66 AN ACT
77 relating to the signature required on an application for voter
88 registration or for a ballot to be voted by mail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 13.002(a) and (b), Election Code, are
1111 amended to read as follows:
1212 (a) A person desiring to register to vote must submit an
1313 application to the registrar of the county in which the person
1414 resides. Except as provided by Subsection (e), an application must
1515 be submitted by personal delivery or [,] by mail[, or by telephonic
1616 facsimile machine in accordance with Sections 13.143(d) and (d-2)].
1717 (b) A registration application must be in writing and signed
1818 by the applicant using ink on paper. An electronic signature or
1919 photocopied signature is not permitted.
2020 SECTION 2. Section 13.143(d), Election Code, is amended to
2121 read as follows:
2222 (d) For purposes of determining the effective date of a
2323 registration, an application submitted by[:
2424 [(1)] mail is considered to be submitted to the
2525 registrar on the date it is placed with postage prepaid and properly
2626 addressed in the United States mail[; or
2727 [(2) telephonic facsimile machine is considered to be
2828 submitted to the registrar on the date the transmission is received
2929 by the registrar, subject to Subsection (d-2)].
3030 SECTION 3. Section 84.001(b), Election Code, is amended to
3131 read as follows:
3232 (b) An application must be in writing and signed by the
3333 applicant using ink on paper. An electronic signature or
3434 photocopied signature is not permitted.
3535 SECTION 4. Section 13.143(d-2), Election Code, is repealed.
3636 SECTION 5. The change in law made by this Act applies to an
3737 application for voter registration or for a ballot to be voted by
3838 mail submitted on or after the effective date of this Act. An
3939 application for voter registration or for a ballot to be voted by
4040 mail submitted before the effective date of this Act is governed by
4141 the law in effect when the application was submitted, and the former
4242 law is continued in effect for that purpose.
4343 SECTION 6. This Act takes effect September 1, 2019.
