55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a competitive bidding requirement exemption for certain
88 county sole-source purchases of road construction or maintenance
99 materials.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 252.312, Transportation Code, is amended
1212 by amending Subsections (a) and (c) and adding Subsection (b-1) to
1313 read as follows:
1414 (a) Except as provided by Subsections [Subsection] (b) and
1515 (b-1), the commissioners court shall purchase the equipment,
1616 materials, and supplies for the county road department through
1717 competitive bidding in conformity with estimates and
1818 specifications prepared by the county road engineer.
1919 (b-1) A purchase in an amount of $100,000 or less of road
2020 construction or maintenance materials available for purchase from
2121 only one supplier may be made without advertising for competitive
2222 bids or complying with any other competitive procurement
2323 requirement.
2424 (c) A purchase may not be divided or reduced to avoid the
2525 competitive bidding requirement [on a purchase that would otherwise
2626 cost more than $25,000].
2727 SECTION 2. Section 252.312, Transportation Code, as amended
2828 by this Act, applies only to a purchase commenced on or after the
2929 effective date of this Act. A purchase for which competitive bids
3030 are advertised before the effective date of this Act is governed by
3131 the law in effect on the date the bids were advertised, and that law
3232 is continued in effect for that purpose.
3333 SECTION 3. This Act takes effect September 1, 2019.
