118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 SECTION 1. Section 545.157(a), Transportation Code, is
1310 amended to read as follows:
1411 (a) This section applies only to the following vehicles:
1512 (1) a stationary authorized emergency vehicle using
1613 visual signals that meet the requirements of Sections 547.305 and
1714 547.702;
1815 (2) a stationary tow truck using equipment authorized
19- by Section 547.305(d); [and]
16+ by Section 547.305(d); and
2017 (3) a Texas Department of Transportation vehicle or a
2118 highway maintenance vehicle operated pursuant to a contract awarded
2219 under Subchapter A, Chapter 223, not separated from the roadway by a
2320 traffic control channelizing device and using visual signals that
2421 comply with the standards and specifications adopted under Section
25- 547.105; and
26- (4) a service vehicle used in the maintenance of an
27- electrical power line and using visual signals that comply with the
28- standards and specifications adopted under Section 547.105.

2923 SECTION 2. Section 547.001(2-b), Transportation Code, is
3024 amended to read as follows:
3125 (2-b) "Highway maintenance vehicle" means a highway or
3226 traffic maintenance vehicle designated by the Texas Department of
3327 Transportation. The term includes equipment for:
3428 (A) road maintenance, including:
3529 (i) equipment for snow removal, line
36- striping, skid resistance testing, sweeping, [and] spraying,
37- guardrail repair, sign maintenance, and temporary traffic-control
38- device placement or removal;
30+ striping, skid resistance testing, sweeping, [and] spraying, guard
31+ rail repair, sign maintenance, and temporary traffic control device
32+ placement or removal;
3933 (ii) aerial platform lift machines; and
4034 (iii) road profiler machines; and
4135 (B) off-road use, including motor graders, road
4236 rollers, excavators, pneumatic tire equipment, movers, and
4337 tractors.
4438 SECTION 3. This Act takes effect September 1, 2019.
