66 AN ACT
77 relating to a grant available to school districts to provide
88 services to students residing in care and treatment facilities and
99 residential placement facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1212 amended by adding Section 29.0181 to read as follows:
1313 Sec. 29.0181. GRANT PROGRAM TO EDUCATE STUDENTS RESIDING IN
1414 CARE AND TREATMENT FACILITIES AND RESIDENTIAL PLACEMENT
1515 FACILITIES. (a) This section applies to a student residing in a
1616 care and treatment facility, other than a state school, or
1717 residential placement facility whose parent or person standing in
1818 parental relation to the student does not reside in the school
1919 district providing education services to the student.
2020 (b) From funds appropriated for the purposes of this
2121 section, federal funds, or any other funds available, the
2222 commissioner shall make grants available to school districts to
2323 assist districts in covering the cost of educating students
2424 residing in care and treatment facilities or residential placement
2525 facilities.
2626 (c) A school district is eligible to apply for a grant under
2727 this section if:
2828 (1) the district does not receive sufficient funds,
2929 including state funds provided under Sections 42.151 and 42.152 and
3030 federal funds, for a student residing in a care and treatment
3131 facility or residential placement facility to pay for the education
3232 services provided to the student; or
3333 (2) the district does not receive sufficient funds,
3434 including state funds provided under Sections 42.151 and 42.152 and
3535 federal funds, for all students in the district residing in care and
3636 treatment facilities or residential placement facilities to pay for
3737 the education services provided to the students.
3838 (d) A school district that applies for a grant under this
3939 section must provide the commissioner with a report comparing the
4040 state and federal funds received by the district for students
4141 residing in care and treatment facilities and residential placement
4242 facilities with the expenses incurred by the district in providing
4343 education services to students residing in care and treatment
4444 facilities and residential placement facilities.
4545 (e) Expenses that may be included by a school district in
4646 applying for a grant under this section include the cost of training
4747 personnel to provide education services to a student residing in a
4848 care and treatment facility or a residential placement facility.
4949 (f) A school district that receives a grant under this
5050 section must educate students residing in care and treatment
5151 facilities and residential placement facilities in the least
5252 restrictive environment that is appropriate to meet the student's
5353 educational needs.
5454 (g) The commissioner shall adopt rules as necessary to
5555 administer this section.
5656 SECTION 2. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2019.
