of directors of the Ector County
7379 Hospital District under Section 1024.117, Special District Local
7480 Laws Code; and
7581 (C) the board of directors of the Midland County
7682 Hospital District of Midland County, Texas, under Section 1061.121,
7783 Special District Local Laws Code;
7884 (19) county park rangers commissioned under
7985 Subchapter E, Chapter 351, Local Government Code;
8086 (20) investigators employed by the Texas Racing
8187 Commission;
8288 (21) officers commissioned under Chapter 554,
8389 Occupations Code;
8490 (22) officers commissioned by the governing body of a
8591 metropolitan rapid transit authority under Section 451.108,
8692 Transportation Code, or by a regional transportation authority
8793 under Section 452.110, Transportation Code;
8894 (23) investigators commissioned by the attorney
8995 general under Section 402.009, Government Code;
9096 (24) security officers and investigators commissioned
9197 as peace officers under Chapter 466, Government Code;
9298 (25) officers appointed by an appellate court under
9399 Subchapter F, Chapter 53, Government Code;
94100 (26) officers commissioned by the state fire marshal
95101 under Chapter 417, Government Code;
96102 (27) an investigator commissioned by the commissioner
97103 of insurance under Section 701.104, Insurance Code;
98104 (28) apprehension specialists and inspectors general
99105 commissioned by the Texas Juvenile Justice Department as officers
100106 under Sections 242.102 and 243.052, Human Resources Code;
101107 (29) officers appointed by the inspector general of
102108 the Texas Department of Criminal Justice under Section 493.019,
103109 Government Code;
104110 (30) investigators commissioned by the Texas
105111 Commission on Law Enforcement under Section 1701.160, Occupations
106112 Code;
107113 (31) commission investigators commissioned by the
108114 Texas Private Security Board under Section 1702.061, Occupations
109115 Code;
110116 (32) the fire marshal and any officers, inspectors, or
111117 investigators commissioned by an emergency services district under
112118 Chapter 775, Health and Safety Code;
113119 (33) officers commissioned by the State Board of
114120 Dental Examiners under Section 254.013, Occupations Code, subject
115121 to the limitations imposed by that section;
116122 (34) investigators commissioned by the Texas Juvenile
117123 Justice Department as officers under Section 221.011, Human
118124 Resources Code; [and]
119125 (35) the fire marshal and any related officers,
120126 inspectors, or investigators commissioned by a county under
121127 Subchapter B, Chapter 352, Local Government Code; and
122128 (36) officers commissioned by the State Board of
123129 Veterinary Medical Examiners under Section 801.165, Occupations
124130 Code.
125131 SECTION 3. This Act takes effect immediately if it receives
126132 a vote of two-thirds of all the members elected to each house, as
127133 provided by Section 39, Article III, Texas Constitution. If this
128134 Act does not receive the vote necessary for immediate effect, this
129135 Act takes effect September 1, 2019.
