7		-	relating to school district notification to a parent or guardian of
8		-	physical fitness assessment results of the parent's or guardian's
9		-	child.

10	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	13		SECTION 1. Section 28.004(k), Education Code, is amended to
12	14		read as follows:
13	15		(k) A school district shall publish in the student handbook
14	16		and post on the district's Internet website, if the district has an
15	17		Internet website:
16	18		(1) a statement of the policies adopted to ensure that
17	19		elementary school, middle school, and junior high school students
18	20		engage in at least the amount and level of physical activity
19	21		required by Section 28.002(l);
20	22		(2) a statement of:
21	23		(A) the number of times during the preceding year
22	24		the district's school health advisory council has met;
23	25		(B) whether the district has adopted and enforces
24	26		policies to ensure that district campuses comply with agency
25	27		vending machine and food service guidelines for restricting student
26	28		access to vending machines; and
27	29		(C) whether the district has adopted and enforces
28	30		policies and procedures that prescribe penalties for the use of
29	31		e-cigarettes, as defined by Section 38.006, and tobacco products by
30	32		students and others on school campuses or at school-sponsored or
31	33		school-related activities; and
32	34		(3) a statement providing notice [to parents] that the
33		-	school district will provide a parent ~~or guardian~~ with a copy of the
34		-	~~results of~~ the [they can request in writing their child's] physical
35		-	~~fitness~~ assessment of the parent's ~~or guardian's~~ child [results] at
36		-	~~the end of the school~~ year.

37	39		SECTION 2. Section 38.103, Education Code, is amended by
38	40		adding Subsection (a-1) to read as follows:
39	41		(a-1) Not later than the last day of the school year, a
40		-	school district shall provide a parent or guardian with a copy of
41		-	the results of the physical fitness assessment of the parent's or
42		-	guardian's child. The results provided to a parent or guardian
43		-	under this subsection must be clear, precise, and easy to
44		-	understand.

45	46		SECTION 3. This Act applies beginning with the 2019-2020

47	48		SECTION 4. This Act takes effect immediately if it receives
48	49		a vote of two-thirds of all the members elected to each house, as
49	50		provided by Section 39, Article III, Texas Constitution. If this
50	51		Act does not receive the vote necessary for immediate effect, this
51	52		Act takes effect September 1, 2019.
