97 relating to the establishment and duties of the human trafficking
108 prevention coordinating council.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Subchapter B, Chapter 402, Government Code, is
1311 amended by adding Section 402.034 to read as follows:
1412 Sec. 402.034. HUMAN TRAFFICKING PREVENTION COORDINATING
1513 COUNCIL. (a) In this section, "council" means the human
1614 trafficking prevention coordinating council.
1715 (b) The office of the attorney general shall establish the
1816 human trafficking prevention coordinating council to develop and
1917 implement a five-year strategic plan for preventing human
2018 trafficking in this state.
2119 (c) The council is composed of the following:
2220 (1) the governor or the governor's designee;
2321 (2) the attorney general or the attorney general's
2422 designee;
2523 (3) the commissioner of the Department of Family and
2624 Protective Services or the commissioner's designee;
2725 (4) the public safety director of the Department of
28- Public Safety or the director's designee;
26+ Public Safety or the director's designee; and
2927 (5) one representative from each of the following
3028 state agencies, appointed by the chief administrative officer of
3129 the respective agency:
3230 (A) the Texas Workforce Commission;
3331 (B) the Texas Alcoholic Beverage Commission;
3432 (C) the Parks and Wildlife Department; and
3533 (D) the Texas Department of Licensing and
36- Regulation; and
37- (6) one representative of any other state agency
38- appointed by the chief administrative officer of the agency, if the
39- human trafficking prevention task force established under Section
40- 402.035 and the council determine that a representative from the
41- state agency is a necessary member of the council.

4235 (d) The presiding officer of the council is the attorney
4336 general or the attorney general's designee.
4437 (e) For each five-year period, the council shall:
4538 (1) develop and implement a strategic plan for
4639 preventing human trafficking in this state; and
4740 (2) submit the strategic plan to the legislature.
4841 (f) The strategic plan must include:
4942 (1) an inventory of human trafficking prevention
5043 programs and services in this state that are administered by state
5144 agencies, including institutions of higher education, and
5245 political subdivisions;
5346 (2) regarding the programs and services described by
5447 Subdivision (1):
5548 (A) a report on the number of persons served by
5649 the programs and services; and
5750 (B) a plan to coordinate the programs and
5851 services to achieve the following goals:
5952 (i) eliminate redundancy;
6053 (ii) ensure the agencies' use of best
6154 practices in preventing human trafficking; and
6255 (iii) identify and collect data regarding
6356 the efficacy of the programs and services; and
6457 (3) in relation to the goals for programs and services
6558 as described by Subdivision (2)(B), a plan to coordinate the
6659 expenditure of state funds allocated to prevent human trafficking
67- in this state, including the expenditure of state funds by the human
68- trafficking prevention task force established under Section
69- 402.035.
60+ in this state, including the expenditure of state funds by the task
61+ force established under Section 402.035 or by a successor entity
62+ established by the office of the attorney general.
7063 (g) Not later than December 1 of each year, beginning with
7164 the year following the year the council submits a strategic plan to
7265 the legislature under Subsection (e)(2), the council shall submit
7366 to the legislature an annual report detailing the progress of the
7467 strategic plan's implementation. The annual report must include:
7568 (1) a description of the level of participation in the
7669 strategic plan by each agency represented on the council and how the
7770 implementation of the strategic plan serves to coordinate the
7871 programs and services described by Subsection (f)(1) and achieve
7972 the goals described by Subsection (f)(2)(B); and
8073 (2) an update of the inventory of programs and
8174 services described by Subsection (f)(1) and how each program or
8275 service furthers the goals of the strategic plan.
8376 (h) The office of the attorney general shall make available
8477 on the office's Internet website the strategic plan and the annual
8578 reports required under Subsection (g).
8679 SECTION 2. Not later than May 1, 2020, the human trafficking
8780 prevention coordinating council shall submit to the legislature the
8881 five-year strategic plan required by Section 402.034(e),
8982 Government Code, as added by this Act.
9083 SECTION 3. This Act takes effect September 1, 2019.
