66 AN ACT
77 relating to the civil liability of certain businesses in connection
88 with allowing concealed handguns on the business premises.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Title 4, Civil Practice and Remedies Code, is
1111 amended by adding Chapter 95A to read as follows:
1212 CHAPTER 95A. LIABILITY OF BUSINESS IN CONNECTION WITH ALLOWING
1313 CONCEALED HANDGUNS
1414 Sec. 95A.001. DEFINITION. In this chapter, "license
1515 holder" means a person licensed to carry a handgun under Subchapter
1616 H, Chapter 411, Government Code.
1717 Sec. 95A.002. IMMUNITY OF BUSINESS THAT ALLOWS CONCEALED
1818 HANDGUNS. A person with control over the premises of a business who
1919 allows entry on the premises by a license holder with a concealed
2020 handgun is not liable based solely on that permission for damages
2121 arising from the lawful carrying of a concealed handgun on the
2222 premises.
2323 Sec. 95A.003. ORAL OR WRITTEN COMMUNICATION. For purposes
2424 of this chapter, the lack of an oral or written communication that
2525 constitutes notice for purposes of Section 30.06, Penal Code, is
2626 sufficient to constitute allowing entry on the premises by a
2727 license holder with a concealed handgun.
2828 SECTION 2. Section 95A.002, Civil Practice and Remedies
2929 Code, as added by this Act, does not apply to a cause of action that
3030 accrued before the effective date of this Act. A cause of action
3131 that accrued before the effective date of this Act is governed by
3232 the law applicable to the cause of action immediately before that
3333 date, and that law is continued in effect for that purpose.
3434 SECTION 3. This Act takes effect September 1, 2019.
