77 relating to changing statutory references to marihuana to cannabis.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 13.22, Code of Criminal Procedure, is
1010 amended to read as follows:
1111 Art. 13.22. POSSESSION AND DELIVERY OF CANNABIS
1212 [MARIHUANA]. An offense of possession or delivery of cannabis
1313 [marihuana] may be prosecuted in the county where the offense was
1414 committed or with the consent of the defendant in a county that is
1515 adjacent to and in the same judicial district as the county where
1616 the offense was committed.
1717 SECTION 2. Article 15.27(h), Code of Criminal Procedure, is
1818 amended to read as follows:
1919 (h) This article applies to any felony offense and the
2020 following misdemeanors:
2121 (1) an offense under Section 20.02, 21.08, 22.01, 22.05,
2222 22.07, or 71.02, Penal Code;
2323 (2) the unlawful use, sale, or possession of a controlled
2424 substance, drug paraphernalia, or cannabis [marihuana], as defined
2525 by Chapter 481, Health and Safety Code; or
2626 (3) the unlawful possession of any of the weapons or devices
2727 listed in Sections 46.01(1)-(14) or (16), Penal Code, or a weapon
2828 listed as a prohibited weapon under Section 46.05, Penal Code.
2929 SECTION 3. Article 18A.101, Code of Criminal Procedure, is
3030 amended to read as follows:
3131 Art. 18A.101. OFFENSES FOR WHICH INTERCEPTION ORDER MAY BE
3232 ISSUED. A judge of competent jurisdiction may issue an
3333 interception order only if the prosecutor applying for the order
3434 shows probable cause to believe that the interception will provide
3535 evidence of the commission of:
3636 (1) a felony under any of the following provisions of
3737 the Health and Safety Code:
3838 (A) Chapter 481, other than felony possession of
3939 cannabis [marihuana];
4040 (B) Chapter 483; or
4141 (C) Section 485.032;
4242 (2) an offense under any of the following provisions
4343 of the Penal Code:
4444 (A) Section 19.02;
4545 (B) Section 19.03;
4646 (C) Section 20.03;
4747 (D) Section 20.04;
4848 (E) Chapter 20A;
4949 (F) Chapter 34, if the criminal activity giving
5050 rise to the proceeds involves the commission of an offense under
5151 Title 5, Penal Code, or an offense under federal law or the laws of
5252 another state containing elements that are substantially similar to
5353 the elements of an offense under Title 5;
5454 (G) Section 38.11;
5555 (H) Section 43.04;
5656 (I) Section 43.05; or
5757 (J) Section 43.26; or
5858 (3) an attempt, conspiracy, or solicitation to commit
5959 an offense listed in Subdivision (1) or (2).
6060 SECTION 4. Article 42A.514(a), Code of Criminal Procedure,
6161 is amended to read as follows:
6262 (a) If a judge grants community supervision to a defendant
6363 younger than 18 years of age convicted of an alcohol-related
6464 offense under Section 106.02, 106.025, 106.04, 106.041, 106.05, or
6565 106.07, Alcoholic Beverage Code, or Section 49.02, Penal Code, or
6666 an offense involving possession of a controlled substance or
6767 cannabis [marihuana] under Section 481.115, 481.1151, 481.116,
6868 481.1161, 481.117, 481.118, or 481.121, Health and Safety Code, the
6969 judge may require the defendant as a condition of community
7070 supervision to attend, as appropriate:
7171 (1) an alcohol awareness program approved under
7272 Section 106.115, Alcoholic Beverage Code; or
7373 (2) a drug education program that is designed to
7474 educate persons on the dangers of drug abuse and is approved by the
7575 Department of State Health Services in accordance with Section
7676 521.374, Transportation Code.
