55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a Medicaid buy-in program for Medicaid recipients with
88 increased household income from employment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.024442 to read as follows:
1212 Sec. 531.024442. MEDICAID BUY-IN PROGRAM FOR CERTAIN
1313 PERSONS WITH INCREASED HOUSEHOLD INCOME FROM EMPLOYMENT. (a) The
1414 commission shall operate a Medicaid buy-in program for Medicaid
1515 recipients:
1616 (1) who are not eligible for a Medicaid buy-in program
1717 established under Section 531.02444; and
1818 (2) whose eligibility for Medicaid is otherwise being
1919 terminated solely because of an increase in household income
2020 received from employment.
2121 (b) The program under this section must be substantively
2222 identical to the Medicaid buy-in programs for persons with
2323 disabilities established under Section 531.02444, except to the
2424 extent that programmatic differences are appropriate because of the
2525 populations served by the programs.
2626 (c) The executive commissioner shall adopt rules for
2727 participation in the program under this section that provide for:
2828 (1) eligibility requirements, including household
2929 income limits for participation; and
3030 (2) requirements for program participants to pay
3131 premiums or cost-sharing payments.
3232 SECTION 2. Not later than January 1, 2020, the executive
3333 commissioner of the Health and Human Services Commission shall
3434 adopt the rules required by Section 531.024442, Government Code, as
3535 added by this Act, and the commission shall implement the program
3636 required by that section.
3737 SECTION 3. If before implementing any provision of this Act
3838 a state agency determines that a waiver or authorization from a
3939 federal agency is necessary for implementation of that provision,
4040 the agency affected by the provision shall request the waiver or
4141 authorization and may delay implementing that provision until the
4242 waiver or authorization is granted.
4343 SECTION 4. This Act takes effect September 1, 2019.
