7- relating to school district notification to a parent or guardian of
8- physical fitness assessment results of the parent's or guardian's
9- child.

1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Section 28.004(k), Education Code, is amended to
1214 read as follows:
1315 (k) A school district shall publish in the student handbook
1416 and post on the district's Internet website, if the district has an
1517 Internet website:
1618 (1) a statement of the policies adopted to ensure that
1719 elementary school, middle school, and junior high school students
1820 engage in at least the amount and level of physical activity
1921 required by Section 28.002(l);
2022 (2) a statement of:
2123 (A) the number of times during the preceding year
2224 the district's school health advisory council has met;
2325 (B) whether the district has adopted and enforces
2426 policies to ensure that district campuses comply with agency
2527 vending machine and food service guidelines for restricting student
2628 access to vending machines; and
2729 (C) whether the district has adopted and enforces
2830 policies and procedures that prescribe penalties for the use of
2931 e-cigarettes, as defined by Section 38.006, and tobacco products by
3032 students and others on school campuses or at school-sponsored or
3133 school-related activities; and
3234 (3) a statement providing notice [to parents] that the
33- school district will provide a parent or guardian with a copy of the
34- results of the [they can request in writing their child's] physical
35- fitness assessment of the parent's or guardian's child [results] at
36- the end of the school year.

3739 SECTION 2. Section 38.103, Education Code, is amended by
3840 adding Subsection (a-1) to read as follows:
3941 (a-1) Not later than the last day of the school year, a
40- school district shall provide a parent or guardian with a copy of
41- the results of the physical fitness assessment of the parent's or
42- guardian's child. The results provided to a parent or guardian
43- under this subsection must be clear, precise, and easy to
44- understand.

4546 SECTION 3. This Act applies beginning with the 2019-2020
4647 school year.
4748 SECTION 4. This Act takes effect immediately if it receives
4849 a vote of two-thirds of all the members elected to each house, as
4950 provided by Section 39, Article III, Texas Constitution. If this
5051 Act does not receive the vote necessary for immediate effect, this
5152 Act takes effect September 1, 2019.
