55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an annual report prepared by the Health Professions
88 Council.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 101.151, Occupations Code, is amended to
1111 read as follows:
1212 Sec. 101.151. ANNUAL REPORT. (a) The council shall prepare
1313 an annual report that includes:
1414 (1) a statistical compilation of enforcement actions
1515 taken by a regulatory agency listed in Section 101.002;
1616 (2) recommendations for statutory changes to improve
1717 the regulation of the health care professions; [and]
1818 (3) strategies to expand the health care workforce in
1919 this state, including:
2020 (A) methods for reducing the time required to
2121 process license applications for health care professions;
2222 (B) methods for increasing the number of health
2323 care practitioners providing mental and behavioral health care
2424 services; and
2525 (C) any statutory and legislative appropriation
2626 recommendations the council determines are appropriate for
2727 expanding the health care workforce in this state, including
2828 recommendations for expanding the health care workforce in
2929 medically underserved areas; and
3030 (4) [(3)] other relevant information and
3131 recommendations determined necessary by the council.
3232 (b) The council shall send the report to the governor, the
3333 lieutenant governor, [and] the speaker of the house of
3434 representatives, the chairs of the standing committees of the
3535 senate and the house of representatives having primary jurisdiction
3636 over public health, and the chairs of the standing committees of the
3737 senate and the house of representatives having primary jurisdiction
3838 over state finance or appropriations not later than February 1 of
3939 each year.
4040 SECTION 2. Notwithstanding Section 101.151, Occupations
4141 Code, as amended by this Act, the Health Professions Council
4242 established under Chapter 101, Occupations Code:
4343 (1) is not required to include in the annual report
4444 required under Section 101.151 the strategies described by Section
4545 101.151(a)(3), Occupations Code, as added by this Act, until
4646 February 1, 2021; and
4747 (2) shall submit to the governor, the lieutenant
4848 governor, the speaker of the house of representatives, the chairs
4949 of the standing committees of the senate and the house of
5050 representatives having primary jurisdiction over public health,
5151 and the chairs of the standing committees of the senate and the
5252 house of representatives having primary jurisdiction over state
5353 finance or appropriations a report that includes only the
5454 strategies described by Section 101.151(a)(3) not later than June
5555 1, 2020.
5656 SECTION 3. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2019.
