66 AN ACT
77 relating to the recovery of property from certain vehicles stored
88 at a vehicle storage facility or governmental vehicle storage
99 facility.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 2303, Occupations Code, is
1212 amended by adding Section 2303.162 to read as follows:
1313 Sec. 2303.162. RECOVERY OF PROPERTY FROM CERTAIN STORED
1414 VEHICLES. (a) In this section:
1515 (1) "Governmental vehicle storage facility" means a
1616 garage, parking lot, or other facility that is:
1717 (A) owned by a governmental entity; and
1818 (B) used to store or park at least 10 vehicles
1919 each year.
2020 (2) "Motor carrier" has the meaning assigned by
2121 Section 643.001, Transportation Code.
2222 (b) The operator of a vehicle storage facility or
2323 governmental vehicle storage facility shall allow the owner of
2424 property that is left in a vehicle stored at the facility to recover
2525 the property if:
2626 (1) at the time the vehicle was towed to the facility
2727 for storage:
2828 (A) the vehicle was operated by a motor carrier;
2929 and
3030 (B) the property was transported under an
3131 agreement between the property owner and the motor carrier; and
3232 (2) the property owner demonstrates ownership of the
3333 property.
3434 (c) The commission by rule shall determine the documents
3535 necessary to establish a person's ownership of property under this
3636 section.
3737 SECTION 2. This Act takes effect September 1, 2019.
