55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to factors the Texas Historical Commission considers in
88 reviewing an application for a grant or loan through the historic
99 courthouse preservation program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 442.0081(e), Government Code, is amended
1212 to read as follows:
1313 (e) In considering whether to grant an application, the
1414 commission shall also consider the following factors:
1515 (1) the amount of money available for a grant or loan
1616 and the percentage of the costs that the county or municipality will
1717 contribute;
1818 (2) whether the county or municipality will contribute
1919 any in-kind contribution such as labor or materials;
2020 (3) the cost to preserve or restore the courthouse;
2121 (4) the architectural style of the courthouse;
2222 (5) the historic significance of the courthouse;
2323 (6) the county's or municipality's master preservation
2424 plan; [and]
2525 (7) the county's or municipality's local funding
2626 capacity as measured by the total taxable value of properties in the
2727 county or municipality, as applicable; and
2828 (8) any other factors that the commission by rule may
2929 provide.
3030 SECTION 2. The change in law made by this Act applies only
3131 to an application filed on or after the effective date of this Act.
3232 An application filed before the effective date of this Act is
3333 governed by the law in effect on the date the application was filed,
3434 and the former law is continued in effect for that purpose.
3535 SECTION 3. This Act takes effect September 1, 2019.
