7 | 7 | | relating to the standard service retirement annuity for members of |

8 | 8 | | the legislature and the lieutenant governor. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 814.103, Government Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | Sec. 814.103. SERVICE RETIREMENT BENEFITS FOR ELECTED CLASS |
---|
13 | 13 | | SERVICE. (a) Except as provided by Subsection (b), the standard |
---|
14 | 14 | | service retirement annuity for service credited in the elected |
---|
15 | 15 | | class of membership for a person described by Section |
---|
16 | 16 | | 812.002(a)(1), other than the lieutenant governor, or a person |
---|
17 | 17 | | described by Section 812.002(a)(3) is an amount equal to the number |
---|
18 | 18 | | of years of service credit in that class, times two percent of the |
---|
19 | 19 | | state salary, excluding longevity pay payable under Section |
---|
20 | 20 | | 659.0445 and as adjusted from time to time, being paid a district |
---|
21 | 21 | | judge. |
---|
22 | 22 | | (b) The standard service retirement annuity for service |
---|
23 | 23 | | credited in the elected class computed under Subsection (a) may not |
---|
24 | 24 | | exceed at any time 100 percent of the state salary being paid a |
---|
25 | 25 | | district judge. |
---|
26 | 26 | | (c) The standard service retirement annuity for service |
---|
27 | 27 | | credited in the elected class of membership for the lieutenant |
---|
28 | 28 | | governor or a person described by Section 812.002(a)(2) is an |
---|
29 | 29 | | amount equal to the amount of the average standard service |
---|
30 | 30 | | retirement annuity of a full-time certified classroom teacher who |
---|
31 | 31 | | retired from employment with the public free schools of this state |
---|
32 | 32 | | in the preceding calendar year as determined by the Teacher |
---|
33 | 33 | | Retirement System of Texas. |
---|
34 | 34 | | (d) Not later than February 1 of each year, the Teacher |
---|
35 | 35 | | Retirement System of Texas shall make the determination required |
---|
36 | 36 | | under Subsection (c) with respect to the preceding calendar year |
---|
37 | 37 | | and notify the lieutenant governor, members of the legislature, and |
---|
38 | 38 | | the retirement system of its determination. |
---|
39 | 39 | | SECTION 2. Section 814.103, Government Code, as amended by |
---|
40 | 40 | | this Act, applies only to the standard service retirement annuity |
---|
41 | 41 | | of a member of the elected class who is first eligible to become a |
---|
42 | 42 | | member of the elected class on or after January 1, 2020. The |
---|
43 | 43 | | standard service retirement annuity of a member of the elected |
---|
44 | 44 | | class who is first eligible to become a member of the elected class |
---|
45 | 45 | | before January 1, 2020, is governed by the law as it existed |
---|
46 | 46 | | immediately before that date, and that law is continued in effect |
---|
47 | 47 | | for that purpose. |
---|
48 | 48 | | SECTION 3. This Act takes effect on the date on which the |
---|
49 | 49 | | constitutional amendment proposed by the 86th Legislature, Regular |
---|
50 | 50 | | Session, 2019, setting the salaries of members of the legislature |
---|
51 | 51 | | and the lieutenant governor based on the average public school |
---|
52 | 52 | | teacher salary in this state is approved by the voters. If that |
---|
53 | 53 | | amendment is not approved by the voters, this Act has no effect. |
