8 | 8 | | at a vehicle storage facility or governmental vehicle storage |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter D, Chapter 2303, Occupations Code, is |
---|
12 | 12 | | amended by adding Section 2303.162 to read as follows: |
---|
13 | 13 | | Sec. 2303.162. RECOVERY OF PROPERTY FROM CERTAIN STORED |
---|
14 | 14 | | VEHICLES. (a) In this section: |
---|
15 | 15 | | (1) "Governmental vehicle storage facility" means a |
---|
16 | 16 | | garage, parking lot, or other facility that is: |
---|
17 | 17 | | (A) owned by a governmental entity; and |
---|
18 | 18 | | (B) used to store or park at least 10 vehicles |
---|
19 | 19 | | each year. |
---|
20 | 20 | | (2) "Motor carrier" has the meaning assigned by |
---|
21 | 21 | | Section 643.001, Transportation Code. |
---|
22 | 22 | | (b) The operator of a vehicle storage facility or |
---|
23 | 23 | | governmental vehicle storage facility shall allow the owner of |
---|
24 | 24 | | property that is left in a vehicle stored at the facility to recover |
---|
25 | 25 | | the property if: |
---|
26 | 26 | | (1) at the time the vehicle was towed to the facility |
---|
27 | 27 | | for storage: |
---|
28 | 28 | | (A) the vehicle was operated by a motor carrier; |
---|
29 | 29 | | and |
---|
30 | 30 | | (B) the property was transported under an |
---|
31 | 31 | | agreement between the property owner and the motor carrier; and |
---|
32 | 32 | | (2) the property owner demonstrates ownership of the |
---|
33 | 33 | | property. |
---|
34 | 34 | | (c) The commission by rule shall determine the documents |
---|
35 | 35 | | necessary to establish a person's ownership of property under this |
---|
36 | 36 | | section. |
---|
37 | 37 | | SECTION 2. This Act takes effect September 1, 2019. |
