66 AN ACT
77 relating to the standard service retirement annuity for members of
88 the legislature and the lieutenant governor.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 814.103, Government Code, is amended to
1111 read as follows:
1212 Sec. 814.103. SERVICE RETIREMENT BENEFITS FOR ELECTED CLASS
1313 SERVICE. (a) Except as provided by Subsection (b), the standard
1414 service retirement annuity for service credited in the elected
1515 class of membership for a person described by Section
1616 812.002(a)(1), other than the lieutenant governor, or a person
1717 described by Section 812.002(a)(3) is an amount equal to the number
1818 of years of service credit in that class, times two percent of the
1919 state salary, excluding longevity pay payable under Section
2020 659.0445 and as adjusted from time to time, being paid a district
2121 judge.
2222 (b) The standard service retirement annuity for service
2323 credited in the elected class computed under Subsection (a) may not
2424 exceed at any time 100 percent of the state salary being paid a
2525 district judge.
2626 (c) The standard service retirement annuity for service
2727 credited in the elected class of membership for the lieutenant
2828 governor or a person described by Section 812.002(a)(2) is an
2929 amount equal to the amount of the average standard service
3030 retirement annuity of a full-time certified classroom teacher who
3131 retired from employment with the public free schools of this state
3232 in the preceding calendar year as determined by the Teacher
3333 Retirement System of Texas.
3434 (d) Not later than February 1 of each year, the Teacher
3535 Retirement System of Texas shall make the determination required
3636 under Subsection (c) with respect to the preceding calendar year
3737 and notify the lieutenant governor, members of the legislature, and
3838 the retirement system of its determination.
3939 SECTION 2. Section 814.103, Government Code, as amended by
4040 this Act, applies only to the standard service retirement annuity
4141 of a member of the elected class who is first eligible to become a
4242 member of the elected class on or after January 1, 2020. The
4343 standard service retirement annuity of a member of the elected
4444 class who is first eligible to become a member of the elected class
4545 before January 1, 2020, is governed by the law as it existed
4646 immediately before that date, and that law is continued in effect
4747 for that purpose.
4848 SECTION 3. This Act takes effect on the date on which the
4949 constitutional amendment proposed by the 86th Legislature, Regular
5050 Session, 2019, setting the salaries of members of the legislature
5151 and the lieutenant governor based on the average public school
5252 teacher salary in this state is approved by the voters. If that
5353 amendment is not approved by the voters, this Act has no effect.