7777 SECTION 5. Article 42A.551(c), Code of Criminal Procedure,
7878 is amended to read as follows:
7979 (c) Subsection (a) does not apply to a defendant who:
8080 (1) under Section 481.1151(b)(1), Health and Safety
8181 Code, possessed more than five abuse units of the controlled
8282 substance;
8383 (2) under Section 481.1161(b)(3), Health and Safety
8484 Code, possessed more than one pound, by aggregate weight, including
8585 adulterants or dilutants, of the controlled substance; or
8686 (3) under Section 481.121(b)(3), Health and Safety
8787 Code, possessed more than one pound of cannabis [marihuana].
8888 SECTION 6. Section 37.005(c), Education Code, is amended to
8989 read as follows:
9090 (c) A student who is enrolled in a grade level below grade
9191 three may not be placed in out-of-school suspension unless while on
9292 school property or while attending a school-sponsored or
9393 school-related activity on or off of school property, the student
9494 engages in:
9595 (1) conduct that contains the elements of an offense
9696 related to weapons under Section 46.02 or 46.05, Penal Code;
9797 (2) conduct that contains the elements of a violent
9898 offense under Section 22.01, 22.011, 22.02, or 22.021, Penal Code;
9999 or
100100 (3) selling, giving, or delivering to another person
101101 or possessing, using, or being under the influence of any amount of:
102102 (A) cannabis [marihuana] or a controlled
103103 substance, as defined by Chapter 481, Health and Safety Code, or by
104104 21 U.S.C. Section 801 et seq.;
105105 (B) a dangerous drug, as defined by Chapter 483,
106106 Health and Safety Code; or
107107 (C) an alcoholic beverage, as defined by Section
108108 1.04, Alcoholic Beverage Code.
109109 SECTION 7. Section 37.006(a), Education Code, is amended to
110110 read as follows:
111111 (a) A student shall be removed from class and placed in a
112112 disciplinary alternative education program as provided by Section
113113 37.008 if the student:
114114 (1) engages in conduct involving a public school that
115115 contains the elements of the offense of false alarm or report under
116116 Section 42.06, Penal Code, or terroristic threat under Section
117117 22.07, Penal Code; or
118118 (2) commits the following on or within 300 feet of
119119 school property, as measured from any point on the school's real
120120 property boundary line, or while attending a school-sponsored or
121121 school-related activity on or off of school property:
122122 (A) engages in conduct punishable as a felony;
123123 (B) engages in conduct that contains the elements
124124 of the offense of assault under Section 22.01(a)(1), Penal Code;
125125 (C) sells, gives, or delivers to another person
126126 or possesses or uses or is under the influence of:
127127 (i) cannabis [marihuana] or a controlled
128128 substance, as defined by Chapter 481, Health and Safety Code, or by
129129 21 U.S.C. Section 801 et seq.; or
130130 (ii) a dangerous drug, as defined by
131131 Chapter 483, Health and Safety Code;
132132 (D) sells, gives, or delivers to another person
133133 an alcoholic beverage, as defined by Section 1.04, Alcoholic
134134 Beverage Code, commits a serious act or offense while under the
135135 influence of alcohol, or possesses, uses, or is under the influence
136136 of an alcoholic beverage;
137137 (E) engages in conduct that contains the elements
138138 of an offense relating to an abusable volatile chemical under
139139 Sections 485.031 through 485.034, Health and Safety Code; or
140140 (F) engages in conduct that contains the elements
141141 of the offense of public lewdness under Section 21.07, Penal Code,
142142 or indecent exposure under Section 21.08, Penal Code.
143143 SECTION 8. Section 37.007(b), Education Code, is amended to
144144 read as follows:
145145 (b) A student may be expelled if the student:
146146 (1) engages in conduct involving a public school that
147147 contains the elements of the offense of false alarm or report under
148148 Section 42.06, Penal Code, or terroristic threat under Section
149149 22.07, Penal Code;
150150 (2) while on or within 300 feet of school property, as
151151 measured from any point on the school's real property boundary
152152 line, or while attending a school-sponsored or school-related
153153 activity on or off of school property:
154154 (A) sells, gives, or delivers to another person
155155 or possesses, uses, or is under the influence of any amount of:
156156 (i) cannabis [marihuana] or a controlled
157157 substance, as defined by Chapter 481, Health and Safety Code, or by
158158 21 U.S.C. Section 801 et seq.;
159159 (ii) a dangerous drug, as defined by
160160 Chapter 483, Health and Safety Code; or
161161 (iii) an alcoholic beverage, as defined by
162162 Section 1.04, Alcoholic Beverage Code;
163163 (B) engages in conduct that contains the elements
164164 of an offense relating to an abusable volatile chemical under
165165 Sections 485.031 through 485.034, Health and Safety Code;
166166 (C) engages in conduct that contains the elements
167167 of an offense under Section 22.01(a)(1), Penal Code, against a
168168 school district employee or a volunteer as defined by Section
169169 22.053; or
170170 (D) engages in conduct that contains the elements
171171 of the offense of deadly conduct under Section 22.05, Penal Code;
172172 (3) subject to Subsection (d), while within 300 feet
173173 of school property, as measured from any point on the school's real
174174 property boundary line:
175175 (A) engages in conduct specified by Subsection
176176 (a); or
177177 (B) possesses a firearm, as defined by 18 U.S.C.
