66 AN ACT
77 relating to dangerous wild animals; providing penalties; creating a
88 criminal offense; authorizing a fee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 822, Health and Safety Code, is amended
1111 by adding Subchapter F to read as follows:
1212 SUBCHAPTER F. REGULATION OF DANGEROUS WILD ANIMALS
1313 Sec. 822.151. DEFINITIONS. In this subchapter:
1414 (1) "Animal control authority" means the sheriff of a
1515 county in which a dangerous wild animal is located.
1616 (2) "Animal shelter" means a municipal or county
1717 animal shelter or an animal shelter operated by a nonprofit
1818 charitable organization established primarily to shelter and care
1919 for stray and abandoned animals.
2020 (3) "Commission" means the Health and Human Services
2121 Commission.
2222 (4) "Dangerous wild animal" means:
2323 (A) a baboon;
2424 (B) a bear;
2525 (C) a cheetah;
2626 (D) a chimpanzee;
2727 (E) a clouded leopard;
2828 (F) a cougar;
2929 (G) a gorilla;
3030 (H) a hyena;
3131 (I) a jaguar;
3232 (J) a leopard;
3333 (K) a lion;
3434 (L) a macaque;
3535 (M) an orangutan;
3636 (N) a snow leopard;
3737 (O) a tiger; or
3838 (P) any hybrid or subspecies of an animal listed
3939 in this subdivision.
4040 (5) "Owner" means any person who owns, possesses, or
4141 has custody or control of a dangerous wild animal.
4242 (6) "Person" means an individual, partnership,
4343 corporation, trust, estate, joint stock company, foundation, or
4444 association of individuals.
4545 (7) "Wildlife sanctuary" means a charitable
4646 organization that is exempt from taxation under Section 501(c)(3),
4747 Internal Revenue Code of 1986, that is described by Section
4848 170(b)(1)(A)(vi), Internal Revenue Code of 1986, and that:
4949 (A) operates a place of refuge where an abused,
5050 neglected, unwanted, impounded, abandoned, orphaned, or displaced
5151 wild animal is provided care for the animal's lifetime; and
5252 (B) with respect to a dangerous wild animal owned
5353 by or in the custody or control of the organization, does not:
5454 (i) conduct a commercial activity,
5555 including the sale, trade, auction, lease, or loan of the animal or
5656 parts of the animal, or use the animal in any manner in a for-profit
5757 business or operation;
5858 (ii) breed the animal;
5959 (iii) allow direct contact between the
6060 public and the animal; or
6161 (iv) allow off-site transportation and
6262 display of the animal.
6363 Sec. 822.152. DANGEROUS WILD ANIMALS PROHIBITED;
6464 EXCEPTIONS. (a) Except as provided by this section, a person may
6565 not own, possess, sell, transfer, breed, or have custody or control
6666 of a dangerous wild animal.
6767 (b) The prohibition under Subsection (a) does not apply to:
6868 (1) a county, municipality, or agency of this state,
6969 an agency of the United States, or an agent or official of a county,
7070 municipality, or agency acting in the agent's or official's
7171 official capacity;
7272 (2) a research facility, as defined by Section 2(e),
7373 Animal Welfare Act (7 U.S.C. Section 2132(e)), that is licensed by
7474 the secretary of the United States Department of Agriculture under
7575 that Act;
7676 (3) a person holding a Class "A", Class "B", or Class
7777 "C" license issued by the United States secretary of agriculture
7878 under the Animal Welfare Act (7 U.S.C. Section 2131 et seq.) if the
7979 person complies with Section 822.153;
8080 (4) a wildlife sanctuary;
8181 (5) a veterinary hospital providing treatment to a
8282 dangerous wild animal;
8383 (6) a person who holds a rehabilitation permit issued
8484 under Subchapter C, Chapter 43, Parks and Wildlife Code, while
8585 rehabilitating the dangerous wild animal;
8686 (7) a college or university that began displaying a
8787 dangerous wild animal as a mascot before September 1, 2019, and does
8888 not allow direct contact between the public and the mascot;
8989 (8) an animal shelter temporarily housing a dangerous
9090 wild animal seized under Section 822.156 or the written request of
9191 an animal control authority or a law enforcement agency acting
9292 under this subchapter; or
9393 (9) an owner lawfully in possession of a dangerous
9494 wild animal before September 1, 2019, if the owner complies with
9595 Section 822.154.
9696 Sec. 822.153. REGULATION OF CERTAIN LICENSE HOLDERS. A
9797 person described by Section 822.152(b)(3) may possess a dangerous
9898 wild animal if:
9999 (1) the person's license described by that section is
100100 in good standing;
101101 (2) the person has not been convicted of or fined for
102102 an offense involving the abuse or neglect of any animal under local,
103103 state, or federal law;
104104 (3) none of the person's employees with responsibility
105105 for the security or care of the dangerous wild animal have been
106106 convicted of or fined for an offense described by Subdivision (2);
