55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for the criminal offense of theft.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 31.03(e), Penal Code, is amended to read
1010 as follows:
1111 (e) Except as provided by Subsection (f), an offense under
1212 this section is:
1313 (1) a Class C misdemeanor if the value of the property
1414 stolen is less than $100;
1515 (2) a Class B misdemeanor if:
1616 (A) the value of the property stolen is $100 or
1717 more but less than $750;
1818 (B) the value of the property stolen is less than
1919 $100 and the defendant has, in the five-year period preceding the
2020 date of commission of the instant offense, previously been
2121 convicted two or more times of any grade of theft; or
2222 (C) the property stolen is a driver's license,
2323 commercial driver's license, or personal identification
2424 certificate issued by this state or another state;
2525 (3) a Class A misdemeanor if:
2626 (A) the value of the property stolen is $750 or
2727 more but less than $2,500; or
2828 (B) the value of the property stolen is $100 or
2929 more but less than $750 and the defendant has, in the five-year
3030 period preceding the date of commission of the instant offense,
3131 previously been convicted two or more times of any grade of theft;
3232 (4) a state jail felony if:
3333 (A) the value of the property stolen is $2,500 or
3434 more but less than $30,000, or the property is less than 10 head of
3535 sheep, swine, or goats or any part thereof under the value of
3636 $30,000;
3737 (B) regardless of value, the property is stolen
3838 from the person of another or from a human corpse or grave,
3939 including property that is a military grave marker;
4040 (C) the property stolen is a firearm, as defined
4141 by Section 46.01;
4242 (D) the value of the property stolen is $750 or
4343 more but less than $2,500 and, regardless of the period within which
4444 the convictions occurred, the defendant has been previously
4545 convicted two or more times of any grade of theft;
4646 (E) the property stolen is an official ballot or
4747 official carrier envelope for an election; or
4848 (F) the value of the property stolen is less than
4949 $20,000 and the property stolen is:
5050 (i) aluminum;
5151 (ii) bronze;
5252 (iii) copper; or
5353 (iv) brass;
5454 (5) a felony of the third degree if the value of the
5555 property stolen is $30,000 or more but less than $150,000, or the
5656 property is:
5757 (A) cattle, horses, or exotic livestock or exotic
5858 fowl as defined by Section 142.001, Agriculture Code, stolen during
5959 a single transaction and having an aggregate value of less than
6060 $150,000;
6161 (B) 10 or more head of sheep, swine, or goats
6262 stolen during a single transaction and having an aggregate value of
6363 less than $150,000; or
6464 (C) a controlled substance, having a value of
6565 less than $150,000, if stolen from:
6666 (i) a commercial building in which a
6767 controlled substance is generally stored, including a pharmacy,
6868 clinic, hospital, nursing facility, or warehouse; or
6969 (ii) a vehicle owned or operated by a
7070 wholesale distributor of prescription drugs;
7171 (6) a felony of the second degree if:
7272 (A) the value of the property stolen is $150,000
7373 or more but less than $300,000; or
7474 (B) the value of the property stolen is less than
7575 $300,000 and the property stolen is an automated teller machine or
7676 the contents or components of an automated teller machine; or
7777 (7) a felony of the first degree if the value of the
7878 property stolen is $300,000 or more.
7979 SECTION 2. The change in law made by this Act applies only
8080 to an offense committed on or after the effective date of this Act.
8181 An offense committed before the effective date of this Act is
8282 governed by the law in effect on the date the offense was committed,
8383 and the former law is continued in effect for that purpose. For
8484 purposes of this section, an offense was committed before the
8585 effective date of this Act if any element of the offense occurred
8686 before that date.
8787 SECTION 3. This Act takes effect September 1, 2019.
