6 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

7 | 15 | | SECTION 1. Section 2306.67022, Government Code, is amended |
---|
8 | 16 | | to read as follows: |
---|
9 | 17 | | Sec. 2306.67022. QUALIFIED ALLOCATION PLAN; MANUAL. (a) |
---|
10 | 18 | | At least biennially, the board shall adopt a qualified allocation |
---|
11 | 19 | | plan and a corresponding manual to provide information regarding |
---|
12 | 20 | | the administration of and eligibility for the low income housing |
---|
13 | 21 | | tax credit program. The board may adopt the plan and manual |
---|
14 | 22 | | annually, as considered appropriate by the board. |
---|
15 | 23 | | (b) The department may require as part of the threshold |
---|
16 | 24 | | criteria under a qualified allocation plan that a proposed |
---|
17 | 25 | | development satisfy certain criteria relating to educational |
---|
18 | 26 | | quality, as specified by the department in that plan. |
---|
19 | 27 | | (c) The department may not adopt a qualified allocation plan |
---|
20 | 28 | | that uses a scoring system that awards points to an application |
---|
21 | 29 | | based on criteria relating to the educational quality applicable to |
---|
22 | 30 | | a proposed development site. |
---|
23 | 31 | | (d) This subsection and Subsections (b) and (c) expire |
---|
24 | 32 | | September 1, 2021. |
---|
25 | 33 | | SECTION 2. (a) The Texas Department of Housing and |
---|
26 | 34 | | Community Affairs shall conduct a study of the effects that the |
---|
27 | 35 | | implementation of Sections 2306.67022(b) and (c), Government Code, |
---|
28 | 36 | | as added by this Act, has on the allocation of low income housing |
---|
29 | 37 | | tax credits in this state. |
---|
30 | 38 | | (b) Not later than January 1, 2021, the Texas Department of |
---|
31 | 39 | | Housing and Community Affairs shall submit to the governor, the |
---|
32 | 40 | | lieutenant governor, the speaker of the house of representatives, |
---|
33 | 41 | | and each standing committee of the legislature with jurisdiction |
---|
34 | 42 | | over affordable housing a report regarding the study required by |
---|
35 | 43 | | Subsection (a) of this section. |
---|
36 | 44 | | SECTION 3. The change in law made by this Act applies only |
---|
37 | 45 | | to an application for low income housing tax credits that is |
---|
38 | 46 | | submitted to the Texas Department of Housing and Community Affairs |
---|
39 | 47 | | during an application cycle that is based on the 2020 qualified |
---|
40 | 48 | | allocation plan or a subsequent plan adopted by the governing board |
---|
41 | 49 | | of the department under Section 2306.67022, Government Code, as |
---|
42 | 50 | | amended by this Act. An application that is submitted during an |
---|
43 | 51 | | application cycle that is based on an earlier qualified allocation |
---|
44 | 52 | | plan is governed by the law in effect on the date the application |
---|
45 | 53 | | cycle began, and the former law is continued in effect for that |
---|
46 | 54 | | purpose. |
---|
47 | 55 | | SECTION 4. This Act takes effect September 1, 2019. |