107107 (4) the person has not been cited by the United States
108108 Department of Agriculture under the Animal Welfare Act (7 U.S.C.
109109 Section 2131 et seq.) within the preceding three years for:
110110 (A) failure to allow a facility inspection; or
111111 (B) interference with a facility inspection;
112112 (5) the person has not been cited in an inspection
113113 report by the United States Department of Agriculture under the
114114 Animal Welfare Act for any violations during the preceding three
115115 years related to a dangerous wild animal's health and safety being
116116 jeopardized by:
117117 (A) inappropriate veterinary care;
118118 (B) inappropriate handling of the animal causing
119119 stress or trauma to the animal or a threat to public safety;
120120 (C) inappropriate provision of food, water,
121121 shelter, or space; or
122122 (D) any infraction cited as a direct violation;
123123 (6) the person has not received any official notice of
124124 warning or entered into stipulations, consent decrees, or
125125 settlements with the United States Department of Agriculture during
126126 the preceding five years;
127127 (7) the person discloses any known pending
128128 investigation of the person by the United States Department of
129129 Agriculture;
130130 (8) the person maintains liability insurance in an
131131 amount not less than $100,000 for each occurrence of property
132132 damage, bodily injury, or death caused by a dangerous wild animal
133133 possessed by the person;
134134 (9) the person has not had a license or permit for the
135135 care, possession, exhibition, propagation, or sale of animals
136136 revoked or suspended by any local, state, or federal agency; and
137137 (10) the person has a written plan, including
138138 protocols for training staff on methods of safe recapture, filed
139139 with the appropriate animal control authority for the quick and
140140 safe recapture or destruction for each of the person's dangerous
141141 wild animals if the animal escapes.
142142 Sec. 822.154. REGULATION OF CERTAIN OWNERS; REGISTRATION;
143143 FEE. (a) An owner described by Section 822.152(b)(9) may possess a
144144 dangerous wild animal if the owner:
145145 (1) has veterinary records or acquisition papers that
146146 establish ownership of the dangerous wild animal before September
147147 1, 2019;
148148 (2) has not been convicted of an offense involving
149149 cruelty to an animal;
150150 (3) has not had a license or permit relating to the
151151 care, possession, exhibition, breeding, or sale of a dangerous wild
152152 animal revoked or suspended by any local, state, or federal agency;
153153 (4) has developed and is prepared to implement an
154154 emergency plan for responding to the escape of or an attack by the
155155 dangerous wild animal and has provided the plan to the commission
156156 and animal control authority at the time the owner registers the
157157 animal under Subsection (b);
158158 (5) has provided a list of the owner's dangerous wild
159159 animals to the commission and animal control authority;
160160 (6) does not acquire by any means, including through
161161 purchase, donation, or breeding, an additional dangerous wild
162162 animal on or after September 1, 2019;
163163 (7) does not allow direct contact between the public
164164 and the dangerous wild animal;
165165 (8) registers the dangerous wild animal with the
166166 commission as required by Subsection (b);
167167 (9) notifies the commission of any attack of a human by
168168 the animal not later than 48 hours after the attack; and
169169 (10) immediately notifies the commission and local law
170170 enforcement of any escape of the animal from the owner's custody.
171171 (b) An owner described by Section 822.152(b)(9) shall
172172 annually register the owner's dangerous wild animal with the
173173 commission on a form provided by the commission and pay the
174174 registration fee established by the commission.
175175 (c) The commission may establish and charge a reasonable
176176 registration fee in an amount sufficient to cover the cost of
177177 administering this subchapter.
178178 Sec. 822.155. LIABILITY. (a) An owner described by Section
179179 822.152(b)(9) is liable for all costs incurred in apprehending and
180180 confining a dangerous wild animal that escapes the owner's custody.
181181 (b) The commission, a local law enforcement agency, or an
182182 employee of the commission or agency is not liable to an owner
183183 described by Section 822.152(b)(9) for damages arising from the
184184 escape of the owner's dangerous wild animal, including liability
185185 for property damage, injury, or death caused by the animal or for
186186 injury to or the death of the animal.
187187 Sec. 822.156. SEIZURE OF DANGEROUS WILD ANIMAL; HEARING.
188188 (a) On a showing of probable cause that a dangerous wild animal is
189189 owned, possessed, held in custody, or controlled in violation of
190190 this subchapter, a justice court, county court, or county court at
191191 law in the county in which the dangerous wild animal is located
192192 shall:
193193 (1) order an animal control authority or a peace
194194 officer located in the county to seize the dangerous wild animal;
195195 (2) issue a warrant authorizing the animal's seizure;
196196 and
197197 (3) schedule a hearing to be held on a date not later
198198 than the 10th day after the date the warrant is issued to determine:
199199 (A) whether a violation of this subchapter
200200 occurred; and
201201 (B) the final disposition of the dangerous wild
202202 animal.
203203 (b) The person executing a warrant described by Subsection
204204 (a)(2) shall serve written notice of the hearing described by
205205 Subsection (a)(3) to the owner of the dangerous wild animal at the
206206 time the warrant is executed.