178178 Section 921;
179179 (4) engages in conduct that contains the elements of
180180 any offense listed in Subsection (a)(2)(A) or (C) or the offense of
181181 aggravated robbery under Section 29.03, Penal Code, against another
182182 student, without regard to whether the conduct occurs on or off of
183183 school property or while attending a school-sponsored or
184184 school-related activity on or off of school property; or
185185 (5) engages in conduct that contains the elements of
186186 the offense of breach of computer security under Section 33.02,
187187 Penal Code, if:
188188 (A) the conduct involves accessing a computer,
189189 computer network, or computer system owned by or operated on behalf
190190 of a school district; and
191191 (B) the student knowingly:
192192 (i) alters, damages, or deletes school
193193 district property or information; or
194194 (ii) commits a breach of any other
195195 computer, computer network, or computer system.
196196 SECTION 9. Section 37.015(a), Education Code, is amended to
197197 read as follows:
198198 (a) The principal of a public or private primary or
199199 secondary school, or a person designated by the principal under
200200 Subsection (d), shall notify any school district police department
201201 and the police department of the municipality in which the school is
202202 located or, if the school is not in a municipality, the sheriff of
203203 the county in which the school is located if the principal has
204204 reasonable grounds to believe that any of the following activities
205205 occur in school, on school property, or at a school-sponsored or
206206 school-related activity on or off school property, whether or not
207207 the activity is investigated by school security officers:
208208 (1) conduct that may constitute an offense listed
209209 under Section 508.149, Government Code;
210210 (2) deadly conduct under Section 22.05, Penal Code;
211211 (3) a terroristic threat under Section 22.07, Penal
212212 Code;
213213 (4) the use, sale, or possession of a controlled
214214 substance, drug paraphernalia, or cannabis [marihuana] under
215215 Chapter 481, Health and Safety Code;
216216 (5) the possession of any of the weapons or devices
217217 listed under Sections 46.01(1)-(14) or Section 46.01(16), Penal
218218 Code;
219219 (6) conduct that may constitute a criminal offense
220220 under Section 71.02, Penal Code; or
221221 (7) conduct that may constitute a criminal offense for
222222 which a student may be expelled under Section 37.007(a), (d), or
223223 (e).
224224 SECTION 10. Section 37.016, Education Code, is amended to
225225 read as follows:
226226 Sec. 37.016. REPORT OF DRUG OFFENSES; LIABILITY. A
227227 teacher, school administrator, or school employee is not liable in
228228 civil damages for reporting to a school administrator or
229229 governmental authority, in the exercise of professional judgment
230230 within the scope of the teacher's, administrator's, or employee's
231231 duties, a student whom the teacher suspects of using, passing, or
232232 selling, on school property:
233233 (1) cannabis [marihuana] or a controlled substance, as
234234 defined by Chapter 481, Health and Safety Code;
235235 (2) a dangerous drug, as defined by Chapter 483,
236236 Health and Safety Code;
237237 (3) an abusable glue or aerosol paint, as defined by
238238 Chapter 485, Health and Safety Code, or a volatile chemical, as
239239 listed in Chapter 484, Health and Safety Code, if the substance is
240240 used or sold for the purpose of inhaling its fumes or vapors; or
241241 (4) an alcoholic beverage, as defined by Section 1.04,
242242 Alcoholic Beverage Code.
243243 SECTION 11. Section 76.017(b), Government Code, is amended
244244 to read as follows:
245245 (b) The program must:
246246 (1) include automatic screening and evaluation of a
247247 person arrested for an offense, other than a Class C misdemeanor, in
248248 which an element of the offense is the use or possession of alcohol
249249 or the use, possession, or sale of a controlled substance or
250250 cannabis [marihuana];
251251 (2) include automatic screening and evaluation of a
252252 person arrested for an offense, other than a Class C misdemeanor, in
253253 which the use of alcohol or drugs is suspected to have significantly
254254 contributed to the offense for which the individual has been
255255 arrested;
256256 (3) coordinate the evaluation and referral to
257257 treatment services; and
258258 (4) make referrals for the appropriate treatment of a
259259 person determined to be in need of treatment, including referrals
260260 to a community corrections facility as defined by Section 509.001.
