4	10		AN ACT
5	11		relating to peace officers commissioned by the State Board of
6	12		Veterinary Medical Examiners.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Subchapter D, Chapter 801, Occupations Code, is
9	15		amended by adding Section 801.165 to read as follows:
10	16		Sec. 801.165. PEACE OFFICERS. (a) The board may employ and
11	17		commission as a peace officer to enforce this chapter a person who
12	18		has been certified as qualified to be a peace officer by the Texas
13	19		Commission on Law Enforcement.
14	20		(b) If the board commissions peace officers under
15	21		Subsection (a), the board shall designate a peace officer as the
16	22		chief investigator to supervise and direct the other peace officers
17	23		commissioned by the board. The chief investigator must have
18	24		appropriate training and experience in law enforcement, as
19	25		determined by the board.
20	26		SECTION 2. Article 2.12, Code of Criminal Procedure, is
21	27		amended to read as follows:
22	28		Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
23	29		officers:
24	30		(1) sheriffs, their deputies, and those reserve
25	31		deputies who hold a permanent peace officer license issued under
26	32		Chapter 1701, Occupations Code;
27	33		(2) constables, deputy constables, and those reserve
28	34		deputy constables who hold a permanent peace officer license issued
29	35		under Chapter 1701, Occupations Code;
30	36		(3) marshals or police officers of an incorporated
31	37		city, town, or village, and those reserve municipal police officers
32	38		who hold a permanent peace officer license issued under Chapter
33	39		1701, Occupations Code;
34	40		(4) rangers, officers, and members of the reserve
35	41		officer corps commissioned by the Public Safety Commission and the
36	42		Director of the Department of Public Safety;
37	43		(5) investigators of the district attorneys', criminal
38	44		district attorneys', and county attorneys' offices;
39	45		(6) law enforcement agents of the Texas Alcoholic
40	46		Beverage Commission;
41	47		(7) each member of an arson investigating unit
42	48		commissioned by a city, a county, or the state;
43	49		(8) officers commissioned under Section 37.081,
44	50		Education Code, or Subchapter E, Chapter 51, Education Code;
45	51		(9) officers commissioned by the General Services
46	52		Commission;
47	53		(10) law enforcement officers commissioned by the
48	54		Parks and Wildlife Commission;
49	55		(11) airport police officers commissioned by a city
50	56		with a population of more than 1.18 million located primarily in a
51	57		county with a population of 2 million or more that operates an
52	58		airport that serves commercial air carriers;
53	59		(12) airport security personnel commissioned as peace
54	60		officers by the governing body of any political subdivision of this
55	61		state, other than a city described by Subdivision (11), that
56	62		operates an airport that serves commercial air carriers;
57	63		(13) municipal park and recreational patrolmen and
58	64		security officers;
59	65		(14) security officers and investigators commissioned
60	66		as peace officers by the comptroller;
61	67		(15) officers commissioned by a water control and
62	68		improvement district under Section 49.216, Water Code;
63	69		(16) officers commissioned by a board of trustees
64	70		under Chapter 54, Transportation Code;
65	71		(17) investigators commissioned by the Texas Medical
66	72		Board;
67	73		(18) officers commissioned by:
68	74		(A) the board of managers of the Dallas County
69	75		Hospital District, the Tarrant County Hospital District, the Bexar
70	76		County Hospital District, or the El Paso County Hospital District
71	77		under Section 281.057, Health and Safety Code;
72	78		(B) the board of directors of the Ector County
73	79		Hospital District under Section 1024.117, Special District Local
74	80		Laws Code; and
75	81		(C) the board of directors of the Midland County
76	82		Hospital District of Midland County, Texas, under Section 1061.121,
77	83		Special District Local Laws Code;
78	84		(19) county park rangers commissioned under
79	85		Subchapter E, Chapter 351, Local Government Code;
80	86		(20) investigators employed by the Texas Racing
81	87		Commission;
82	88		(21) officers commissioned under Chapter 554,
83	89		Occupations Code;
84	90		(22) officers commissioned by the governing body of a
85	91		metropolitan rapid transit authority under Section 451.108,
86	92		Transportation Code, or by a regional transportation authority
87	93		under Section 452.110, Transportation Code;
88	94		(23) investigators commissioned by the attorney
89	95		general under Section 402.009, Government Code;
90	96		(24) security officers and investigators commissioned
91	97		as peace officers under Chapter 466, Government Code;
92	98		(25) officers appointed by an appellate court under
93	99		Subchapter F, Chapter 53, Government Code;
94	100		(26) officers commissioned by the state fire marshal
95	101		under Chapter 417, Government Code;
96	102		(27) an investigator commissioned by the commissioner
97	103		of insurance under Section 701.104, Insurance Code;
98	104		(28) apprehension specialists and inspectors general
99	105		commissioned by the Texas Juvenile Justice Department as officers
100	106		under Sections 242.102 and 243.052, Human Resources Code;
101	107		(29) officers appointed by the inspector general of
102	108		the Texas Department of Criminal Justice under Section 493.019,
103	109		Government Code;
104	110		(30) investigators commissioned by the Texas
105	111		Commission on Law Enforcement under Section 1701.160, Occupations
106	112		Code;
107	113		(31) commission investigators commissioned by the
108	114		Texas Private Security Board under Section 1702.061, Occupations
109	115		Code;
110	116		(32) the fire marshal and any officers, inspectors, or
111	117		investigators commissioned by an emergency services district under
112	118		Chapter 775, Health and Safety Code;
113	119		(33) officers commissioned by the State Board of
114	120		Dental Examiners under Section 254.013, Occupations Code, subject
115	121		to the limitations imposed by that section;
116	122		(34) investigators commissioned by the Texas Juvenile
117	123		Justice Department as officers under Section 221.011, Human
118	124		Resources Code; [and]
119	125		(35) the fire marshal and any related officers,
120	126		inspectors, or investigators commissioned by a county under
121	127		Subchapter B, Chapter 352, Local Government Code; and
122	128		(36) officers commissioned by the State Board of
123	129		Veterinary Medical Examiners under Section 801.165, Occupations
124	130		Code.
125	131		SECTION 3. This Act takes effect immediately if it receives
126	132		a vote of two-thirds of all the members elected to each house, as
127	133		provided by Section 39, Article III, Texas Constitution. If this
128	134		Act does not receive the vote necessary for immediate effect, this
129	135		Act takes effect September 1, 2019.
