55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of certain conduct involving prohibited
88 weapons; creating a criminal offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.01, Penal Code, is amended by adding
1111 Subdivision (20) to read as follows:
1212 (20) "Three-dimensional printer" means a device
1313 capable of producing a three-dimensional object from a digital
1414 model.
1515 SECTION 2. Sections 46.05(a) and (e), Penal Code, as
1616 amended by Chapters 155 (H.B. 1819) and 814 (H.B. 913), Acts of the
1717 85th Legislature, Regular Session, 2017, are reenacted and amended
1818 to read as follows:
1919 (a) A person commits an offense if the person intentionally
2020 or knowingly possesses, manufactures, transports, repairs, or
2121 sells:
2222 (1) any of the following items, unless the item is
2323 registered in the National Firearms Registration and Transfer
2424 Record maintained by the Bureau of Alcohol, Tobacco, Firearms and
2525 Explosives or otherwise not subject to that registration
2626 requirement or unless the item is classified as a curio or relic by
2727 the United States Department of Justice:
2828 (A) an explosive weapon;
2929 (B) a machine gun; or
3030 (C) a short-barrel firearm;
3131 (2) knuckles;
3232 (3) armor-piercing ammunition;
3333 (4) a chemical dispensing device;
3434 (5) a zip gun;
3535 (6) a tire deflation device; [or]
3636 (7) a firearm silencer, unless the firearm silencer is
3737 classified as a curio or relic by the United States Department of
3838 Justice or the actor otherwise possesses, manufactures,
3939 transports, repairs, or sells the firearm silencer in compliance
4040 with federal law;
4141 (8) [(7)] an improvised explosive device; or
4242 (9) a firearm containing a component part manufactured
4343 using a three-dimensional printer.
4444 (e) An offense under Subsection (a)(1), (3), (4), (5), [or]
4545 (7), (8), or (9) or (a-1) is a felony of the third degree. An
4646 offense under Subsection (a)(6) is a state jail felony. An offense
4747 under Subsection (a)(2) is a Class A misdemeanor.
4848 SECTION 3. Section 46.05, Penal Code, is amended by adding
4949 Subsection (a-1) to read as follows:
5050 (a-1) A person commits an offense if the person
5151 intentionally or knowingly:
5252 (1) manufactures a component part for a firearm using
5353 a three-dimensional printer; or
5454 (2) possesses, transports, repairs, or sells a
5555 component part described by Subdivision (1).
5656 SECTION 4. To the extent of any conflict, this Act controls
5757 over another Act of the 86th Legislature, Regular Session, 2019,
5858 relating to nonsubstantive additions to and corrections in enacted
5959 codes.
6060 SECTION 5. The change in law made by this Act applies only
6161 to an offense committed on or after the effective date of this Act.
6262 An offense committed before the effective date of this Act is
6363 governed by the law in effect on the date the offense was committed,
6464 and the former law is continued in effect for that purpose. For
6565 purposes of this section, an offense was committed before the
6666 effective date of this Act if any element of the offense occurred
6767 before that date.
6868 SECTION 6. This Act takes effect September 1, 2019.