261261 SECTION 12. Section 123.002, Government Code, is amended to
262262 read as follows:
263263 Sec. 123.002. AUTHORITY TO ESTABLISH PROGRAM. The
264264 commissioners court of a county or governing body of a municipality
265265 may establish the following types of drug court programs:
266266 (1) drug courts for persons arrested for, charged
267267 with, or convicted of:
268268 (A) an offense in which an element of the offense
269269 is the use or possession of alcohol or the use, possession, or sale
270270 of a controlled substance, a controlled substance analogue, or
271271 cannabis [marihuana]; or
272272 (B) an offense in which the use of alcohol or a
273273 controlled substance is suspected to have significantly
274274 contributed to the commission of the offense and the offense did not
275275 involve:
276276 (i) carrying, possessing, or using a
277277 firearm or other dangerous weapon;
278278 (ii) the use of force against the person of
279279 another; or
280280 (iii) the death of or serious bodily injury
281281 to another;
282282 (2) drug courts for juveniles detained for, taken into
283283 custody for, or adjudicated as having engaged in:
284284 (A) delinquent conduct, including habitual
285285 felony conduct, or conduct indicating a need for supervision in
286286 which an element of the conduct is the use or possession of alcohol
287287 or the use, possession, or sale of a controlled substance, a
288288 controlled substance analogue, or cannabis [marihuana]; or
289289 (B) delinquent conduct, including habitual
290290 felony conduct, or conduct indicating a need for supervision in
291291 which the use of alcohol or a controlled substance is suspected to
292292 have significantly contributed to the commission of the conduct and
293293 the conduct did not involve:
294294 (i) carrying, possessing, or using a
295295 firearm or other dangerous weapon;
296296 (ii) the use of force against the person of
297297 another; or
298298 (iii) the death of or serious bodily injury
299299 to another;
300300 (3) reentry drug courts for persons with a
301301 demonstrated history of using alcohol or a controlled substance who
302302 may benefit from a program designed to facilitate the person's
303303 transition and reintegration into the community on release from a
304304 state or local correctional facility;
305305 (4) family dependency drug treatment courts for family
306306 members involved in a suit affecting the parent-child relationship
307307 in which a parent's use of alcohol or a controlled substance is a
308308 primary consideration in the outcome of the suit; or
309309 (5) programs for other persons not precisely described
310310 by Subdivisions (1)-(4) who may benefit from a program that has the
311311 essential characteristics described by Section 123.001.
312312 SECTION 13. Sections 481.002(17), (25), and (26), Health
313313 and Safety Code, are amended to read as follows:
314314 (17) "Drug paraphernalia" means equipment, a product,
315315 or material that is used or intended for use in planting,
316316 propagating, cultivating, growing, harvesting, manufacturing,
317317 compounding, converting, producing, processing, preparing,
318318 testing, analyzing, packaging, repackaging, storing, containing,
319319 or concealing a controlled substance in violation of this chapter
320320 or in injecting, ingesting, inhaling, or otherwise introducing into
321321 the human body a controlled substance in violation of this chapter.
