| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 35, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 35.107 to read as follows: |
|---|
| 12 | 12 | | Sec. 35.107. EXPIRATION OF AUTHORITY TO SELL OR CONVEY |
|---|
| 13 | 13 | | POWER. (a) Notwithstanding another provision of this subchapter, |
|---|
| 14 | 14 | | the commissioner's authority to sell or convey power under this |
|---|
| 15 | 15 | | subchapter expires September 1, 2022. |
|---|
| 16 | 16 | | (b) This section does not affect the commissioner's |
|---|
| 17 | 17 | | authority to sell or convey natural gas under this subchapter. |
|---|
| 18 | 18 | | SECTION 2. (a) The General Land Office or an entity |
|---|
| 19 | 19 | | operating under a contract with the General Land Office may |
|---|
| 20 | 20 | | continue to provide retail electric service in accordance with |
|---|
| 21 | 21 | | Subchapter D, Chapter 35, Utilities Code, as that subchapter |
|---|
| 22 | 22 | | existed before the effective date of this Act, under the terms of an |
|---|
| 23 | 23 | | agreement with a customer entered into before the effective date of |
|---|
| 24 | 24 | | this Act, only until the date the agreement expires. |
|---|
| 25 | 25 | | (b) The General Land Office may not renew or extend the |
|---|
| 26 | 26 | | expiration or termination date of a contract to provide retail |
|---|
| 27 | 27 | | electric service in accordance with Subchapter D, Chapter 35, |
|---|
| 28 | 28 | | Utilities Code, to a date after September 1, 2022. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2019. |
