75 A BILL TO BE ENTITLED
86 AN ACT
97 relating to improving training and staff development for primary
108 and secondary educators to enable them to more effectively serve
119 all students.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13- SECTION 1. Section 21.001, Education Code, is amended by
14- adding Subdivision (4) to read as follows:
15- (4) "Student with a disability" means a student who
16- is:
17- (A) eligible to participate in a school
18- district's special education program under Section 29.003;
19- (B) covered by Section 504, Rehabilitation Act of
20- 1973 (29 U.S.C. Section 794); or
21- (C) covered by the Individuals with Disabilities
22- Education Act (20 U.S.C. Section 1400 et seq.).
23- SECTION 2. Section 21.044, Education Code, is amended by

2513 (a-1) to read as follows:
2614 (a) The board shall propose rules:
2715 (1) specifying what each educator is expected to know

2917 disabilities;
3018 (2) establishing the training requirements a person
3119 must accomplish to obtain a certificate, enter an internship, or
3220 enter an induction-year program; and
3321 (3) specifying[. The board shall specify] the minimum
3422 academic qualifications required for a certificate.
3523 (a-1) Any training requirements for a certificate specified
3624 under Subsection (a) must require that the person demonstrate:
37- (1) basic knowledge of:
38- (A) each disability category under the
39- Individuals with Disabilities Education Act (20 U.S.C. Section 1400
40- et seq.) and how each category can affect student learning and
41- development; and
42- (B) conditions that may be considered a
43- disability under Section 504, Rehabilitation Act of 1973 (29 U.S.C.
44- Section 794), and how a condition covered by that section can affect
45- student learning and development;
25+ (1) basic knowledge of each disability category under
26+ the Individuals with Disabilities Education Act (20 U.S.C. Section
27+ 1400 et seq.) and how each category can affect student learning and
28+ development;
4629 (2) competence in the use of proactive instructional
4730 planning techniques that:
4831 (A) provide flexibility in the ways:
4932 (i) information is presented;
5033 (ii) students respond or demonstrate
5134 knowledge and skills; and
5235 (iii) students are engaged;
5336 (B) reduce barriers in instruction;
5437 (C) provide appropriate accommodations,
5538 supports, and challenges; and
5639 (D) maintain high achievement expectations for
5740 all students, including students with disabilities and students of
5841 limited English proficiency; and
5942 (3) competence in the use of evidence-based inclusive
6043 instructional practices, including:
6144 (A) general and special education collaborative
6245 and co-teaching models and approaches;
6346 (B) multitiered systems of support, including
6447 response to intervention strategies, classroom and school level
6548 data-based collaborative structures, and evidence-based strategies
6649 for intervention and progress monitoring systems in academic areas;
6750 (C) classroom management techniques using
6851 evidence-based behavioral intervention strategies and supports;
6952 and
7053 (D) appropriate adaptation strategies, including
7154 accommodations, modifications, and instruction in the use of
7255 assistive technology for instruction.
7356 (b) The [Any] minimum academic qualifications for a
7457 certificate specified under Subsection (a) [that require a person
7558 to possess a bachelor's degree] must [also] require that the person
7659 receive, as part of the training required to obtain that
7760 certificate, instruction in detection and education of students
7861 with dyslexia.
7962 (c-1) The [Any] minimum academic qualifications for a
8063 certificate specified under Subsection (a) [that require a person
8164 to possess a bachelor's degree] must [also] require that the person
8265 receive, as part of the training required to obtain that
8366 certificate, instruction regarding mental health, substance abuse,
8467 and youth suicide. The instruction required must:
8568 (1) be provided through a program selected from the
8669 list of recommended best practice-based programs and
8770 research-based practices established under Section 161.325, Health
8871 and Safety Code; and
8972 (2) include effective strategies for teaching and
9073 intervening with students with mental or emotional disorders,
9174 including de-escalation techniques and positive behavioral
9275 interventions and supports.
9376 (g) Each educator preparation program must provide
9477 information regarding:
9578 (1) the skills that educators are required to possess,
9679 the responsibilities that educators are required to accept, and the
9780 high expectations for all students, including students with
9881 disabilities, in this state;
9982 (2) the effect of supply and demand forces on the
10083 educator workforce in this state;
10184 (3) the performance over time of the educator
10285 preparation program;
10386 (4) the importance of building strong classroom
10487 management skills;
10588 (5) the framework in this state for teacher and
10689 principal evaluation, including the procedures followed in
10790 accordance with Subchapter H; and
10891 (6) appropriate relationships, boundaries, and
10992 communications between educators and students.
110- SECTION 3. Section 21.0443(b), Education Code, is amended