322322 The term includes:
323323 (A) a kit used or intended for use in planting,
324324 propagating, cultivating, growing, or harvesting a species of plant
325325 that is a controlled substance or from which a controlled substance
326326 may be derived;
327327 (B) a material, compound, mixture, preparation,
328328 or kit used or intended for use in manufacturing, compounding,
329329 converting, producing, processing, or preparing a controlled
330330 substance;
331331 (C) an isomerization device used or intended for
332332 use in increasing the potency of a species of plant that is a
333333 controlled substance;
334334 (D) testing equipment used or intended for use in
335335 identifying or in analyzing the strength, effectiveness, or purity
336336 of a controlled substance;
337337 (E) a scale or balance used or intended for use in
338338 weighing or measuring a controlled substance;
339339 (F) a dilutant or adulterant, such as quinine
340340 hydrochloride, mannitol, inositol, nicotinamide, dextrose,
341341 lactose, or absorbent, blotter-type material, that is used or
342342 intended to be used to increase the amount or weight of or to
343343 transfer a controlled substance regardless of whether the dilutant
344344 or adulterant diminishes the efficacy of the controlled substance;
345345 (G) a separation gin or sifter used or intended
346346 for use in removing twigs and seeds from or in otherwise cleaning or
347347 refining cannabis [marihuana];
348348 (H) a blender, bowl, container, spoon, or mixing
349349 device used or intended for use in compounding a controlled
350350 substance;
351351 (I) a capsule, balloon, envelope, or other
352352 container used or intended for use in packaging small quantities of
353353 a controlled substance;
354354 (J) a container or other object used or intended
355355 for use in storing or concealing a controlled substance;
356356 (K) a hypodermic syringe, needle, or other object
357357 used or intended for use in parenterally injecting a controlled
358358 substance into the human body; and
359359 (L) an object used or intended for use in
360360 ingesting, inhaling, or otherwise introducing cannabis
361361 [marihuana], cocaine, hashish, or hashish oil into the human body,
362362 including:
363363 (i) a metal, wooden, acrylic, glass, stone,
364364 plastic, or ceramic pipe with or without a screen, permanent
365365 screen, hashish head, or punctured metal bowl;
366366 (ii) a water pipe;
367367 (iii) a carburetion tube or device;
368368 (iv) a smoking or carburetion mask;
369369 (v) a chamber pipe;
370370 (vi) a carburetor pipe;
371371 (vii) an electric pipe;
372372 (viii) an air-driven pipe;
373373 (ix) a chillum;
374374 (x) a bong; or
375375 (xi) an ice pipe or chiller.
376376 (25) "Manufacture" means the production, preparation,
377377 propagation, compounding, conversion, or processing of a
378378 controlled substance other than cannabis [marihuana], directly or
379379 indirectly by extraction from substances of natural origin,
380380 independently by means of chemical synthesis, or by a combination
381381 of extraction and chemical synthesis, and includes the packaging or
382382 repackaging of the substance or labeling or relabeling of its
383383 container. However, the term does not include the preparation,
384384 compounding, packaging, or labeling of a controlled substance:
385385 (A) by a practitioner as an incident to the
386386 practitioner's administering or dispensing a controlled substance
387387 in the course of professional practice; or
388388 (B) by a practitioner, or by an authorized agent
389389 under the supervision of the practitioner, for or as an incident to
390390 research, teaching, or chemical analysis and not for delivery.
391391 (26) "Cannabis" ["Marihuana"] means the plant
392392 Cannabis sativa L., whether growing or not, the seeds of that plant,
393393 and every compound, manufacture, salt, derivative, mixture, or
394394 preparation of that plant or its seeds. The term does not include:
395395 (A) the resin extracted from a part of the plant
396396 or a compound, manufacture, salt, derivative, mixture, or
397397 preparation of the resin;
398398 (B) the mature stalks of the plant or fiber
399399 produced from the stalks;
400400 (C) oil or cake made from the seeds of the plant;
401401 (D) a compound, manufacture, salt, derivative,
402402 mixture, or preparation of the mature stalks, fiber, oil, or cake;
403403 or
404404 (E) the sterilized seeds of the plant that are
405405 incapable of beginning germination.
