44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to prescribing low-THC cannabis to certain patients for
77 compassionate use.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 169.001(2), Occupations Code, is amended
1010 to read as follows:
1111 (2) "Epilepsy" has the meaning assigned by Section
1212 40.001, Health and Safety Code ["Intractable epilepsy" means a
1313 seizure disorder in which the patient's seizures have been treated
1414 by two or more appropriately chosen and maximally titrated
1515 antiepileptic drugs that have failed to control the seizures].
1616 SECTION 2. Section 169.002(b), Occupations Code, is amended
1717 to read as follows:
1818 (b) A physician is qualified to prescribe low-THC cannabis
1919 to a patient with [intractable] epilepsy if the physician:
2020 (1) is licensed under this subtitle;
2121 (2) dedicates a significant portion of clinical
2222 practice to the evaluation and treatment of epilepsy; and
2323 (3) is certified:
2424 (A) by the American Board of Psychiatry and
2525 Neurology in:
2626 (i) epilepsy; or
2727 (ii) neurology or neurology with special
2828 qualification in child neurology and is otherwise qualified for the
2929 examination for certification in epilepsy; or
3030 (B) in neurophysiology by:
3131 (i) the American Board of Psychiatry and
3232 Neurology; or
3333 (ii) the American Board of Clinical
3434 Neurophysiology.
3535 SECTION 3. Section 169.003, Occupations Code, is amended to
3636 read as follows:
3737 Sec. 169.003. PRESCRIPTION OF LOW-THC CANNABIS. A physician
3838 described by Section 169.002 may prescribe low-THC cannabis to
3939 alleviate a patient
4040 's seizures if:
4141 (1) the patient is a permanent resident of the state;
4242 (2) the physician complies with the registration
4343 requirements of Section 169.004; and
4444 (3) the physician certifies to the department that:
4545 (A) the patient is diagnosed with [intractable]
4646 epilepsy;
4747 (B) the physician determines the risk of the
4848 medical use of low-THC cannabis by the patient is reasonable in
4949 light of the potential benefit for the patient; and
5050 (C) a second physician qualified to prescribe
5151 low-THC cannabis under Section 169.002 has concurred with the
5252 determination under Paragraph (B), and the second physician's
5353 concurrence is recorded in the patient's medical record.
5454 SECTION 4. This Act takes effect September 1, 2019.
