| 7 | 7 | | relating to the annual salaries of the chief justice or the |

| 8 | 8 | | presiding judge of an appellate court. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 659.012(a), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (a) Notwithstanding Section 659.011: |
|---|
| 13 | 13 | | (1) a judge of a district court is entitled to an |
|---|
| 14 | 14 | | annual salary from the state of at least $125,000, except that the |
|---|
| 15 | 15 | | combined salary of a district judge from state and county sources, |
|---|
| 16 | 16 | | including compensation for any extrajudicial services performed on |
|---|
| 17 | 17 | | behalf of the county, may not exceed the amount that is $5,000 less |
|---|
| 18 | 18 | | than the salary provided for a justice of a court of appeals other |
|---|
| 19 | 19 | | than a chief justice; |
|---|
| 20 | 20 | | (2) a justice of a court of appeals other than the |
|---|
| 21 | 21 | | chief justice is entitled to an annual salary from the state that is |
|---|
| 22 | 22 | | equal to 110 percent of the salary of a district judge, except that |
|---|
| 23 | 23 | | the combined salary of a justice of the court of appeals other than |
|---|
| 24 | 24 | | the chief justice from all state and county sources, including |
|---|
| 25 | 25 | | compensation for any extrajudicial services performed on behalf of |
|---|
| 26 | 26 | | the county, may not exceed the amount that is $5,000 less than the |
|---|
| 27 | 27 | | salary provided for a justice of the supreme court; |
|---|
| 28 | 28 | | (3) a justice of the supreme court other than the chief |
|---|
| 29 | 29 | | justice or a judge of the court of criminal appeals other than the |
|---|
| 30 | 30 | | presiding judge is entitled to an annual salary from the state that |
|---|
| 31 | 31 | | is equal to 120 percent of the salary of a district judge; [and] |
|---|
| 32 | 32 | | (4) the chief justice [or presiding judge] of a court |
|---|
| 33 | 33 | | of appeals [an appellate court] is entitled to an annual salary from |
|---|
| 34 | 34 | | the state that is $5,000 [$2,500] more than the salary provided for |
|---|
| 35 | 35 | | the other justices or judges of the court, except that the combined |
|---|
| 36 | 36 | | salary of the chief justice of a court of appeals may not exceed the |
|---|
| 37 | 37 | | [amount that is $2,500 less than the] salary provided for a justice |
|---|
| 38 | 38 | | of the supreme court; and |
|---|
| 39 | 39 | | (5) the chief justice of the supreme court or the |
|---|
| 40 | 40 | | presiding judge of the court of criminal appeals is entitled to an |
|---|
| 41 | 41 | | annual salary from the state that is $10,000 more than the salary |
|---|
| 42 | 42 | | provided for the other justices or judges of the court. |

| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2019. |