406406 SECTION 14. Section 481.103(a), Health and Safety Code, is
407407 amended to read as follows:
408408 (a) Penalty Group 2 consists of:
409409 (1) any quantity of the following hallucinogenic
410410 substances, their salts, isomers, and salts of isomers, unless
411411 specifically excepted, if the existence of these salts, isomers,
412412 and salts of isomers is possible within the specific chemical
413413 designation:
414414 5-(2-aminopropyl)benzofuran (5-APB);
415415 6-(2-aminopropyl)benzofuran (6-APB);
416416 5-(2-aminopropyl)-2,3-dihydrobenzofuran
417417 (5-APDB);
418418 6-(2-aminopropyl)-2,3-dihydrobenzofuran
419419 (6-APDB);
420420 5-(2-aminopropyl)indole (5-IT,5-API);
421421 6-(2-aminopropyl)indole (6-IT,6-API);

730730 SECTION 16. Section 481.111(e), Health and Safety Code, is

732732 (e) Sections 481.120, 481.121, 481.122, and 481.125 do not
733733 apply to a person who engages in the acquisition, possession,
734734 production, cultivation, delivery, or disposal of a raw material
735735 used in or by-product created by the production or cultivation of
736736 low-THC cannabis if the person:
737737 (1) for an offense involving possession only of
738738 cannabis [marihuana] or drug paraphernalia, is a patient for whom
739739 low-THC cannabis is prescribed under Chapter 169, Occupations Code,
740740 or the patient's legal guardian, and the person possesses low-THC
741741 cannabis obtained under a valid prescription from a dispensing
742742 organization; or
743743 (2) is a director, manager, or employee of a
744744 dispensing organization and the person, solely in performing the
745745 person's regular duties at the organization, acquires, possesses,
746746 produces, cultivates, dispenses, or disposes of:
747747 (A) in reasonable quantities, any low-THC
748748 cannabis or raw materials used in or by-products created by the
749749 production or cultivation of low-THC cannabis; or
750750 (B) any drug paraphernalia used in the
751751 acquisition, possession, production, cultivation, delivery, or
752752 disposal of low-THC cannabis.
753753 SECTION 17. Section 481.120, Health and Safety Code, is
754754 amended to read as follows:
755755 Sec. 481.120. OFFENSE: DELIVERY OF CANNABIS [MARIHUANA].
756756 (a) Except as authorized by this chapter, a person commits an
757757 offense if the person knowingly or intentionally delivers cannabis
758758 [marihuana].
759759 (b) An offense under Subsection (a) is:
760760 (1) a Class B misdemeanor if the amount of cannabis
761761 [marihuana] delivered is one-fourth ounce or less and the person
762762 committing the offense does not receive remuneration for the
763763 cannabis [marihuana];
764764 (2) a Class A misdemeanor if the amount of cannabis
765765 [marihuana] delivered is one-fourth ounce or less and the person
766766 committing the offense receives remuneration for the cannabis
767767 [marihuana];
768768 (3) a state jail felony if the amount of cannabis
769769 [marihuana] delivered is five pounds or less but more than
770770 one-fourth ounce;
771771 (4) a felony of the second degree if the amount of
772772 cannabis [marihuana] delivered is 50 pounds or less but more than
773773 five pounds;
774774 (5) a felony of the first degree if the amount of
775775 cannabis [marihuana] delivered is 2,000 pounds or less but more
776776 than 50 pounds; and
777777 (6) punishable by imprisonment in the Texas Department
778778 of Criminal Justice for life or for a term of not more than 99 years
779779 or less than 10 years, and a fine not to exceed $100,000, if the
780780 amount of cannabis [marihuana] delivered is more than 2,000 pounds.
781781 SECTION 18. Section 481.121, Health and Safety Code, is
782782 amended to read as follows:
783783 Sec. 481.121. OFFENSE: POSSESSION OF CANNABIS [MARIHUANA].
784784 (a) Except as authorized by this chapter, a person commits an
785785 offense if the person knowingly or intentionally possesses a usable
786786 quantity of cannabis [marihuana].
787787 (b) An offense under Subsection (a) is:
788788 (1) a Class B misdemeanor if the amount of cannabis
789789 [marihuana] possessed is two ounces or less;
790790 (2) a Class A misdemeanor if the amount of cannabis
791791 [marihuana] possessed is four ounces or less but more than two
792792 ounces;
793793 (3) a state jail felony if the amount of cannabis
794794 [marihuana] possessed is five pounds or less but more than four
795795 ounces;
796796 (4) a felony of the third degree if the amount of
797797 cannabis [marihuana] possessed is 50 pounds or less but more than 5
798798 pounds;
799799 (5) a felony of the second degree if the amount of
800800 cannabis [marihuana] possessed is 2,000 pounds or less but more
801801 than 50 pounds; and
802802 (6) punishable by imprisonment in the Texas Department
803803 of Criminal Justice for life or for a term of not more than 99 years
804804 or less than 5 years, and a fine not to exceed $50,000, if the amount
805805 of cannabis [marihuana] possessed is more than 2,000 pounds.
