8 | 8 | emission system of a diesel-powered motor vehicle to emit soot, | |

10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 547.605(c), Transportation Code, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | (c) The owner or operator of a motor vehicle or motor | |
14 | 14 | vehicle engine, of a model year after 1967, that is equipped with an | |
15 | 15 | exhaust emission system: | |
16 | 16 | (1) shall maintain the system in good working | |
17 | 17 | condition; | |
18 | 18 | (2) shall use the system when the motor vehicle or | |
19 | 19 | motor vehicle engine is operated; [and] | |
20 | 20 | (3) may not remove the system or a part of the system | |
21 | 21 | or intentionally make the system inoperable in this state, unless | |
22 | 22 | the owner or operator removes the system or part to install another | |
23 | 23 | system or part intended to be equally effective in reducing | |
24 | 24 | atmospheric emissions; and | |
25 | 25 | (4) if the motor vehicle is diesel-powered, may not | |
26 | 26 | modify or reprogram the system or a part of the system in a manner | |
27 | 27 | that the owner or operator knows or should know will increase the | |
28 | 28 | motor vehicle's capacity to emit soot, smoke, or other particulate | |
29 | 29 | matter. | |
30 | 30 | SECTION 2. This Act takes effect September 1, 2019. |
