108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11- SECTION 1. Section 34.008, Health and Safety Code, is
12- amended by adding Subsection (c-1) to read as follows:
13- (c-1) Not later than the 30th business day after receiving a
14- request from the department for records regarding a
15- pregnancy-related death for a specific patient, a hospital,
16- birthing center, or other custodian of the records shall submit the
17- records to the department. A request made under this subsection to
18- a hospital or birthing center must be limited to a patient's medical
19- records.
9+ SECTION 1. Subchapter J, Chapter 1001, Health and Safety
10+ Code, is amended by adding Section 1001.242 to read as follows:
11+ Sec. 1001.242. REQUEST FOR MEDICAL RECORDS RELATED TO
12+ MATERNAL DEATH. (a) Not later than the 30th business day after
13+ receiving a request from the department, a hospital, birthing
14+ center, or other custodian of a patient's medical records shall
15+ submit to the department the medical records of a patient who was
16+ pregnant at the time of death or was pregnant at any time in the year
17+ preceding the patient's death.
18+ (b) Any personally identifying information in a patient's
19+ medical records acquired by the department under this section is
20+ confidential and is not subject to disclosure under Chapter 552,
21+ Government Code.
2022 SECTION 2. This Act takes effect September 1, 2019.