207207 (c) The animal control authority or peace officer shall
208208 seize the dangerous wild animal and provide for the impoundment of
209209 the animal in secure and humane conditions until a court determines
210210 the disposition of the animal and issues appropriate orders. This
211211 subsection does not prevent an animal control authority or peace
212212 officer from impounding an animal on the property in which the
213213 animal is located at the time of the seizure.
214214 (d) A court on finding that a violation of this subchapter
215215 occurred shall assess against the owner of a seized dangerous wild
216216 animal the reasonable costs of caring for the animal, including
217217 boarding and veterinary costs.
218218 (e) A court's decision under this section is final and may
219219 not be appealed.
220220 Sec. 822.157. DISPOSITION OF CERTAIN DANGEROUS WILD
221221 ANIMALS. (a) If a court finds that a person has kept a dangerous
222222 wild animal in violation of this subchapter, the court shall divest
223223 the person's ownership of the animal and order ownership of the
224224 animal to vest in the animal control authority.
225225 (b) The animal control authority shall make a reasonable
226226 effort to place the animal in the custody of a wildlife sanctuary.
227227 If the animal control authority is unable to place the animal with a
228228 wildlife sanctuary, the animal control authority may humanely
229229 euthanize the animal in compliance with state and federal law.
230230 Sec. 822.158. CIVIL PENALTY. (a) A person who violates
231231 this subchapter is liable to the county in which the violation
232232 occurs for a civil penalty of not less than $200 and not more than
233233 $2,000 for each animal with respect to which there is a violation
234234 and for each day that the violation continues.
235235 (b) A county in which the violation occurs may sue to
236236 collect a civil penalty under this section. A civil penalty
237237 collected under this subsection may be retained by the county.
238238 (c) A county that sues under Subsection (b) may also recover
239239 the reasonable costs of investigation, reasonable attorney's fees,
240240 and other costs incurred by the county or an animal control
241241 authority.
242242 Sec. 822.159. INJUNCTION. A county in which a dangerous
243243 wild animal is located or in which a person who is harmed or
244244 threatened with harm by a violation of this subchapter may sue an
245245 owner of a dangerous wild animal to enjoin a violation of this
246246 subchapter.
247247 Sec. 822.160. OFFENSE; PENALTY. (a) A person commits an
248248 offense if the person violates this subchapter. Each animal with
249249 respect to which there is a violation and each day that a violation
250250 continues is a separate offense.
251251 (b) An offense under this section is a Class A misdemeanor.
252252 SECTION 2. Section 42.01(e), Penal Code, is amended to read
253253 as follows:
254254 (e) It is a defense to prosecution for an offense under
255255 Subsection (a)(7) or (9) that the person who discharged the firearm
256256 had a reasonable fear of bodily injury to the person or to another
257257 by a dangerous wild animal as defined by Section 822.151 [822.101],
258258 Health and Safety Code.
259259 SECTION 3. Section 42.092(d), Penal Code, is amended to
260260 read as follows:
261261 (d) It is a defense to prosecution under this section that:
262262 (1) the actor had a reasonable fear of bodily injury to
263263 the actor or to another person by a dangerous wild animal as defined
264264 by Section 822.151 [822.101], Health and Safety Code; or
265265 (2) the actor was engaged in bona fide experimentation
266266 for scientific research.
267267 SECTION 4. On January 1, 2020, Subchapter E, Chapter 822,
268268 Health and Safety Code, is repealed.
269269 SECTION 5. (a) Section 822.113, Health and Safety Code, as
270270 repealed by this Act, applies only to an offense committed before
271271 September 1, 2019. An offense committed before that date is
272272 governed by the law in effect on the date the offense was committed,
273273 and the former law is continued in effect for that purpose. For
274274 purposes of this subsection, an offense was committed before that
275275 date if any element of the offense occurred before that date.
276276 (b) Section 822.160, Health and Safety Code, as added by
277277 this Act, applies only to an offense committed on or after the
278278 effective date of this Act. An offense committed before the
279279 effective date of this Act is governed by the law in effect on the
280280 date the offense was committed, and the former law is continued in
281281 effect for that purpose. For purposes of this section, an offense
282282 was committed before the effective date of this Act if any element
283283 of the offense occurred before that date.
284284 (c) Not later than November 1, 2019, the executive
285285 commissioner of the Health and Human Services Commission shall
286286 adopt rules, establish the fees, and prescribe the application form
287287 necessary to implement Subchapter F, Chapter 822, Health and Safety
288288 Code, as added by this Act.
289289 (d) Notwithstanding Subchapter F, Chapter 822, Health and
290290 Safety Code, as added by this Act, an owner of a dangerous wild
291291 animal is not required to comply with Subchapter F, Chapter 822,
292292 Health and Safety Code, as added by this Act, or rules adopted under
293293 that subchapter until January 1, 2020.
294294 SECTION 6. This Act takes effect September 1, 2019.
