55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the modification or reprogramming of the exhaust
88 emission system of a diesel-powered motor vehicle to emit soot,
99 smoke, or other particulate matter.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 547.605(c), Transportation Code, is
1212 amended to read as follows:
1313 (c) The owner or operator of a motor vehicle or motor
1414 vehicle engine, of a model year after 1967, that is equipped with an
1515 exhaust emission system:
1616 (1) shall maintain the system in good working
1717 condition;
1818 (2) shall use the system when the motor vehicle or
1919 motor vehicle engine is operated; [and]
2020 (3) may not remove the system or a part of the system
2121 or intentionally make the system inoperable in this state, unless
2222 the owner or operator removes the system or part to install another
2323 system or part intended to be equally effective in reducing
2424 atmospheric emissions; and
2525 (4) if the motor vehicle is diesel-powered, may not
2626 modify or reprogram the system or a part of the system in a manner
2727 that the owner or operator knows or should know will increase the
2828 motor vehicle's capacity to emit soot, smoke, or other particulate
2929 matter.
3030 SECTION 2. This Act takes effect September 1, 2019.
