8	6		AN ACT
9	7		relating to the establishment and duties of the human trafficking
10	8		prevention coordinating council.
11	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	10		SECTION 1. Subchapter B, Chapter 402, Government Code, is
13	11		amended by adding Section 402.034 to read as follows:
14	12		Sec. 402.034. HUMAN TRAFFICKING PREVENTION COORDINATING
15	13		COUNCIL. (a) In this section, "council" means the human
16	14		trafficking prevention coordinating council.
17	15		(b) The office of the attorney general shall establish the
18	16		human trafficking prevention coordinating council to develop and
19	17		implement a five-year strategic plan for preventing human
20	18		trafficking in this state.
21	19		(c) The council is composed of the following:
22	20		(1) the governor or the governor's designee;
23	21		(2) the attorney general or the attorney general's
24	22		designee;
25	23		(3) the commissioner of the Department of Family and
26	24		Protective Services or the commissioner's designee;
27	25		(4) the public safety director of the Department of
28		-	Public Safety or the director's designee;
	26	+	Public Safety or the director's designee; and
29	27		(5) one representative from each of the following
30	28		state agencies, appointed by the chief administrative officer of
31	29		the respective agency:
32	30		(A) the Texas Workforce Commission;
33	31		(B) the Texas Alcoholic Beverage Commission;
34	32		(C) the Parks and Wildlife Department; and
35	33		(D) the Texas Department of Licensing and
36		-	Regulation; and
37		-	(6) one representative of any other state agency
38		-	appointed by the chief administrative officer of the agency, if the
39		-	human trafficking prevention task force established under Section
40		-	402.035 and the council determine that a representative from the
41		-	state agency is a necessary member of the council.

42	35		(d) The presiding officer of the council is the attorney
43	36		general or the attorney general's designee.
44	37		(e) For each five-year period, the council shall:
45	38		(1) develop and implement a strategic plan for
46	39		preventing human trafficking in this state; and
47	40		(2) submit the strategic plan to the legislature.
48	41		(f) The strategic plan must include:
49	42		(1) an inventory of human trafficking prevention
50	43		programs and services in this state that are administered by state
51	44		agencies, including institutions of higher education, and
52	45		political subdivisions;
53	46		(2) regarding the programs and services described by
54	47		Subdivision (1):
55	48		(A) a report on the number of persons served by
56	49		the programs and services; and
57	50		(B) a plan to coordinate the programs and
58	51		services to achieve the following goals:
59	52		(i) eliminate redundancy;
60	53		(ii) ensure the agencies' use of best
61	54		practices in preventing human trafficking; and
62	55		(iii) identify and collect data regarding
63	56		the efficacy of the programs and services; and
64	57		(3) in relation to the goals for programs and services
65	58		as described by Subdivision (2)(B), a plan to coordinate the
66	59		expenditure of state funds allocated to prevent human trafficking
67		-	in this state, including the expenditure of state funds by the ~~human~~
68		-	~~trafficking prevention task~~ force established under Section
69		-	~~402~~.~~035.~~
	60	+	in this state, including the expenditure of state funds by the task
	61	+	force established under Section 402.035 or by a successor entity
	62	+	established by the office of the attorney general.
70	63		(g) Not later than December 1 of each year, beginning with
71	64		the year following the year the council submits a strategic plan to
72	65		the legislature under Subsection (e)(2), the council shall submit
73	66		to the legislature an annual report detailing the progress of the
74	67		strategic plan's implementation. The annual report must include:
75	68		(1) a description of the level of participation in the
76	69		strategic plan by each agency represented on the council and how the
77	70		implementation of the strategic plan serves to coordinate the
78	71		programs and services described by Subsection (f)(1) and achieve
79	72		the goals described by Subsection (f)(2)(B); and
80	73		(2) an update of the inventory of programs and
81	74		services described by Subsection (f)(1) and how each program or
82	75		service furthers the goals of the strategic plan.
83	76		(h) The office of the attorney general shall make available
84	77		on the office's Internet website the strategic plan and the annual
85	78		reports required under Subsection (g).
86	79		SECTION 2. Not later than May 1, 2020, the human trafficking
87	80		prevention coordinating council shall submit to the legislature the
88	81		five-year strategic plan required by Section 402.034(e),
89	82		Government Code, as added by this Act.
90	83		SECTION 3. This Act takes effect September 1, 2019.
