| 5 | 11 | | relating to a common characteristic or use project in a public |
|---|
| 6 | 12 | | improvement district in certain municipalities. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 14 | | SECTION 1. Section 372.0035(a), Local Government Code, is |
|---|
| 9 | 15 | | amended to read as follows: |
|---|
| 10 | 16 | | (a) This section applies only to: |
|---|
| 11 | 17 | | (1) a municipality that: |
|---|
| 12 | 18 | | (A) has a population of more than 650,000 and |
|---|
| 13 | 19 | | less than two million; [or] |
|---|
| 14 | 20 | | (B) has a population of more than 325,000 and |
|---|
| 15 | 21 | | less than 625,000; or |
|---|
| 16 | 22 | | (C) has a population of more than 180,000 and |
|---|
| 17 | 23 | | less than 200,000; and |
|---|
| 18 | 24 | | (2) a public improvement district established under |
|---|
| 19 | 25 | | this subchapter and solely composed of territory in which the only |
|---|
| 20 | 26 | | businesses are: |
|---|
| 21 | 27 | | (A) hotels with 100 or more rooms ordinarily used |
|---|
| 22 | 28 | | for sleeping, if the district is established by a municipality |
|---|
| 23 | 29 | | described by Subdivision (1)(A); [or] |
|---|
| 24 | 30 | | (B) hotels with 75 or more rooms ordinarily used |
|---|
| 25 | 31 | | for sleeping, if the district is established by a municipality |
|---|
| 26 | 32 | | described by Subdivision (1)(B); or |
|---|
| 27 | 33 | | (C) hotels with 10 or more rooms ordinarily used |
|---|
| 28 | 34 | | for sleeping, if the district is established by a municipality |
|---|
| 29 | 35 | | described by Subdivision (1)(C). |
|---|
| 30 | 36 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 37 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 39 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 40 | | Act takes effect September 1, 2019. |
