66 AN ACT
77 relating to the authority of the General Land Office to sell retail
88 electric power.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 35, Utilities Code, is
1111 amended by adding Section 35.107 to read as follows:
1212 Sec. 35.107. EXPIRATION OF AUTHORITY TO SELL OR CONVEY
1313 POWER. (a) Notwithstanding another provision of this subchapter,
1414 the commissioner's authority to sell or convey power under this
1515 subchapter expires September 1, 2022.
1616 (b) This section does not affect the commissioner's
1717 authority to sell or convey natural gas under this subchapter.
1818 SECTION 2. (a) The General Land Office or an entity
1919 operating under a contract with the General Land Office may
2020 continue to provide retail electric service in accordance with
2121 Subchapter D, Chapter 35, Utilities Code, as that subchapter
2222 existed before the effective date of this Act, under the terms of an
2323 agreement with a customer entered into before the effective date of
2424 this Act, only until the date the agreement expires.
2525 (b) The General Land Office may not renew or extend the
2626 expiration or termination date of a contract to provide retail
2727 electric service in accordance with Subchapter D, Chapter 35,
2828 Utilities Code, to a date after September 1, 2022.
2929 SECTION 3. This Act takes effect September 1, 2019.
