| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 43.358, 43.604, and 43.624, Parks and |
|---|
| 11 | 11 | | Wildlife Code, are amended to read as follows: |
|---|
| 12 | 12 | | Sec. 43.358. INSPECTION; NOTICE. (a) An authorized |
|---|
| 13 | 13 | | employee of the department may inspect [at any time and without |
|---|
| 14 | 14 | | warrant]: |
|---|
| 15 | 15 | | (1) any pen, coop, or enclosure holding white-tailed |
|---|
| 16 | 16 | | deer or mule deer; or |
|---|
| 17 | 17 | | (2) any records required to be maintained under |
|---|
| 18 | 18 | | Section 43.359(a). |
|---|
| 19 | 19 | | (b) The department shall give a deer breeder notice of an |
|---|
| 20 | 20 | | inspection not later than the third day before the date of the |
|---|
| 21 | 21 | | inspection. Notice may be made by telephone or sent electronically |
|---|
| 22 | 22 | | or as an electronic message on a wireless communication device. |
|---|
| 23 | 23 | | Sec. 43.604. INSPECTION; NOTICE. (a) An authorized |
|---|
| 24 | 24 | | employee of the department may inspect [at any time without |
|---|
| 25 | 25 | | warrant] the records required by Section 43.605 and the acreage for |
|---|
| 26 | 26 | | which the permit is issued for the purpose of determining the permit |
|---|
| 27 | 27 | | holder's compliance with the management plan. |
|---|
| 28 | 28 | | (b) The department shall give a permit holder notice of an |
|---|
| 29 | 29 | | inspection not later than the third day before the date of the |
|---|
| 30 | 30 | | inspection. Notice may be made by telephone or sent electronically |
|---|
| 31 | 31 | | or as an electronic message on a wireless communication device. |
|---|
