412 AN ACT
513 relating to the allocation of low income housing tax credits.
614 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
715 SECTION 1. Section 2306.67022, Government Code, is amended
816 to read as follows:
917 Sec. 2306.67022. QUALIFIED ALLOCATION PLAN; MANUAL. (a)
1018 At least biennially, the board shall adopt a qualified allocation
1119 plan and a corresponding manual to provide information regarding
1220 the administration of and eligibility for the low income housing
1321 tax credit program. The board may adopt the plan and manual
1422 annually, as considered appropriate by the board.
1523 (b) The department may require as part of the threshold
1624 criteria under a qualified allocation plan that a proposed
1725 development satisfy certain criteria relating to educational
1826 quality, as specified by the department in that plan.
1927 (c) The department may not adopt a qualified allocation plan
2028 that uses a scoring system that awards points to an application
2129 based on criteria relating to the educational quality applicable to
2230 a proposed development site.
2331 (d) This subsection and Subsections (b) and (c) expire
2432 September 1, 2021.
2533 SECTION 2. (a) The Texas Department of Housing and
2634 Community Affairs shall conduct a study of the effects that the
2735 implementation of Sections 2306.67022(b) and (c), Government Code,
2836 as added by this Act, has on the allocation of low income housing
2937 tax credits in this state.
3038 (b) Not later than January 1, 2021, the Texas Department of
3139 Housing and Community Affairs shall submit to the governor, the
3240 lieutenant governor, the speaker of the house of representatives,
3341 and each standing committee of the legislature with jurisdiction
3442 over affordable housing a report regarding the study required by
3543 Subsection (a) of this section.
3644 SECTION 3. The change in law made by this Act applies only
3745 to an application for low income housing tax credits that is
3846 submitted to the Texas Department of Housing and Community Affairs
3947 during an application cycle that is based on the 2020 qualified
4048 allocation plan or a subsequent plan adopted by the governing board
4149 of the department under Section 2306.67022, Government Code, as
4250 amended by this Act. An application that is submitted during an
4351 application cycle that is based on an earlier qualified allocation
4452 plan is governed by the law in effect on the date the application
4553 cycle began, and the former law is continued in effect for that
4654 purpose.
4755 SECTION 4. This Act takes effect September 1, 2019.
