4	10		AN ACT
5	11		relating to the online publication of home addresses of certain
6	12		occupational license holders.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Subchapter B, Chapter 403, Occupations Code, is
9	15		amended by adding Section 403.053 to read as follows:
10	16		Sec. 403.053. PUBLISHING LICENSE HOLDER HOME ADDRESS
11	17		PROHIBITED. (a) The department may not include the home address of
12	18		a person licensed under this chapter in a roster, registry, or other
13	19		database the department publishes on the department's Internet
14	20		website unless the person requests that the person's home address
15	21		appear in the roster, registry, or other database on the website. A
16	22		request under this subsection must be made in the manner prescribed
17	23		by the department.
18	24		(b) The home address of a person licensed under this chapter
19	25		that is included in a roster, registry, or other database the
20	26		department maintains is public information and is not excepted from
21	27		required disclosure under Chapter 552, Government Code.
22	28		SECTION 2. Section 503.207, Occupations Code, is amended by
23	29		adding Subsections (c) and (d) to read as follows:
24	30		(c) The board may not include the home address of a person
25	31		licensed under this chapter in a registry the board publishes on the
26	32		board's Internet website unless the person requests that the
27	33		person's home address appear in the registry on the website. A
28	34		request under this subsection must be made in the manner prescribed
29	35		by the board.
30	36		(d) The home address of a person licensed under this chapter
31	37		that is included in the registry the board prepares under this
32	38		section is public information and is not excepted from required
33	39		disclosure under Chapter 552, Government Code.
34	40		SECTION 3. Section 504.055, Occupations Code, is amended by
35	41		adding Subsections (e) and (f) to read as follows:
36	42		(e) The department may not include the home address of a
37	43		person licensed by the department in a roster the department
38	44		publishes on the department's Internet website unless the person
39	45		requests that the person's home address appear in the roster on the
40	46		website. A request under this subsection must be made in the manner
41	47		prescribed by the department.
42	48		(f) The home address of a person licensed under this chapter
43	49		that is included in a roster the department prepares under this
44	50		section is public information and is not excepted from required
45	51		disclosure under Chapter 552, Government Code.
46	52		SECTION 4. Section 505.205, Occupations Code, is amended by
47	53		adding Subsections (d) and (e) to read as follows:
48	54		(d) The board may not include the home address of a person
49	55		licensed under this chapter in a roster the board publishes on the
50	56		board's Internet website unless the person requests that the
51	57		person's home address appear in the roster on the website. A
52	58		request under this subsection must be made in the manner prescribed
53	59		by the board.
54	60		(e) The home address of a person licensed under this chapter
55	61		that is included in the roster the board prepares under this section
56	62		is public information and is not excepted from required disclosure
57	63		under Chapter 552, Government Code.
58	64		SECTION 5. This Act takes effect September 1, 2019.
