| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 252.312, Transportation Code, is amended |
|---|
| 12 | 12 | | by amending Subsections (a) and (c) and adding Subsection (b-1) to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (a) Except as provided by Subsections [Subsection] (b) and |
|---|
| 15 | 15 | | (b-1), the commissioners court shall purchase the equipment, |
|---|
| 16 | 16 | | materials, and supplies for the county road department through |
|---|
| 17 | 17 | | competitive bidding in conformity with estimates and |
|---|
| 18 | 18 | | specifications prepared by the county road engineer. |
|---|
| 19 | 19 | | (b-1) A purchase in an amount of $100,000 or less of road |
|---|
| 20 | 20 | | construction or maintenance materials available for purchase from |
|---|
| 21 | 21 | | only one supplier may be made without advertising for competitive |
|---|
| 22 | 22 | | bids or complying with any other competitive procurement |
|---|
| 23 | 23 | | requirement. |
|---|
| 24 | 24 | | (c) A purchase may not be divided or reduced to avoid the |
|---|
| 25 | 25 | | competitive bidding requirement [on a purchase that would otherwise |
|---|
| 26 | 26 | | cost more than $25,000]. |
|---|
| 27 | 27 | | SECTION 2. Section 252.312, Transportation Code, as amended |
|---|
| 28 | 28 | | by this Act, applies only to a purchase commenced on or after the |
|---|
| 29 | 29 | | effective date of this Act. A purchase for which competitive bids |
|---|
| 30 | 30 | | are advertised before the effective date of this Act is governed by |
|---|
| 31 | 31 | | the law in effect on the date the bids were advertised, and that law |
|---|
| 32 | 32 | | is continued in effect for that purpose. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2019. |
