97 relating to requiring certain persons to receive emergency
108 management training.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 418.005, Government Code, is amended by
13- amending Subsections (a), (b), (c), and (e) and adding Subsection
14- (a-1) to read as follows:

1512 (a) This section applies only to an officer, employee, or
16- paid volunteer [elected law enforcement officer or county judge, or
17- an appointed public officer] of the state or of a political
13+ volunteer [elected law enforcement officer or county judge, or an
14+ appointed public officer] of the state or of a political
1815 subdivision[,] who has management or supervisory responsibilities
1916 and:
2017 (1) whose position description, job duties, or
2118 assignment includes emergency management responsibilities; or
2219 (2) who plays a role in emergency preparedness,
2320 response, or recovery.
24- (a-1) For purposes of this section, a person is considered a
25- paid volunteer only if the person performs duties at an executive or
26- high-ranking management level.
2721 (b) Each person described by Subsection (a) shall complete a
2822 course of training provided or approved by the division of not less
2923 than three hours regarding the responsibilities of state and local
3024 governments under this chapter not later than the 180th day after
3125 the date the person:
3226 (1) takes the oath of office, if the person is required
3327 to take an oath of office to assume the person's duties as a public
3428 officer; or
3529 (2) otherwise assumes responsibilities with the state
3630 or a political subdivision [as a public officer], if the person is
3731 not required to take an oath of office to assume the person's
3832 duties.
3933 (c) The division shall develop and provide a training course
4034 related to the emergency management responsibilities of
41- state-level officers, employees, and paid volunteers and a training
35+ state-level officers, employees, and volunteers and a training
4236 course related to the emergency management responsibilities of
43- officers, employees, and paid volunteers of political
44- subdivisions. The division shall ensure that the training courses
45- satisfy the requirements of Subsection (b).
37+ officers, employees, and volunteers of political subdivisions. The
38+ division shall ensure that the training courses satisfy the
39+ requirements of Subsection (b).
4640 (e) The division or other entity providing the training
4741 shall provide a certificate of course completion to a person
4842 [public officers] who completes [complete] the training required by
4943 this section. A person [public officer] who completes the training
5044 required by this section shall maintain and make available for
5145 public inspection the record of the person's [public officer's]
5246 completion of the training.
5347 SECTION 2. Not later than March 1, 2020, each person who is
5448 required to complete a course of training under Section 418.005,
5549 Government Code, as amended by this Act, must complete the
5650 training.
5751 SECTION 3. This Act takes effect September 1, 2019.
