7 | 7 | | relating to factors the Texas Historical Commission considers in |

8 | 8 | | reviewing an application for a grant or loan through the historic |
---|
9 | 9 | | courthouse preservation program. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 442.0081(e), Government Code, is amended |
---|
12 | 12 | | to read as follows: |
---|
13 | 13 | | (e) In considering whether to grant an application, the |
---|
14 | 14 | | commission shall also consider the following factors: |
---|
15 | 15 | | (1) the amount of money available for a grant or loan |
---|
16 | 16 | | and the percentage of the costs that the county or municipality will |
---|
17 | 17 | | contribute; |
---|
18 | 18 | | (2) whether the county or municipality will contribute |
---|
19 | 19 | | any in-kind contribution such as labor or materials; |
---|
20 | 20 | | (3) the cost to preserve or restore the courthouse; |
---|
21 | 21 | | (4) the architectural style of the courthouse; |
---|
22 | 22 | | (5) the historic significance of the courthouse; |
---|
23 | 23 | | (6) the county's or municipality's master preservation |
---|
24 | 24 | | plan; [and] |
---|
25 | 25 | | (7) the county's or municipality's local funding |
---|
26 | 26 | | capacity as measured by the total taxable value of properties in the |
---|
27 | 27 | | county or municipality, as applicable; and |
---|
28 | 28 | | (8) any other factors that the commission by rule may |
---|
29 | 29 | | provide. |

30 | 30 | | SECTION 2. The change in law made by this Act applies only |
---|
31 | 31 | | to an application filed on or after the effective date of this Act. |
---|
32 | 32 | | An application filed before the effective date of this Act is |
---|
33 | 33 | | governed by the law in effect on the date the application was filed, |
---|
34 | 34 | | and the former law is continued in effect for that purpose. |
---|
35 | 35 | | SECTION 3. This Act takes effect September 1, 2019. |
