55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of services to certain children under the
88 Medicaid medical transportation program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.024141 to read as follows:
1212 Sec. 531.024141. MEDICAL TRANSPORTATION PROGRAM SERVICES
1313 FOR CERTAIN CHILDREN. (a) Notwithstanding Section 32.024(e),
1414 Human Resources Code, the commission shall provide:
1515 (1) medical transportation program services to an
1616 eligible child described by Subsection (b); and
1717 (2) reimbursement for those services.
1818 (b) A child is eligible to receive medical transportation
1919 program services under this section:
2020 (1) if the child's mother is:
2121 (A) a recipient of Medicaid during a pregnancy;
2222 and
2323 (B) using medical transportation program
2424 services to travel to and from a covered health care service related
2525 to the pregnancy, including postpartum care; and
2626 (2) regardless of whether the child is also a
2727 recipient of Medicaid.
2828 (c) The mother of a child receiving medical transportation
2929 program services under this section must provide:
3030 (1) if required by law, a child passenger safety seat
3131 system as defined under Section 545.412, Transportation Code; and
3232 (2) any other equipment that the child needs in order
3333 to safely receive medical transportation program services.
3434 (d) In addition to state and federal money, the commission
3535 may accept gifts and grants from any source to provide medical
3636 transportation program services to an eligible child under this
3737 section.
3838 (e) The executive commissioner may adopt rules to implement
3939 this section.
4040 SECTION 2. In order to implement Section 531.024141,
4141 Government Code, as added by this Act, as soon as practicable after
4242 the effective date of this Act, the Health and Human Services
4343 Commission shall apply for and actively seek:
4444 (1) a waiver or other authorization from the federal
4545 Centers for Medicare and Medicaid Services or other appropriate
4646 federal agency; and
4747 (2) federal money that may be available for the
4848 purpose of that section.
4949 SECTION 3. This Act takes effect September 1, 2019.
