| 7 | 7 | | relating to the provision of services to certain children under the |

| 8 | 8 | | Medicaid medical transportation program. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 531.024141 to read as follows: |
|---|
| 12 | 12 | | Sec. 531.024141. MEDICAL TRANSPORTATION PROGRAM SERVICES |
|---|
| 13 | 13 | | FOR CERTAIN CHILDREN. (a) Notwithstanding Section 32.024(e), |
|---|
| 14 | 14 | | Human Resources Code, the commission shall provide: |
|---|
| 15 | 15 | | (1) medical transportation program services to an |
|---|
| 16 | 16 | | eligible child described by Subsection (b); and |
|---|
| 17 | 17 | | (2) reimbursement for those services. |
|---|
| 18 | 18 | | (b) A child is eligible to receive medical transportation |
|---|
| 19 | 19 | | program services under this section: |
|---|
| 20 | 20 | | (1) if the child's mother is: |
|---|
| 21 | 21 | | (A) a recipient of Medicaid during a pregnancy; |
|---|
| 22 | 22 | | and |
|---|
| 23 | 23 | | (B) using medical transportation program |
|---|
| 24 | 24 | | services to travel to and from a covered health care service related |
|---|
| 25 | 25 | | to the pregnancy, including postpartum care; and |
|---|
| 26 | 26 | | (2) regardless of whether the child is also a |
|---|
| 27 | 27 | | recipient of Medicaid. |
|---|
| 28 | 28 | | (c) The mother of a child receiving medical transportation |
|---|
| 29 | 29 | | program services under this section must provide: |
|---|
| 30 | 30 | | (1) if required by law, a child passenger safety seat |
|---|
| 31 | 31 | | system as defined under Section 545.412, Transportation Code; and |
|---|
| 32 | 32 | | (2) any other equipment that the child needs in order |
|---|
| 33 | 33 | | to safely receive medical transportation program services. |
|---|
| 34 | 34 | | (d) In addition to state and federal money, the commission |
|---|
| 35 | 35 | | may accept gifts and grants from any source to provide medical |
|---|
| 36 | 36 | | transportation program services to an eligible child under this |
|---|
| 37 | 37 | | section. |
|---|
| 38 | 38 | | (e) The executive commissioner may adopt rules to implement |
|---|
| 39 | 39 | | this section. |
|---|
| 40 | 40 | | SECTION 2. In order to implement Section 531.024141, |
|---|
| 41 | 41 | | Government Code, as added by this Act, as soon as practicable after |
|---|
| 42 | 42 | | the effective date of this Act, the Health and Human Services |
|---|
| 43 | 43 | | Commission shall apply for and actively seek: |
|---|
| 44 | 44 | | (1) a waiver or other authorization from the federal |
|---|
| 45 | 45 | | Centers for Medicare and Medicaid Services or other appropriate |
|---|
| 46 | 46 | | federal agency; and |
|---|
| 47 | 47 | | (2) federal money that may be available for the |
|---|
| 48 | 48 | | purpose of that section. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect September 1, 2019. |