11295 (b) To be eligible for approval or renewal of approval, an

11497 (1) incorporate proactive instructional planning

119102 (ii) students respond or demonstrate
120103 knowledge and skills; and
121104 (iii) students are engaged;
122105 (B) reduces barriers in instruction;
123106 (C) provides appropriate accommodations,
124107 supports, and challenges; and
125108 (D) maintains high achievement expectations for
126109 all students, including students with disabilities and students of
127110 limited English proficiency;
128111 (2) integrate inclusive practices for all students,
129112 including students with disabilities, and evidence-based
130113 instruction and intervention strategies throughout course work,
131114 clinical experience, and student teaching;
132115 (3) adequately prepare candidates for educator
133116 certification; and
134117 (4) meet the standards and requirements of the board.
135- SECTION 4. Section 21.045(a), Education Code, is amended to

137120 (a) The board shall propose rules necessary to establish
138121 standards to govern the continuing accountability of all educator
139122 preparation programs based on the following information that is
140123 disaggregated with respect to race, sex, and ethnicity:
141124 (1) results of the certification examinations
142125 prescribed under Section 21.048(a);
143126 (2) performance based on the appraisal system for
144127 beginning teachers adopted by the board;
145128 (3) achievement, including improvement in
146129 achievement, of all students, including students with
147130 disabilities, taught by beginning teachers for the first three
148131 years following certification, to the extent practicable;
149132 (4) compliance with board requirements regarding the
150133 frequency, duration, and quality of structural guidance and ongoing
151134 support provided by field supervisors to candidates completing
152135 student teaching, clinical teaching, or an internship; and
153136 (5) results from a teacher satisfaction survey,
154137 developed by the board with stakeholder input, of new teachers
155138 performed at the end of the teacher's first year of teaching.
156- SECTION 5. Section 21.0453(a), Education Code, is amended

158141 (a) The board shall require an educator preparation program
159142 to provide candidates for teacher certification with information
160143 concerning the following:
161144 (1) skills and responsibilities required of teachers
162145 with regard to all students, including students with disabilities;
163146 (2) expectations for student performance, including
164147 students with disabilities, based on state standards;
165148 (3) the current supply of and demand for teachers in
166149 this state;
167150 (4) the importance of developing classroom management
168151 skills; and
169152 (5) the state's framework for appraisal of teachers
170153 and principals.
171- SECTION 6. Section 21.046(b), Education Code, is amended to

173156 (b) The qualifications for certification as a principal
174157 must be sufficiently flexible so that an outstanding teacher may
175158 qualify by substituting approved experience and professional
176159 training for part of the educational requirements. Supervised and
177160 approved on-the-job experience in addition to required internship
178161 shall be accepted in lieu of classroom hours. The qualifications
179162 must emphasize:
180163 (1) instructional leadership, including the ability
181164 to create an inclusive school environment and to foster parent
182165 involvement;
183166 (2) administration, supervision, and communication
184167 skills;
185- (3) curriculum and instruction management, including
186- curriculum and instruction management for students with
187- disabilities;
168+ (3) curriculum and instruction management;
188169 (4) performance evaluation;
189170 (5) organization; and
190171 (6) fiscal management.
191- SECTION 7. Section 21.047(c), Education Code, is amended to

193174 (c) A center may develop and implement a comprehensive
194175 field-based educator preparation program to supplement the
195176 internship hours required in Section 21.050. This comprehensive
196177 field-based teacher program must:
197178 (1) be designed on the basis of current research into
198179 state-of-the-art teaching practices applicable to all students,
199180 including students with disabilities, curriculum theory and
200181 application within diverse student populations, evaluation of
201182 student outcomes, and the effective application of technology; and
202183 (2) have rigorous internal and external evaluation
203184 procedures that focus on content, delivery systems, and teacher and
204185 student outcomes.
205- SECTION 8. Sections 21.051(b) and (f), Education Code, are

207188 (b) Before a school district may employ a candidate for
208189 certification as a teacher of record and, except as provided by
209190 Subsection (b-1), after the candidate's admission to an educator
210191 preparation program, the candidate must complete at least 15 hours
211192 of field-based experience in which the candidate is actively
212193 engaged in instructional or educational activities involving a
213194 diverse student population that, to the greatest extent
214195 practicable, includes students with disabilities under supervision
215196 at:
216197 (1) a public school campus accredited or approved for
217198 the purpose by the agency; or
218199 (2) a private school recognized or approved for the
219200 purpose by the agency.
220201 (f) The board shall propose rules providing flexible
221202 options for persons for any field-based experience or internship
222203 required for certification. The options must, to the greatest
223204 extent practicable, involve interaction with a diverse student
224205 population, including students with disabilities.
225- SECTION 9. Section 21.451, Education Code, is amended by

228209 Subsection (a), a school district must use procedures that, to the

233214 (A) provides flexibility in the ways:
234215 (i) information is presented;
235216 (ii) students respond or demonstrate
236217 knowledge and skills; and
237218 (iii) students are engaged;
238219 (B) reduces barriers to instruction;
239220 (C) provides appropriate accommodations,
240221 supports, and challenges; and
241222 (D) maintains high achievement expectations for
242223 all students, including students with disabilities and students of
243224 limited English proficiency; and
244225 (2) integrates inclusive and evidence-based
245226 instructional practices for all students, including students with
246227 disabilities.
247- SECTION 10. This Act takes effect September 1, 2019.
