55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to statewide initiatives to improve maternal and newborn
88 health for women with opioid use disorder.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 34, Health and Safety Code, is amended by
1111 adding Section 34.0158 to read as follows:
1212 Sec. 34.0158. OPIOID USE DISORDER MATERNAL AND NEWBORN
1313 HEALTH INITIATIVES. (a) The department, in collaboration with the
1414 task force, shall develop and implement initiatives to:
1515 (1) improve screening procedures to better identify
1616 and care for women with opioid use disorder;
1717 (2) improve continuity of care for women with opioid
1818 use disorder by ensuring that health care providers refer the women
1919 to appropriate treatment and verify the women receive the
2020 treatment;
2121 (3) optimize health care provided to pregnant women
2222 with opioid use disorder;
2323 (4) optimize health care provided to newborns with
2424 neonatal abstinence syndrome by encouraging maternal engagement;
2525 (5) increase access to medication-assisted treatment
2626 for women with opioid use disorder during pregnancy and the
2727 postpartum period; and
2828 (6) prevent opioid use disorder by reducing the number
2929 of opioid drugs prescribed before, during, and following a
3030 delivery.
3131 (b) Before implementing the initiatives described by
3232 Subsection (a), the department may conduct a limited pilot program
3333 in one or more geographic areas of this state to implement the
3434 initiatives at hospitals licensed under Chapter 241 with expertise
3535 in caring for newborns with neonatal abstinence syndrome or related
3636 conditions. The pilot program must conclude not later than March 1,
3737 2020. This subsection expires September 1, 2021.
3838 (c) Using existing resources, the department, in
3939 collaboration with the task force, shall promote and facilitate the
4040 use among health care providers in this state of maternal health
4141 informational materials, including tools and procedures related to
4242 best practices in maternal health to improve obstetrical care for
4343 women with opioid use disorder.
4444 SECTION 2. Not later than December 1, 2020, the Department
4545 of State Health Services shall prepare and submit to the presiding
4646 officers of the standing committees of each house of the
4747 legislature with primary jurisdiction over public health a written
4848 report that evaluates the success of the initiatives developed and
4949 implemented under Section 34.0158, Health and Safety Code, as added
5050 by this Act, and, if applicable, the pilot program conducted under
5151 that section. The report submitted under this section may be
5252 submitted with the report required under Section 34.0156, Health
5353 and Safety Code.
5454 SECTION 3. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2019.
