85 A BILL TO BE ENTITLED
96 AN ACT
107 relating to the prima facie speed limit on certain streets and
118 highways.
129 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1310 SECTION 1. Section 545.352(b), Transportation Code, is
1411 amended to read as follows:
1512 (b) Unless a special hazard exists that requires a slower
1613 speed for compliance with Section 545.351(b), the following speeds
1714 are lawful:
18- (1) [30 miles per hour] in an urban district:
19- (A) on a street other than an alley:
20- (i) 30 miles per hour; or
21- (ii) 25 miles per hour if the street is
22- located in a residence district and is not officially designated or
23- marked as part of the state highway system; and
24- (B) 15 miles per hour in an alley;
15+ (1) 25 [30] miles per hour in an urban district on a
16+ street other than an alley and 15 miles per hour in an alley;
2517 (2) except as provided by Subdivision (4), 70 miles
2618 per hour on a highway numbered by this state or the United States
2719 outside an urban district, including a farm-to-market or
2820 ranch-to-market road;
2921 (3) except as provided by Subdivision (4), 60 miles
3022 per hour on a highway that is outside an urban district and not a
3123 highway numbered by this state or the United States;
3224 (4) outside an urban district:
3325 (A) 60 miles per hour if the vehicle is a school
3426 bus that has passed a commercial motor vehicle inspection under
3527 Section 548.201 and is on a highway numbered by the United States or
3628 this state, including a farm-to-market road; or
3729 (B) 50 miles per hour if the vehicle is a school
3830 bus that:
3931 (i) has not passed a commercial motor
4032 vehicle inspection under Section 548.201; or
4133 (ii) is traveling on a highway not numbered
4234 by the United States or this state;
4335 (5) on a beach, 15 miles per hour; or
4436 (6) on a county road adjacent to a public beach, 15
4537 miles per hour, if declared by the commissioners court of the
4638 county.
47- SECTION 2. Section 545.356(d), Transportation Code, is
48- amended to read as follows:
39+ SECTION 2. Sections 545.356(b-1) and (d), Transportation
40+ Code, are amended to read as follows:
41+ (b-1) Except as provided by Subsection (b-3), the governing
42+ body of a municipality, for a highway or a part of a highway in the
43+ municipality that is not an officially designated or marked highway
44+ or road of the state highway system, may declare a lower speed limit
45+ of not less than 20 [25] miles per hour, if the governing body
46+ determines that the prima facie speed limit on the highway is
47+ unreasonable or unsafe.
4948 (d) The governing body of a municipality that declares a
5049 lower speed limit on a highway or part of a highway under Subsection
5150 (b-1) or (b-3), not later than February 1 of each year, shall
5251 publish on its Internet website and submit to the department a
5352 report that compares for each of the two previous calendar years:
5453 (1) the number of traffic citations issued by peace
5554 officers of the municipality and the alleged speed of the vehicles,
5655 for speed limit violations on the highway or part of the highway;
5756 [(2) the number of warning citations issued by peace
5857 officers of the municipality on the highway or part of the highway;]
5958 and
6059 (2) [(3)] the number of vehicular accidents that
6160 resulted in injury or death and were attributable to speed limit
6261 violations on the highway or part of the highway.
6362 SECTION 3. The change in law made by this Act to Section
6463 545.352(b), Transportation Code, applies only to an offense for a
6564 violation of that section committed on or after the effective date
6665 of this Act. An offense for a violation of that section committed
6766 before the effective date of this Act is governed by the law in
6867 effect on the date the offense was committed, and the former law is
6968 continued in effect for that purpose. For purposes of this section,
7069 an offense was committed before the effective date of this Act if
7170 any element of the offense occurred before that date.
7271 SECTION 4. This Act takes effect September 1, 2019.
