| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 30.06, Penal Code, is amended by adding | |
| 11 | 11 | Subsection (g) to read as follows: | |
| 12 | 12 | (g) It is a defense to prosecution under this section that | |
| 13 | 13 | at the time of the commission of the offense the actor was an active | |
| 14 | 14 | judicial officer, as defined by Section 411.201, Government Code. | |
| 15 | 15 | SECTION 2. The change in law made by this Act applies only to | |
| 16 | 16 | an offense committed on or after the effective date of this Act. An | |
| 17 | 17 | offense committed before the effective date of this Act is governed | |
| 18 | 18 | by the law in effect on the date the offense was committed, and the | |
| 19 | 19 | former law is continued in effect for that purpose. For purposes of | |
| 20 | 20 | this section, an offense was committed before the effective date of | |
| 21 | 21 | this Act if any element of the offense occurred before that date. | |
| 22 | 22 | SECTION 3. This Act takes effect September 1, 2019. |