806806 SECTION 19. The heading to Section 481.122, Health and
807807 Safety Code, is amended to read as follows:
808808 Sec. 481.122. OFFENSE: DELIVERY OF CONTROLLED SUBSTANCE OR
809809 CANNABIS [MARIHUANA] TO CHILD.
810810 SECTION 20. Sections 481.122(a) and (b), Health and Safety
811811 Code, are amended to read as follows:
812812 (a) A person commits an offense if the person knowingly
813813 delivers a controlled substance listed in Penalty Group 1, 1-A, 2,
814814 or 3 or knowingly delivers cannabis [marihuana] and the person
815815 delivers the controlled substance or cannabis [marihuana] to a
816816 person:
817817 (1) who is a child;
818818 (2) who is enrolled in a public or private primary or
819819 secondary school; or
820820 (3) who the actor knows or believes intends to deliver
821821 the controlled substance or cannabis [marihuana] to a person
822822 described by Subdivision (1) or (2).
823823 (b) It is an affirmative defense to prosecution under this
824824 section that:
825825 (1) the actor was a child when the offense was
826826 committed; or
827827 (2) the actor:
828828 (A) was younger than 21 years of age when the
829829 offense was committed;
830830 (B) delivered only cannabis [marihuana] in an
831831 amount equal to or less than one-fourth ounce; and
832832 (C) did not receive remuneration for the
833833 delivery.
834834 SECTION 21. Section 481.133(c), Health and Safety Code, is
835835 amended to read as follows:
836836 (c) In this section, "drug test" means a lawfully
837837 administered test designed to detect the presence of a controlled
838838 substance or cannabis [marihuana].
839839 SECTION 22. Section 31.0031(d), Human Resources Code, is
840840 amended to read as follows:
841841 (d) The responsibility agreement shall require that:
842842 (1) the parent of a dependent child cooperate with the
843843 commission and the Title IV-D agency if necessary to establish the
844844 paternity of the dependent child and to establish or enforce child
845845 support;
846846 (2) if adequate and accessible providers of the
847847 services are available in the geographic area and subject to the
848848 availability of funds, each dependent child, as appropriate,
849849 complete early and periodic screening, diagnosis, and treatment
850850 checkups on schedule and receive the immunization series prescribed
851851 by Section 161.004, Health and Safety Code, unless the child is
852852 exempt under that section;
853853 (3) each adult recipient, or teen parent recipient who
854854 has completed the requirements regarding school attendance in
855855 Subdivision (6), not voluntarily terminate paid employment of at
856856 least 30 hours each week without good cause in accordance with rules
857857 adopted by the executive commissioner;
858858 (4) each adult recipient for whom a needs assessment
859859 is conducted participate in an activity to enable that person to
860860 become self-sufficient by:
861861 (A) continuing the person's education or
862862 becoming literate;
863863 (B) entering a job placement or employment skills
864864 training program;
865865 (C) serving as a volunteer in the person's
866866 community; or
867867 (D) serving in a community work program or other
868868 work program approved by the commission;
869869 (5) each caretaker relative or parent receiving
870870 assistance not use, sell, or possess cannabis [marihuana] or a
871871 controlled substance in violation of Chapter 481, Health and Safety
872872 Code, or abuse alcohol;
873873 (6) each dependent child younger than 18 years of age
874874 or teen parent younger than 19 years of age attend school regularly,
875875 unless the child has a high school diploma or high school
876876 equivalency certificate or is specifically exempted from school
877877 attendance under Section 25.086, Education Code;
878878 (7) each recipient comply with commission rules
879879 regarding proof of school attendance; and
880880 (8) each recipient attend appropriate parenting
881881 skills training classes, as determined by the needs assessment.
882882 SECTION 23. Section 1355.006, Insurance Code, is amended to
883883 read as follows:
884884 Sec. 1355.006. COVERAGE FOR CERTAIN CONDITIONS RELATED TO
885885 CONTROLLED SUBSTANCE OR CANNABIS [MARIHUANA] NOT REQUIRED. (a) In
886886 this section, "cannabis" and "controlled substance" [and
887887 "marihuana"] have the meanings assigned by Section 481.002, Health
888888 and Safety Code.
889889 (b) This subchapter does not require a group health benefit
890890 plan to provide coverage for the treatment of:
891891 (1) addiction to a controlled substance or cannabis
892892 [marihuana] that is used in violation of law; or
893893 (2) mental illness that results from the use of a
894894 controlled substance or cannabis [marihuana] in violation of law.
895895 SECTION 24. This Act takes effect September 1, 2019.
